Terms & Conditions Sellers shall be responsible for obtaining any required licenses, sales and appropriate food permits (Cottage Food, Food Handler's, Food Sales) or approvals under state laws applicable to his/her activity at the event and for paying any taxes, sales taxes, fees or other charges that may be applicable to any seller at the event. I consent and authorize Georgia Plant Trade and Sales (GPTS) and venue located in Georgia to use my likeness in any photograph, video, or other digital media (Photos) taken or to be taken during this Georgia Plant Swap + Sale in any and all of its publications, including print or web-based publications. I irrevocably authorize to copy, edit, enhance, crop, or otherwise alter any photo for use in their publications. I also waive any rights for approval or inspection of any photos. WEATHER/RAIN POLICY Our events are NOT rain or shine. We don't think it is worth risking the safety of our sellers and their products to have an event in the rain. We make the call the day before of the event and send out announcements on all social media if the event is still happening, so please keep an eye on your inbox and our social media! In the case we do cancel the event. I agree to indemnify and hold Georgia Plant Trade and Sales, their officials, staff, and agents harmless of and from any and all actions, causes of actions of every kind in law or equity, suits, debts, liens, contracts, agreements, promises, claims, liabilities, demands, damages, obligations, loss, costs, and expense of any nature whatsoever, known or unknown, fixed or contingent, including, with limitation, attorney’s fees and court costs through and including any appeals, taxable or otherwise, incurred, either directly or indirectly, as a result of my participation in the Georgia Plant Trade and Sales Events, including but not limited to, any claims which might be made by myself, my co-workers, my agents, my employees, and/or any member of the general public. Release and Waiver of Liability The undersigned hereby acknowledges a desire to participate in Georgia Plant Trade and Sales. The undersigned further acknowledges that such participation, Including, travel to and from the event, involves an inherent risk of physical and mental injury, The undersigned acknowledges that participation in the Georgia Plant Trade and Sales is voluntary and agrees to assume any and all risks. The undersigned, and all successors and assigns thereto, shall hold harmless the Georgia Plant Trade and Sales, the Management, and any employees or volunteers from all suits, claims, actions or damages of any nature whatsoever resulting from participation in the Georgia Plant Trade and Sales. These indemnities shall not be limited by reason of the listing of any insurance coverage. By signing this release, the participant(s) verifies he/she has adequate liability insurance. Fill out the Application and by clicking the box below, Vendor acknowledges that they have received and read the application and that Vendor agrees to be bound to these terms. I understand that Georgia Plant Trade and Sales and Hosting Venue (named on confirmation) is not responsible nor liable for damages including but not limited to loss suffered before, during or after the event I have applied to as a result of the display of my work, equipment, material, or injury to anyone participating. If insurance is desired, it must be secured by the seller. The organizer and venue reserves the right to cancel a seller confirmation if guidelines are not upheld. The organizer and venue may require the seller to leave the event at any time if the seller is in violation of any rules and/or regulations stated herein. I acknowledge that I am responsible for the security of my own property and responsible for securing my canopy and fixtures to prevent safety hazards and expressly assume all risk of loss and/or damage to property arising either directly or indirectly from my participation in the Georgia Plant Trade and Sales. I understand and agree that Georgia Plant Trade and Sales is in no way responsible for my property or its safekeeping.
