COMPREHENSIVE EVENT TERMS AND CONDITIONS, RELEASE OF LIABILITY, ASSUMPTION OF RISK, ALCOHOL ACKNOWLEDGMENT, VENDOR REQUIREMENTS, AND INDEMNIFICATION AGREEMENT

BY PURCHASING A TICKET, SUBMITTING AN APPLICATION, ACCEPTING PARTICIPATION, ENTERING EVENT PREMISES, SETTING UP, EXHIBITING, SPONSORING, VENDING, PERFORMING, VOLUNTEERING, CONTRACTING, OR PARTICIPATING IN ANY CAPACITY, EACH PERSON OR ENTITY ACKNOWLEDGES THAT THEY HAVE READ, UNDERSTOOD, AND AGREED TO BE LEGALLY BOUND BY THESE TERMS AND CONDITIONS.
This Agreement applies to all attendees, ticket holders, vendors, food vendors, exhibitors, sponsors, nonprofit partners, community partners, contractors, subcontractors, volunteers, entertainers, performers, speakers, media representatives, employees, agents, guests, invitees, and any person or entity present on event premises (collectively referred to as "Participants").
RIGHT OF ADMISSION AND PARTICIPATION
Organizer reserves the absolute right to approve, deny, suspend, remove, eject, or revoke participation, admission, vendor status, sponsorship status, exhibitor status, or event access at any time, with or without notice or refund, for any lawful reason.
Any determination made by Organizer, venue management, security personnel, event staff, law enforcement, or venue representatives shall be final.
AGE RESTRICTIONS
All Participants consuming alcoholic beverages or participating in bourbon tastings must be twenty-one (21) years of age or older and possess valid government-issued identification.
Organizer reserves the right to verify age and refuse service or participation to any individual unable or unwilling to provide valid identification.
ASSUMPTION OF RISK
Participants acknowledge that attendance, participation, setup, teardown, vending, sponsorship activities, food preparation, alcohol service, entertainment activities, and all event operations involve inherent risks including but not limited to:
• Slips, trips, and falls
• Vehicle and transportation incidents
• Crowd-related injuries
• Weather-related hazards
• Alcohol consumption and impairment
• Food allergies and foodborne illness
• Burns, smoke, cooking equipment, grills, smokers, propane equipment, and heat-producing devices
• Electrical hazards
• Vendor operations and equipment
• Theft or property damage
• Exposure to communicable illnesses
• Acts or omissions of third parties
• Serious bodily injury, disability, illness, or death
Participants voluntarily assume all known and unknown risks associated with participation.
ALCOHOL ACKNOWLEDGMENT
Participants acknowledge that alcoholic beverages may be served, sampled, sold, promoted, or consumed during the event.
Participants agree:
• To consume alcohol responsibly
• Not to operate a vehicle while impaired
• To comply with all applicable laws
• To accept full responsibility for all consequences arising from alcohol consumption
Participants who appear intoxicated may be denied service, denied participation, or removed from the event without refund.
FOOD CONSUMPTION AND ALLERGY DISCLAIMER
Participants understand that food products may contain or come into contact with allergens including peanuts, tree nuts, dairy, eggs, soy, wheat, gluten, shellfish, seafood, and other allergens.
Organizer makes no guarantees regarding ingredients, preparation methods, contamination prevention, or dietary accommodations.
Consumption of food or beverages is solely at the Participant's own risk.
VENDOR, FOOD VENDOR, AND EXHIBITOR SAFETY REQUIREMENTS
All vendors, food vendors, exhibitors, sponsors, and contractors shall comply with all federal, state, county, municipal, venue, fire marshal, health department, and Organizer requirements.
In addition:
A. Fire Suppression Requirements
All cooking vendors utilizing grills, smokers, fryers, propane equipment, generators, or heat-producing equipment must maintain appropriate fire suppression equipment and fire extinguishers in accordance with applicable fire codes and Fire Marshal requirements.
Failure to maintain required fire suppression equipment may result in immediate removal from the event.
B. Open Flame Restrictions
No open flames, cooking equipment, grills, smokers, fryers, propane burners, or heat-producing devices may be operated directly underneath any tent, canopy, or temporary structure.
Any vendor requiring cooking operations must provide sufficient clearance and additional setup space as required by fire safety regulations and venue requirements.
Participants requiring expanded cooking or safety areas must notify Organizer in advance for approval.
C. Permits and Compliance
Participants are solely responsible for obtaining and maintaining all required licenses, permits, inspections, certifications, and approvals required for their operations.
Organizer assumes no responsibility for a Participant's failure to obtain necessary approvals.
