Terms and Conditions By submitting this application, you (“Performer”) acknowledge and agree to the following Terms and Conditions with Goin’ Social Events (“Organizer”). 1. Application Submission Submission of this application does not guarantee selection, booking, performance placement, compensation, or any other opportunity. Organizer reserves the right to review, accept, reject, or remove any application at its sole discretion. Performer agrees that all information submitted must be accurate, complete, and current. Providing false, misleading, or materially incomplete information may result in rejection or removal from consideration. 2. Application Term Applications submitted through this process will remain on file through December 31, 2028, unless withdrawn by the Performer or removed by the Organizer. Performer is responsible for keeping contact information, availability, booking rates, technical requirements, and other submitted information current. If Performer no longer performs, is no longer accepting bookings, or no longer wishes to be considered for opportunities, Performer agrees to withdraw their application. 3. Booking & Performance Opportunities Submitting an application does not create a booking agreement, performance agreement, employment relationship, partnership, agency relationship, or other contractual obligation between Performer and Organizer. If selected for an opportunity, the applicable performance date, location, compensation, production requirements, and other terms will be communicated separately. A booking is not considered confirmed unless the applicable terms have been agreed to in writing by the appropriate parties. Performer agrees to comply with all confirmed performance, venue, production, technical, and scheduling requirements. 4. Compensation & Expenses Application submission does not guarantee compensation. Any performance fee, guarantee, percentage of ticket sales, door split, travel reimbursement, lodging, hospitality, or other compensation will be established separately in writing. Unless otherwise agreed in writing, Performer is responsible for their own travel, transportation, lodging, meals, equipment, personnel, insurance, and other expenses associated with performing. 5. Event Changes & Cancellation Organizer reserves the right, subject to any separate written performance agreement, to modify, reschedule, postpone, relocate, or cancel an event due to operational requirements, venue availability, weather, safety concerns, government restrictions, force majeure, or other circumstances affecting the event. Any compensation or obligations resulting from a confirmed booking will be governed by the applicable written performance agreement. 6. Conduct, Safety & Compliance Performer agrees to comply with all applicable federal, state, and local laws, including the laws of the State of Georgia. Performer must comply with all applicable venue policies, event rules, safety requirements, and reasonable instructions from Organizer and event personnel. Illegal drug use, unsafe conduct, violence, harassment, or other conduct that creates a safety risk or materially disrupts an event is prohibited. Organizer may remove a Performer from an event or terminate consideration for future opportunities when reasonably necessary due to safety, conduct, legal, or operational concerns. 7. Music, Content & Intellectual Property Performer represents and warrants that Performer has the necessary rights, licenses, permissions, and authority to submit and use all music, recordings, photographs, videos, logos, artwork, and other materials provided through this application. By submitting promotional materials, Performer grants Organizer a non-exclusive, royalty-free license to use those materials for purposes reasonably related to evaluating, promoting, marketing, and publicizing Performer and potential or confirmed events. This license does not transfer ownership of Performer’s intellectual property. 8. Media & Promotion Performer acknowledges that events may be photographed, filmed, recorded, livestreamed, or otherwise documented. Unless otherwise agreed in writing, Organizer may use event-related photographs, video, audio, and other promotional content featuring Performer for legitimate promotional, marketing, advertising, archival, and social media purposes related to Organizer and its events. 9. Insurance & Personal Property Performer is responsible for maintaining any insurance reasonably required for Performer’s activities, equipment, personnel, and performance. Organizer is not responsible for loss, theft, or damage to Performer’s personal property, equipment, instruments, vehicles, or other belongings, except to the extent caused by Organizer’s gross negligence or willful misconduct or otherwise required by applicable law. 10. Limitation of Liability To the extent permitted by Georgia law, Performer assumes the ordinary risks associated with participation in events and performances. Nothing in these Terms and Conditions is intended to waive or limit any liability that cannot legally be waived or limited under applicable Georgia law. 11. Independent Performer Unless otherwise agreed in a separate written agreement, Performer is an independent contractor and is not an employee, partner, joint venturer, or agent of Organizer. Performer is solely responsible for Performer’s own taxes, personnel, licenses, permits, insurance, and legal obligations arising from Performer’s activities. 12. Governing Law & Venue These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of Georgia, without regard to conflict-of-law principles. To the extent permitted by applicable law, any legal action or proceeding arising out of or relating to these Terms and Conditions or the application process shall be brought in the state or federal courts located in Fulton County, Georgia, and Performer consents to the jurisdiction and venue of such courts. 13. Changes to Terms Organizer reserves the right to update or modify these Terms and Conditions from time to time. The version of these Terms and Conditions in effect at the time of application submission will govern the application unless otherwise required by law or agreed to in writing. 14. Entire Understanding These Terms and Conditions govern the talent application and submission process only. Any confirmed performance or booking will be subject to the terms of the applicable written booking, performance, or artist agreement, which may contain additional terms and conditions. 15. Acceptance By submitting this application, Performer confirms that they have read, understood, and agree to these Terms and Conditions and that the information provided in the application is accurate to the best of their knowledge.
