3. Assumption of Risk
Attendance at this outdoor event is voluntary. Attendees understand that participation may involve risks, including but not limited to weather exposure, heat, uneven ground, slips, falls, crowds, traffic in surrounding areas, and interaction with vendors, equipment, and public spaces. By attending, you voluntarily assume these risks.
4. Release of Liability
To the fullest extent permitted by law, attendees release and hold harmless East Coast Marketplace, Margaret Pace Park, the City of Miami, event organizers, sponsors, vendors, contractors, volunteers, and affiliated parties from any claims, liabilities, losses, damages, or expenses arising out of or related to attendance at the event, except where prohibited by law. Similar attendee terms commonly include release and assumption-of-risk language for event participation.
5. Conduct at the Event
Attendees are expected to behave respectfully toward vendors, staff, volunteers, and other guests. Harassment, discrimination, intoxication, unsafe conduct, disruptive behavior, or failure to follow event rules may result in removal from the event without notice. Event attendee terms commonly require compliance with event rules and applicable laws while on site.
6. Health & Safety
Attendees must follow any instructions provided by the organizer, park staff, security personnel, or public safety officials. The organizer may adjust access, activities, or movement within the event area for safety, weather, or operational reasons.
7. Children & Supervision
Parents and guardians are solely responsible for supervising minors attending the event. Children must remain under adult supervision at all times.
8. Personal Property
Attendees are responsible for their own personal belongings. The organizer is not responsible for lost, stolen, or damaged items during or after the event. Event terms commonly place responsibility for personal property on the attendee.
9. Photography & Media Release
By attending the event, you consent to being photographed, filmed, or recorded in public areas of the event and grant East Coast Marketplace permission to use your image, likeness, and voice in promotional, editorial, marketing, and social media materials without compensation. Similar attendee terms commonly include image and media release language tied to event participation.
10. Weather & Event Changes

12. Vendors & Purchases
Purchases made from vendors are transactions between the attendee and the individual vendor. The organizer is not responsible for vendor products, services, pricing, refunds, exchanges, or disputes related to purchases made at the event. Similar event terms often distinguish organizer responsibility from attendee-vendor transactions.
13. Right to Refuse Entry or Remove Attendees
The organizer reserves the right to refuse entry or remove any attendee for violation of these terms, unsafe behavior, illegal conduct, or failure to comply with instructions from event staff or venue personnel.
### COUNTERFEIT, TRADEMARK & INTELLECTUAL PROPERTY POLICY
The sale, display, distribution, promotion, or possession of counterfeit merchandise, unauthorized replicas, imitation products, trademark-infringing goods, copyright-infringing goods, or any merchandise that violates intellectual property rights is strictly prohibited at all East Coast Marketplace events.
This prohibition includes, but is not limited to, merchandise bearing unauthorized brand names, logos, trademarks, designer marks, sports team logos, copyrighted artwork, characters, or any other protected intellectual property.
By submitting this application and participating in any East Coast Marketplace event, the Vendor represents and warrants that all products offered for sale are authentic, legally obtained, and do not infringe upon any trademark, copyright, patent, trade dress, or other intellectual property rights.
The Vendor assumes full responsibility and liability for all merchandise displayed, promoted, or sold at the event and agrees to indemnify and hold harmless East Coast Marketplace, its owners, employees, contractors, venue partners, sponsors, and event hosts from any claims, damages, fines, penalties, legal actions, losses, or expenses arising from the sale or display of such merchandise.
East Coast Marketplace reserves the right to inspect merchandise at any time before, during, or after the event.
If East Coast Marketplace staff, venue representatives, law enforcement officers, governmental agencies, or other authorized entities reasonably believe that counterfeit, unauthorized, trademark-infringing, or otherwise unlawful merchandise is being displayed, promoted, or sold, the Vendor may be required to immediately remove such merchandise and/or leave the event without notice and without refund.
East Coast Marketplace further reserves the right to report suspected violations to the appropriate trademark owners, intellectual property rights holders, law enforcement agencies, governmental authorities, or other entities responsible for enforcing intellectual property laws.
Vendors found to be selling or displaying counterfeit, unauthorized, or infringing merchandise may be immediately removed from the event, permanently prohibited from participating in future East Coast Marketplace events, and may be subject to legal action by the appropriate rights holders or authorities.
The Vendor is solely responsible for verifying the authenticity, legality, and origin of all products offered for sale.