PARKING AND OVERSIZED VEHICLES
Standard event parking shall be governed by venue regulations.
Oversized vehicles, trailers, food trucks, box trucks, RVs, and support vehicles may not be permitted in standard event parking areas.
Per venue regulations, designated oversized vehicle parking is located approximately four (4) to six (6) minutes from the event venue.
Participants are responsible for transportation between remote parking areas and the event site.
Organizer reserves the right to direct, relocate, or restrict parking as necessary.
RELEASE OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY GEORGIA LAW, EACH PARTICIPANT RELEASES, WAIVES, DISCHARGES, AND COVENANTS NOT TO SUE:
• Goin' Social Events
• The Battery Atlanta
• Property owners and managers
• Sponsors and nonprofit partners
• Vendors and exhibitors
• Distilleries, breweries, beverage providers, and food providers
• Contractors and subcontractors
• Volunteers and event staff
• Security personnel
• Venue management
• Employees, officers, directors, agents, representatives, successors, and assigns
(collectively, the "Released Parties")
from any and all claims, liabilities, losses, damages, expenses, judgments, costs, and attorneys' fees arising out of attendance, participation, setup, teardown, sponsorship activities, vendor operations, food preparation, alcohol consumption, transportation, or event-related activities.
INDEMNIFICATION
Each Participant agrees to defend, indemnify, and hold harmless the Released Parties from and against any and all claims, liabilities, damages, settlements, penalties, fines, expenses, costs, and attorneys' fees arising from:
• Participant conduct
• Vendor operations
• Alcohol consumption
• Food service activities
• Property damage
• Personal injury claims
• Violations of law
• Violations of these Terms and Conditions
• Claims brought by third parties arising from Participant actions or omissions
This obligation survives the conclusion of the event.
DAMAGE TO PROPERTY
Participants shall be financially responsible for all damages caused by themselves, their employees, contractors, agents, guests, invitees, vendors, representatives, or equipment.
Organizer reserves all legal rights to recover repair costs, replacement costs, cleanup expenses, legal fees, and associated damages.
MEDICAL EMERGENCIES
Organizer may, but is under no obligation to, arrange emergency medical assistance.
Participants authorize emergency medical treatment if deemed necessary and agree to bear sole responsibility for all resulting expenses.
PHOTOGRAPHY, VIDEO, LIVESTREAM, AND MEDIA RELEASE
Participants grant Organizer an unrestricted, perpetual, irrevocable, worldwide, royalty-free license to use their name, business name, logo, image, likeness, voice, appearance, booth display, products, promotional materials, statements, and recordings for promotional, advertising, marketing, archival, public relations, livestreaming, and social media purposes.
Participants waive all rights to compensation, approval, inspection, or ownership of such media.
PROHIBITED ITEMS
The following are prohibited unless specifically authorized:
• Illegal drugs
• Controlled substances
• Firearms
• Weapons of any kind
• Fireworks
• Explosives
• Hazardous materials
• Unauthorized alcohol
• Outside alcohol
• Unauthorized drones
• Any item deemed unsafe by event management or venue management
EVENT MODIFICATIONS AND FORCE MAJEURE
Organizer reserves the right to modify, postpone, suspend, relocate, or cancel any portion of the event due to weather, public safety concerns, venue requirements, governmental action, utility failures, emergencies, acts of God, terrorism, civil disturbances, force majeure events, or circumstances beyond Organizer's reasonable control.
GOVERNING LAW AND VENUE
This Agreement shall be governed by the laws of the State of Georgia.
Any dispute arising from attendance, participation, sponsorship, vending, exhibiting, ticket purchase, or this Agreement shall be brought exclusively in the state or federal courts located in Cobb County, Georgia.
SEVERABILITY
If any provision of this Agreement is determined to be invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect.
ENTIRE AGREEMENT
These Terms and Conditions constitute the entire agreement between Organizer and all Participants and supersede all prior understandings, representations, communications, and agreements regarding participation in Bourbon & Brisket 2026.
ACKNOWLEDGMENT
BY PURCHASING A TICKET, SUBMITTING AN APPLICATION, ACCEPTING PARTICIPATION, SETTING UP, SPONSORING, EXHIBITING, VENDING, ENTERING EVENT PREMISES, OR PARTICIPATING IN ANY CAPACITY, EACH PARTICIPANT ACKNOWLEDGES THAT THEY HAVE READ THIS AGREEMENT, UNDERSTAND ITS TERMS, VOLUNTARILY ACCEPT ITS CONDITIONS, ASSUME ALL RISKS ASSOCIATED WITH PARTICIPATION, AND AGREE TO BE LEGALLY BOUND BY ITS PROVISIONS.
