Terms & Conditions
# FOODEES FEST ATTENDEE TERMS AND CONDITIONS **Effective Date: July 16, 2026** These Attendee Terms and Conditions (“Terms”) apply to all persons who register for, enter, attend, or participate in any event produced, managed, or promoted by Foodees LLC, doing business as Foodees Fest (“Foodees Fest,” “we,” “us,” or “our”). By registering for or attending a Foodees Fest event (“Event”), you acknowledge that you have read, understood, and agreed to these Terms. A parent or legal guardian who registers for or attends an Event with a minor agrees to these Terms on behalf of both themselves and the minor. ## 1. Free Registration and Admission 1.1 Foodees Fest generally offers free general admission. Registration helps Foodees Fest, participating vendors, venues, and local partners estimate attendance and prepare staffing, food, inventory, parking, sanitation, security, and other operational needs. 1.2 Unless otherwise stated on the applicable Event page, advance registration is not required for general admission. 1.3 Registration does not guarantee immediate entry, parking availability, seating, access to a particular area, participation in an activity, or admission after an Event reaches its permitted or safe operating capacity. 1.4 Foodees Fest and the venue may temporarily delay or limit entry because of crowd levels, weather, safety conditions, government instructions, emergency operations, or other circumstances. 1.5 Registration may be required to participate in giveaways, promotions, contests, special activities, or designated ticketed experiences. ## 2. Event Information and Changes 2.1 Event dates, operating hours, locations, entrances, layouts, parking arrangements, vendor lineups, activities, attractions, and other Event details are subject to change. 2.2 Foodees Fest may modify, delay, pause, relocate, reschedule, shorten, extend, suspend, or cancel all or part of an Event because of: * Severe or unsafe weather; * Government or public-safety instructions; * Venue requirements; * Emergency conditions; * Utility or infrastructure problems; * Vendor or staffing changes; * Conditions beyond Foodees Fest’s reasonable control; or * Any circumstance that Foodees Fest reasonably determines could affect attendee, vendor, staff, or public safety. 2.3 Foodees Fest does not guarantee the appearance of any specific vendor, food truck, business, sponsor, attraction, performer, product, menu item, or activity. 2.4 Attendees are responsible for checking the Event page, Foodees Fest social-media pages, registration communications, and onsite notices for current information. 2.5 Foodees Fest is not responsible for travel, lodging, transportation, childcare, parking, or other expenses incurred because of an Event change, delay, relocation, rescheduling, suspension, or cancellation, except where otherwise required by law. ## 3. Attendee Conduct 3.1 Attendees must comply with: * These Terms; * Posted Event and venue rules; * Applicable federal, state, and local laws; * Safety announcements; * Emergency instructions; and * Reasonable directions given by Foodees Fest staff, venue representatives, security personnel, emergency responders, government officials, or law-enforcement officers. 3.2 The following conduct is prohibited: * Threatening, abusive, discriminatory, harassing, intimidating, or disorderly behavior; * Fighting, physical aggression, or encouraging violence; * Damaging or interfering with vendor, venue, attendee, sponsor, or Event property; * Entering restricted, staff-only, vendor-only, loading, operational, or emergency areas; * Blocking entrances, exits, fire lanes, vendor access, pedestrian routes, or emergency equipment; * Soliciting, selling, distributing materials, collecting donations, conducting surveys, or promoting a business without written authorization; * Unauthorized demonstrations, performances, amplified sound, or commercial activity; * Fraudulent registration, impersonation, theft, or attempted theft; * Interfering with Event operations or another person’s ability to safely enjoy the Event; and * Any behavior Foodees Fest reasonably determines is unsafe, disruptive, unlawful, or inconsistent with the family-friendly nature of the Event. 3.3 Foodees Fest may deny admission, remove an attendee, contact law enforcement, or prohibit an attendee from participating in future Events when the attendee violates these Terms or presents a safety or operational concern. 3.4 An attendee who is removed or denied entry is not entitled to reimbursement for travel, parking, lodging, purchases, or other related expenses. ## 4. Security and Prohibited Items 4.1 Attendees and their belongings may be subject to reasonable security procedures, including visual inspection, bag inspection, entry screening, or other venue-required safety measures. 4.2 Refusal to comply with a lawful and reasonable security procedure may result in delayed or denied entry. 4.3 Prohibited items may include: * Illegal drugs or controlled substances; * Weapons or dangerous items prohibited by law, the venue, or Event policy; * Fireworks, explosives, flammable materials, or incendiary devices; * Outside alcohol; * Unauthorized drones or remotely operated aircraft; * Large signs, structures, equipment, or objects that interfere with pedestrian movement; * Unauthorized vending, sampling, advertising, or promotional materials; * Items that create an unreasonable safety, sanitation, operational, or security risk; and * Any additional items identified on the Event page, venue rules, or onsite signage. 4.4 Permitted and prohibited items may vary by location. Venue-specific rules control when they are more restrictive than these general Terms. ## 5. Children and Minors 5.1 Foodees Fest is an all-ages event unless an Event page states otherwise. 5.2 Children must remain under the supervision of a responsible parent or legal guardian. 