Frightmare is an indoor Halloween shopping experience featuring talented artisans, makers, Halloween creators, collectors, specialty food vendors, and small businesses offering unique spooky, fall, horror, gothic, paranormal, fantasy, and Halloween-inspired merchandise.Our goal is to create a fun, family-friendly shopping experience while maintaining a professional, welcoming atmosphere for both vendors and shoppers. Every event is carefully curated to provide a diverse selection of quality vendors and an unforgettable Halloween experience.Please read these Terms & Conditions carefully before submitting your application.---## APPLICATION & ACCEPTANCESubmission of an application does **not** guarantee acceptance.Vendors are selected based on:* Product category* Product quality* Booth presentation* Professionalism* Overall event needsFrightmare and Shop and Stroll Markets reserve the right to limit vendor categories to maintain a balanced shopping experience.The Organizer reserves the right to deny or remove any vendor who does not meet event standards or professional expectations.---## PRODUCT STANDARDSFrightmare welcomes vendors offering handmade, handcrafted, original artwork, seasonal décor, Halloween collectibles, specialty foods, boutique merchandise, and other unique products that fit the theme of the event.The following items are strictly prohibited:* Counterfeit or bootleg merchandise* Trademarked or copyrighted merchandise without proper licensing (including Disney, Universal, Marvel, etc.)* AI-generated artwork or AI-created products represented as handmade* Illegal or prohibited itemsA limited number of approved small businesses and direct sales (MLM) companies may be accepted.Violation of these policies may result in immediate removal from the event without refund.---## VENDOR PROMOTIONAccepted vendors agree to help promote the event.Vendors agree to:* Share official event graphics on social media* Invite customers, family, and friends* Provide quality product photos if requested* Allow Shop and Stroll Markets to use their business name, logo, photographs, and booth images for promotional purposes without compensationMarketing is a shared effort, and vendor participation helps create successful events for everyone.---## VENDOR SPACE & SETUPThis is an **INDOOR** event located at:**Holly Hill Mall – Space 300**309 Huffman Mill RoadBurlington, NC 27215Each vendor space includes:* One 6-foot table space* One chairVendors must provide:* Floor-length table covering* Business signage* Displays that fit entirely within their assigned spaceAdditional spaces may be purchased, subject to availability and approval.Maximum purchase: **Three (3) vendor spaces**Booth assignments will be provided during check-in.Vendors must:* Remain within their assigned space* Keep all merchandise and displays inside their booth boundaries* Keep aisles and walkways clear at all timesThe following are not permitted:* Booth sharing* Subleasing vendor space* Merchandise extending into walkways* Floor displays that create trip hazardsElectricity and Wi-Fi are **not guaranteed**.---## EVENT SCHEDULE**Vendor Check-In & Setup:** 8:30 AM – 10:00 AM**Event Hours:** 10:00 AM – 3:00 PM**Breakdown:** Begins at 3:00 PMVendors must remain set up for the entire event.Early breakdown is not permitted.Late arrivals without prior approval may result in forfeiture of booth space and vendor fees.---## REFUND & CANCELLATION POLICYAll vendor fees are:* Non-refundable* Non-transferableNo refunds, credits, or transfers will be issued under any circumstances.Refunds will not be provided due to:* Vendor cancellation* Low attendance* Poor sales* Weather* Schedule changes* Venue adjustments* Public safety incidents* Emergencies---## FORCE MAJEUREShop and Stroll Markets and Frightmare shall not be held liable for cancellations, delays, or modifications caused by circumstances beyond reasonable control, including but not limited to:* Severe weather* Natural disasters* Government mandates* Venue closures* Public safety incidents* Emergencies* Utility failures* Other unforeseen circumstancesVendor understands these situations are outside the control of the Organizer and venue.Vendor fees remain non-refundable.---## CHARGEBACK POLICYBy submitting payment, Vendor agrees that all sales are final.Vendor agrees not to initiate:* Chargebacks* Payment disputes* Claims through payment processorsAny vendor initiating a chargeback may be permanently prohibited from future Shop and Stroll Markets events.The Organizer reserves the right to pursue collection of unpaid fees and associated legal costs.---## LIABILITYVendor assumes full responsibility for:* Personal injury* Property damage* Theft* Loss of merchandise* Damage to equipmentShop and Stroll Markets, Frightmare, Holly Hill Mall, event staff, volunteers, venue partners, and affiliates shall not be held liable for any injury, loss, theft, or damage occurring before, during, or after the event.---## INSURANCEProduct liability insurance is optional and is the responsibility of each vendor if they choose to obtain it.Shop and Stroll Markets does not require vendors to carry product liability insurance; however, event insurance does **not** provide coverage for:* Vendor merchandise* Products* Displays* Tables* Chairs* Personal property* Product-related claims---## PROFESSIONAL CONDUCTVendors are expected to conduct themselves professionally at all times.The following may result in immediate removal without refund:* Harassment* Discrimination* Aggressive behavior* Disruptive conduct* Failure to follow Organizer instructions---## COMPLIANCE WITH LAWSVendors are responsible for complying with all applicable local, state, and federal laws, including:* Sales tax requirements* Required permits and licenses* Health Department regulationsFood vendors must comply with all applicable North Carolina health and food safety regulations.---## NO VERBAL AGREEMENTSNo verbal promises, statements, or agreements made by Shop and Stroll Markets, Frightmare, event staff, volunteers, or venue partners shall modify these Terms & Conditions.Only these written Terms & Conditions are binding.---## GOVERNING LAWThis agreement shall be governed by the laws of the State of North Carolina.Any legal action arising from this agreement shall be filed exclusively in the appropriate courts within North Carolina.---## SEVERABILITYIf any provision of these Terms & Conditions is determined to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.---## AGREEMENTBy submitting an application and payment, Vendor acknowledges that they have read, understood, and agree to these Vendor Terms & Conditions.Submission of an application and payment constitutes acceptance of this legally binding agreement.---Questions?email shopandstrollmarkets@
