Assumption of Risk and Waiver of Liability Relating to COVID-19 The novel coronavirus, COVID-19, has been declared a worldwide pandemic by the World Health Organization. COVID-19 is extremely contagious and is believed to spread mainly from person-to-person contact. Federal authorities and the State of Florida recommend social distancing to prevent the spread of COVID-19. Contracting COVID-19 can lead to severe illness, personal injury, permanent disability, and death. The Florida Renaissance Festival, LLC and festival staff undertake every effort to ensure festival facilities are disinfected and have created new protocols and preventative measures to reduce the spread of COVID-19. However as with any public event, the Florida Renaissance Festival, LLC cannot guarantee that participants or guests will be 100% safe from airborne illnesses such as COVID-19, colds or flu while attending or participating in the festival. ASSUMPTION OF RISK: By signing this agreement, I acknowledge the contagious nature of COVID-19 and voluntarily assume the risk that I may be exposed to, or infected by COVID-19 while attending or participating in the Florida Renaissance Festival, and that such exposure or infection may result in personal injury, illness, permanent disability, and death. I understand that the risk of exposure or infection may result from the actions, omissions, or negligence of myself, Florida Renaissance Festival, LLC staff, volunteers or agents, participants, or others not listed, and I acknowledge that all such risks are known to me. I accept sole responsibility for any injury that may arise in connection with participation in the Florida Renaissance Festival. By signing this agreement, I acknowledge that I have read the Florida Renaissance Festival’s safety policies and procedures related to COVID-19 and agree to abide by the Florida Renaissance Festival’s safety policies as well as applicable state and CDC Guidelines at all times while attending and/or participating in the Florida Renaissance Festival. I further agree that as a participant in the festival, I am responsible for ensuring any staff or volunteers within my group, booth or encampment abide by the Florida Renaissance Festival’s safety policies as well as applicable state and CDC Guidelines at all times. WAIVER OF LIABILITY: In consideration of being permitted to participate in the Florida Renaissance Festival, I, on behalf of myself, as well as anyone entitled to act on my behalf, hereby forever waive, release, and hold the Florida Renaissance Festival, LLC, its owners, employees, officers, directors, managers, agents, assigns or other representatives harmless from any and all claims, suits, liability, actions, judgements, attorney’s fees, costs, and any expenses of any kind resulting from injuries or damages, grounded in tort or otherwise, that I, my business or representatives, sustain during or related to our participation or involvement in the Florida Renaissance Festival including exposure, infection and/or spread of COVID-19 whether known or unknown, foreseen or unforeseen. By signing this document, you are giving up any right to make a claim or file a lawsuit regarding your participation in the festival including any claim based on the negligent acts or omissions of the Florida Renaissance Festival, LLC, its owners, employees, officers, directors, managers, agents, assigns or other representatives.