5.3 Parents and guardians are responsible for the safety, behavior, purchases, and activities of minors in their care. 5.4 Foodees Fest staff and vendors are not responsible for supervising children. 5.5 A parent or guardian who allows a minor to participate in an activity represents that the minor is capable of safely participating and accepts responsibility for the minor’s participation. ## 6. Food, Beverages, Allergies, and Vendor Purchases 6.1 Food, beverages, merchandise, products, and services available at an Event are generally sold directly by independently operated vendors. 6.2 Individual vendors determine their own: * Menus and product selections; * Prices; * Payment methods; * Refund or exchange policies; * Product availability; * Ingredients; * Preparation methods; and * Customer-service procedures. 6.3 Unless Foodees Fest is specifically identified as the seller, purchases are transactions between the attendee and the individual vendor. Questions, concerns, refund requests, or disputes regarding a purchase should be directed to that vendor. 6.4 Attendees with food allergies, intolerances, dietary restrictions, or other medical concerns are responsible for speaking directly with the vendor before purchasing or consuming an item. 6.5 Foodees Fest does not independently verify every ingredient, preparation method, allergen statement, product claim, or representation made by a vendor. 6.6 Cross-contact may occur in food trucks, tents, shared kitchens, preparation spaces, and service areas. Attendees should not assume that any food or beverage is free from a particular allergen unless the serving vendor confirms that information. 6.7 Menu items and products are available while supplies last. Registration or attendance does not guarantee the availability of any particular item. ## 7. Pets and Service Animals 7.1 Pet policies vary by Event and venue. Pets may be prohibited at certain Events even when they have been permitted at other Foodees Fest locations. 7.2 Attendees must review the applicable Event page and venue rules before bringing a pet. 7.3 Where pets are permitted, they must: * Be appropriately restrained and under the owner’s control; * Remain with a responsible handler; * Not create a safety concern or unreasonable disruption; * Not enter restricted food-preparation or operational areas; and * Have all waste promptly removed by the owner. 7.4 Pet owners are responsible for injuries, damage, disruption, or cleanup caused by their animals. 7.5 Service animals are permitted as required by applicable law. 7.6 A service animal must remain under the handler’s control. A service animal may be required to leave when legally permitted, including when the animal is not under control and the handler does not take effective action, or when the animal is not housebroken. 7.7 Emotional-support, comfort, or companion animals are not automatically considered service animals under applicable law. ## 8. Accessibility 8.1 Foodees Fest seeks to provide an accessible and welcoming experience consistent with applicable law and the features of each venue. 8.2 Accessibility conditions, surfaces, parking arrangements, distances, seating, and available facilities may vary by location. 8.3 Attendees requesting a reasonable accessibility accommodation should contact Foodees Fest as early as reasonably possible at **[info@](mailto:info@)**. 8.4 Foodees Fest will evaluate accommodation requests in coordination with the applicable venue and local partners. Certain requests may be limited by the location, available facilities, safety requirements, or circumstances outside Foodees Fest’s control. ## 9. Weather and Outdoor Conditions 9.1 Foodees Fest Events are generally held rain or shine unless conditions become unsafe. 9.2 Outdoor Events may involve heat, cold, rain, wind, uneven ground, mud, wet surfaces, insects, crowds, loud sounds, vehicle movement, temporary structures, electrical equipment, generators, cooking equipment, and other conditions commonly associated with outdoor festivals. 9.3 Attendees are responsible for monitoring weather conditions and preparing appropriately, including bringing suitable clothing, footwear, water, sun protection, or other personal necessities. 9.4 Foodees Fest may pause operations, direct attendees to leave an area, delay entry, evacuate the Event, or close the Event when weather or other conditions create a safety concern. 9.5 Attendees must promptly follow all weather and emergency instructions. ## 10. Assumption of Risk 10.1 Attendance and participation are voluntary. 10.2 Attendees understand that entering or participating in a public festival involves ordinary and inherent risks, including risks associated with: * Crowds and pedestrian traffic; * Slips, trips, and falls; * Weather and outdoor conditions; * Food consumption and allergic reactions; * Temporary structures and equipment; * Parking areas and moving vehicles; * Activities, games, or attractions; * Interaction with vendors, animals, and other attendees; * Exposure to communicable illnesses; and * Loss of or damage to personal property. 10.3 To the fullest extent permitted by law, attendees voluntarily accept the risks associated with attending or participating in the Event. 10.4 Nothing in these Terms limits liability that cannot legally be limited or excluded. ## 11. Personal Property, Parking, and Transportation 11.1 Attendees are responsible for their vehicles, valuables, purchases, strollers, mobility equipment, and other personal belongings. 11.2 Foodees Fest is not responsible for lost, stolen, misplaced, abandoned, or damaged personal property except to the extent responsibility cannot legally be excluded. 11.3 Found property may be turned over to the venue, property owner, local law enforcement, or another designated lost-and-found location. 11.4 Parking availability, parking locations, fees, traffic patterns, entrances, exits, and accessible parking are controlled by the applicable venue, property owner, municipality, or parking operator. 