Terms & Conditions:
I understand that the following are symptoms of COVID-19: fever or chills, cough, shortness of breath or difficulty breathing, fatigue, muscle or body aches, headache, new loss of taste or smell, sore throat, congestion or runny nose, nausea or vomiting, and diarrhea (“COVID-19 Symptoms”). I certify that 14 days before the festival, I will only attend if I have not experienced COVID-19 Symptoms or been in close contact with anyone with COVID-19 Symptoms or who has tested positive for the COVID-19 Virus. If I develop any COVID-19 Symptoms, test positive for COVID-19, or am in close contact with someone with COVID-19 Symptoms or who has tested positive for COVID-19 prior to beginning of ArtFest Fort Myers, I will immediately notify ArtFest Fort Myers and I will not participate in ArtFest Fort Myers.
ArtFest Fort Myers Volunteer also agrees to release and forever discharge ArtFest Fort Myers, Inc., the volunteers, the City of Fort Myers and the other sponsoring organizations and any other duly appointed representatives and employees, agents and officers of each from any responsibility, personal liability, loss or damages arising out of or in connection with ArtFest Fort Myers.
In consideration of my desire to serve as a volunteer at ArtFest Fort Myers I hereby assume all responsibility for any and all risk arising out of or in conjunction with this event.
I acknowledge that risks include, but are not limited to, property damage, bodily injury, weather conditions, contact with other participants including all risks related to illness and infectious diseases, such as COVID-19 and use of equipment and facilities of ArtFest Fort Myers, Inc. or its suppliers.
Further, I grant permission to all of the foregoing to use any photographs, videos, or other records of this event for any legitimate or promotional purpose without compensation to me.
I also grant permission to ArtFest Fort Myers, Inc to send email, text or phone messages regarding any necessary weekend festival information.
I currently have no known mental or physical condition that would impair my capability for full participation as intended or expected of me.
I have carefully read the foregoing release and indemnification and understand the contents thereof and sign this release as my own, free act.
I expressly agree that this release, waiver and indemnity agreement is intended to be as broad and inclusive as permitted by the State of Florida, and that if any portion thereof is held invalid, it is agreed that the balance shall, notwithstanding, continue in full legal force and effect.
I acknowledge that I am over the age of 18, or the legal guardian of the volunteer under the age of 18. And if I am under the age of 18, I acknowledge that my parent or legal guardian has approved my volunteer registration and waiver of liability.
Having read this waiver and knowing these facts, I, for myself and my heirs, executors, administrators and assigns, hereby release, waive and discharge ArtFest Fort Myers Inc. and the City of Fort Myers their respective Board of Directors, officers, directors, employees, agents, volunteers and sponsors from all claims or liability of any kind arising out of my participation in ArtFest Fort Myers even though that liability may arise out of negligence or carelessness on the part of the persons named in this waiver.
COVID Protocols:
ArtFest Fort Myers is an outdoor festival. Most volunteer positions are located outdoors or inside a professional tent with ventilation.
CDC Guidelines recommend anyone who is not fully vaccinated wear a mask indoors. Masks are not required in outdoor settings. Social Distancing is recommended from people who you do not live with. Hand Sanitizer will be available all over the festival.
