CARS WITH A CAUSE – TERMS & CONDITIONS

These Terms and Conditions (“Agreement”) are entered into by and between the event organizers, promoters, affiliates, volunteers, sponsors, property owners, and any associated entities (collectively, “Organizers”), and the undersigned participant, exhibitor, vendor, attendee, sponsor, or guest (collectively, “Participant”).
By registering, attending, exhibiting, vending, sponsoring, or otherwise participating in the Event, Participant expressly agrees to be legally bound by the following terms:
1. ASSUMPTION OF RISK
Participant acknowledges that attendance and participation in an automotive event involves inherent risks, including but not limited to: bodily injury, death, property damage, exposure to moving vehicles, crowds, weather conditions, equipment failure, and other foreseeable and unforeseeable hazards.
Participant voluntarily assumes all risks, known and unknown, associated with participation in the Event.
2. WAIVER AND RELEASE OF LIABILITY
To the fullest extent permitted under Georgia law, Participant hereby irrevocably releases, waives, discharges, and covenants not to sue Organizers, property owners, sponsors, vendors, affiliates, employees, contractors, volunteers, or agents from any and all liability, claims, demands, actions, or causes of action arising out of or related to:
Personal injury or death
Property damage or theft
Vehicle damage or loss
Economic loss or loss of income
Business interruption
Acts of negligence (ordinary negligence included, to the extent permitted by law)
Weather-related incidents or “Acts of God”
Crowd-related incidents or third-party conduct
3. INDEMNIFICATION
Participant agrees to fully defend, indemnify, and hold harmless Organizers from and against any and all claims, liabilities, damages, losses, costs, or expenses (including attorney’s fees) arising out of or related to Participant’s:
Presence at the Event
Vehicle operation or display
Conduct or misconduct
Violation of laws, rules, or regulations
Injury or damage caused to third parties
4. NO LIABILITY FOR LOSS OF INCOME OR BUSINESS
Organizers shall not be held liable for any loss of income, revenue, profits, goodwill, business opportunities, or anticipated earnings resulting from:
Event cancellation or rescheduling
Weather conditions
Low attendance or vendor performance
Technical failures
Force majeure events
Law enforcement or governmental action
Operational changes made in good faith by Organizers
5. EVENT MODIFICATION & CANCELLATION RIGHTS
Organizers reserve the unrestricted right to:
Modify Event schedule, layout, or programming
Deny entry to any person or vehicle
Remove any Participant without refund
Cancel, postpone, or relocate the Event for any reason
No refunds shall be required unless explicitly stated in writing by Organizers.
6. VEHICLE LIABILITY
All vehicles displayed or operated on Event premises are the sole responsibility of the registered owner/operator.
Organizers are not responsible for:
Damage, theft, vandalism, or loss of vehicles
Mechanical failure or battery depletion
Towing or relocation costs
Damage caused by spectators or other participants
7. CONDUCT & REMOVAL
Organizers reserve the right to remove any Participant at their sole discretion for:
Unsafe driving or behavior
Disorderly conduct
Intoxication or substance impairment
Harassment or violence
Noncompliance with staff instructions
No refund or compensation shall be issued upon removal.
8. MEDIA RELEASE & IMAGE RIGHTS
Participant grants Organizers irrevocable rights to capture, record, and use Participant’s likeness, image, voice, vehicle, and participation in all media formats for promotional, commercial, and archival purposes without compensation.
9. FORCE MAJEURE
Organizers shall not be liable for delays, cancellation, or modifications caused by circumstances beyond their reasonable control, including but not limited to: weather, fire, flood, acts of government, labor disputes, or public emergencies.
10. INSURANCE DISCLAIMER
Participant acknowledges that Organizers do not provide personal, health, automobile, or property insurance coverage. Participant is solely responsible for maintaining adequate insurance coverage.
11. SEVERABILITY
If any provision of this Agreement is held invalid or unenforceable, the remaining provisions shall remain in full force and effect.
12. GOVERNING LAW
This Agreement shall be governed and construed in accordance with the laws of the State of Georgia, without regard to conflict of law principles.
13. ENTIRE AGREEMENT
This document constitutes the entire agreement between the parties and supersedes any prior oral or written representations.
14. ACKNOWLEDGMENT
By participating in the Event, Participant acknowledges that they have read, understood, and voluntarily agree to be bound by these Terms and Conditions.