11.5 Parking is not guaranteed by registration. Vehicles parked illegally or contrary to posted rules may be ticketed, towed, or removed at the vehicle owner’s expense. ## 12. Photography, Video, and Media Release 12.1 Photography, livestreaming, audio recording, and video recording may occur throughout the Event. 12.2 By entering the Event, attendees acknowledge that they may appear incidentally or directly in photographs, video, audio recordings, livestreams, security recordings, interviews, or other media created by Foodees Fest, its contractors, sponsors, partners, vendors, media representatives, or attendees. 12.3 To the fullest extent permitted by law, attendees grant Foodees Fest and its authorized representatives permission to photograph, film, record, reproduce, edit, publish, display, distribute, and otherwise use their image, appearance, voice, and likeness in connection with Event documentation, advertising, marketing, publicity, social media, and other lawful business purposes without compensation or further approval. 12.4 A parent or legal guardian attending with a minor grants the same permission regarding the minor. 12.5 Personal photography is generally permitted. Commercial photography, organized photo shoots, media production, interviews, drone use, or photography that interferes with vendors, attendees, or Event operations requires prior written authorization. 12.6 Attendees may not use another attendee’s image or likeness for unlawful, harassing, defamatory, exploitative, or unauthorized commercial purposes. ## 13. Giveaways and Promotions 13.1 Registration may provide entry into a giveaway, drawing, or promotional opportunity when stated on the registration page or Event materials. 13.2 Giveaways and promotions may be subject to separate official rules, eligibility requirements, deadlines, geographic restrictions, prize conditions, and notification procedures. 13.3 Where separate official rules apply, those rules control over these general Terms regarding the applicable promotion. 13.4 Registration does not guarantee that an attendee will win or receive a prize. 13.5 Foodees Fest may substitute, modify, or withdraw a prize when permitted by the applicable promotional rules and law. ## 14. Registration Information and Communications 14.1 Attendees must provide accurate information when registering. 14.2 Registration information may be used to: * Process and confirm registration; * Communicate Event information or operational updates; * Administer giveaways or promotions; * Respond to attendee inquiries; * Support safety and attendance planning; and * Perform other activities described in the Foodees Fest Privacy Policy. 14.3 By registering, attendees consent to receive service-related communications concerning the Event. 14.4 Promotional email or text-message consent, where requested, should be presented separately and may be withdrawn in accordance with the applicable communication. 14.5 Personal information will be handled in accordance with the Foodees Fest Privacy Policy and applicable law. ## 15. Enforcement and Responsibility for Damage 15.1 Attendees are responsible for damage they intentionally or negligently cause to Event, venue, vendor, sponsor, staff, or third-party property. 15.2 Parents and legal guardians are responsible for the conduct of minors in their care to the extent permitted by law. 15.3 Pet handlers are responsible for the conduct of animals they bring to the Event. 15.4 Foodees Fest may provide information to venue management, law enforcement, emergency responders, insurers, or other appropriate parties when reasonably necessary to investigate an incident, address a safety concern, protect legal rights, or comply with law. ## 16. Limitation of Liability 16.1 To the fullest extent permitted by applicable law, Foodees Fest, its owners, officers, employees, contractors, volunteers, sponsors, venue owners, property managers, and affiliated partners will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages arising from registration, attendance, participation, Event changes, vendor transactions, or use of Event facilities. 16.2 Nothing in these Terms excludes or limits liability for gross negligence, willful misconduct, or any liability that cannot legally be excluded or limited. ## 17. Governing Law and Disputes 17.1 These Terms are governed by applicable federal law and the laws of the state in which the applicable Event is held, without regard to conflict-of-law principles, unless controlling law requires otherwise. 17.2 Before beginning formal legal proceedings, an attendee is encouraged to contact Foodees Fest and provide a reasonable opportunity to review and respond to the concern. 17.3 Nothing in these Terms prevents either party from exercising rights or remedies that cannot legally be waived. ## 18. Severability and No Waiver 18.1 If any provision of these Terms is determined to be invalid, unlawful, or unenforceable, the remaining provisions will remain in effect to the fullest extent permitted by law. 18.2 A failure by Foodees Fest to enforce a provision on one occasion does not waive its right to enforce that provision or another provision in the future. ## 19. Event-Specific Rules 19.1 Individual Event pages, venue policies, posted notices, giveaway rules, activity waivers, or written instructions may contain additional terms. 19.2 Event-specific and venue-specific requirements are incorporated into these Terms. 19.3 When an Event-specific or venue-specific rule is more restrictive than these general Terms, the more restrictive rule will apply to that Event, provided it is lawful. ## 20. Updates to These Terms 20.1 Foodees Fest may update these Terms periodically. 20.2 The version posted at the time of the applicable Event will govern attendance at that Event unless otherwise required by law. 20.3 The effective date at the top of these Terms identifies the most recent revision. ## 21.
