Vendor Terms & Conditions
By applying to and/or participating in The All Elm Street Market, vendors agree to the following terms and conditions:
1. Application & Acceptance
Submitting an application does not guarantee acceptance. All vendors are curated to ensure a balanced market with minimal category overlap. Acceptance is based on product type, quality, originality, space availability, and overall market fit. The All Elm Street Market reserves the right to accept, decline, or waitlist any application at its sole discretion.
2. Fees & Payments
Vendor fees are non-refundable once paid, unless the market is canceled by the organizer. Fees must be paid in full by the deadline provided upon acceptance. Failure to submit payment by the deadline may result in forfeiture of your space.
3. No-Shows & Cancellations
Vendors who fail to attend without prior written notice may lose priority for future markets. Repeated no-shows may result in removal from future events. Vendor fees are non-refundable for cancellations made by the vendor.
4. Booth Space & Setup
• Booth spaces are assigned by market management.
• Vendors must remain within their designated space.
• Subleasing or sharing booth space without prior written approval is not permitted.
• Vendors must supply their own tables, tents, weights, and display materials unless otherwise stated.
• All tents must be properly weighted for safety.
5. Setup, Breakdown & Attendance
Vendors must arrive, set up, and remain for the full duration of the market. Early breakdown is not permitted without approval from market management. Setup and breakdown times will be provided prior to each market.
6. Products & Conduct
Only items approved in your application may be sold. Vendors may not sell prohibited, illegal, offensive, or misrepresented items. Vendors are expected to act professionally, respectfully, and courteously toward customers, fellow vendors, and staff at all times.
7. Licenses, Permits & Taxes
Vendors are responsible for obtaining and maintaining any required business licenses, sales tax licenses, food permits, or other regulatory approvals required by the City, County, or State. The All Elm Street Market does not collect or remit sales tax on behalf of vendors.
8. Food & Beverage Vendors
Food vendors must comply with all applicable health department regulations and approvals. Proof of required permits may be requested prior to the event.
9. Weather & Force Majeure
The market is held rain or shine unless deemed unsafe. No refunds will be issued due to weather conditions beyond the organizer’s control. The All Elm Street Market is not liable for cancellations due to acts of God, government restrictions, or circumstances beyond reasonable control.
10. Liability & Insurance
Vendors participate at their own risk. The All Elm Street Market, its organizers, partners, property owners, and sponsors are not responsible for injury, loss, theft, or damage to vendor property. Vendors are encouraged to carry their own liability insurance.
11. Cleanliness & Trash
Vendors must keep their area clean and leave it in the same or better condition than found. Vendors are responsible for removing their own trash unless otherwise specified.
12. Marketing & Photography
By participating, vendors grant The All Elm Street Market permission to photograph or record their booth and products for marketing and promotional purposes, including social media, websites, and advertising.
13. Market Changes
The All Elm Street Market reserves the right to make changes to event layout, vendor placement, hours, rules, or policies as needed to ensure safety and market success.
14. Removal From Event
The market reserves the right to remove any vendor who violates these terms, engages in unsafe or disruptive behavior, or fails to comply with instructions from market staff. Removal may occur without refund.
