HauntFest Code of Conduct
Waiver, Release, and Hold Harmless Agreement
In consideration of my participation in any HauntFest events (the "Activity"). I (together with family, spouse, heirs, representatives and assigns) represent, covenant and agree, on behalf of myself and my heirs, assigns, and any other person claiming by, under or through me, as follows:
I, a HauntFest worker/volunteer, acknowledge the potential risks to attending and working a haunted festival, including but not limited to risk of heart attack, injury to person, lost or stolen property, seizure, and any other form of unintentional harm that may be a result of uneven grounds, loud music, or flashing lights. I acknowledge that participating in the Activity involves certain risks (some of which I may not fully appreciate) and that injuries, death, property damage or other harm could occur to me or others. I accept and voluntarily incur all risks of any injuries, damages, or harm which arise during or result from my participation in the Activity, including any associated activities, regardless of whether or not caused in whole or in part by the negligence or other fault of the HauntFest, LLC, the event venue, and/or its or their departments, trustees, affiliates, employees, officers, agents or insurers ("Released Parties").
I waive all claims against any of the Released Parties for any injuries, damages, losses or claims, whether known and unknown, which arise during or result from my participation in the Activity, regardless of whether or not caused in whole or part by the negligence or other fault of any of the Released Parties. I release and forever discharge the Released Parties from all such claims.
I acknowledge that HauntFest, LLC, reserves the right to expel anyone from the event who causes any threat to the safety or integrity of the festival, its participants, or its staff. Disrespect will not be tolerated. I agree to react calmly and patiently to customer and volunteer conflicts and to ask for assistance when needed. I also agree to report if any misconduct has been witnessed during or before festival hours. If touching is allowed at the venue, I agree to follow all safety guidelines and not cause harm to participants. I understand this is a volunteer position and that I am not entitled to monetary compensation.
By signing this consent form, I agree to the guidelines contained herein with regard to HauntFest, LLC and the event venue. I also agree to Hold Harmless HauntFest, LLC and the event venue, their staff, their affiliates, tenants, and committee members thereof, from any claim including limited injury to person, damage to property, loss by fire, theft, or any other cause, nor will I/we be a party to any lawsuit. This is a legal and binding Hold Harmless Agreement. I agree to indemnify and hold the Released Parties harmless from all losses, liabilities, damages, costs or expenses (including but not limited to reasonable attorneys' fees and other litigation costs and expenses) incurred by any of the Released Parties as a result of any claims or suits that I (or anyone claiming by, under or through me) may bring against any of the Released Parties to recover any losses, liabilities, costs, damages, or expenses which arise during or result from my participation in the Activity, regardless of whether or not caused in whole or part by the negligence or other fault of any of the Released Parties.
