Welcome and thank you for your interest in vending with Foodees Food & Culture Festival.

FoodeesFest is a large-scale, outdoor, multi-day festival celebrating food, culture, and small businesses. Events typically host 100+ vendors, including food trucks, tented food vendors, artisans, authors, and non-food retailers.

This application helps us understand your business, menu or products, setup needs, and category placement. Submission of an application does not guarantee acceptance.

Lemonade is reserved for Lemonade vendors, if you are a food truck you are not permitted to sell lemonade, if you are and you include it on your application, we will remove it and disregard during the approval process. 

Each vendor must apply under the category that matches their actual setup and product type.

 

Important Event Protocol

• Beverage sales are restricted unless approved

Menu & Product Approval
All food vendors must submit:
• Full menu
• Category selection

Only approved items may be sold. Menu changes are not permitted once approved.

 

Food vendors may not sell lemonade unless specifically approved by Foodees Fest in writing. This includes fresh-squeezed, flavored, frozen, fruit, or specialty lemonade. Any unapproved lemonade items must be removed from the menu and may not be sold onsite.

 

Load-In, Setup & Breakdown
Final schedules, layouts, permits, inspections, and operational updates are shared exclusively through the Foodees Vendors & Sponsors Facebook Group. Joining the group is mandatory for participation.

Late arrivals, early breakdown, or no-shows may result in removal without refund and loss of future booking eligibility.

Terms & Conditions

Foodees Fest Vendor Terms & Conditions
Event Dates: April 30 – May 2
Venue: Tanger Property

By submitting an application and/or completing payment, the applicant/vendor acknowledges, understands, and agrees to the following Terms & Conditions.

Application, Approval & Participation
Submission of an application does not guarantee acceptance into the event. Foodees Fest reserves the right to approve, deny, waitlist, remove, or disqualify any vendor at its sole discretion.

Vendor space is not secured until the application has been approved and payment has been successfully processed. If the payment method on file is declined, invalid, reversed, disputed, or not completed, Foodees Fest may cancel the approval and release the space to another vendor without further notice.

Vendors understand that once an application is approved, the payment method on file may be charged immediately. There are no additional steps between approval and payment processing unless otherwise stated in writing by Foodees Fest.

Foodees Fest reserves the right to make final decisions regarding vendor selection, category balance, menu approval, booth placement, layout, operational needs, safety requirements, and event participation.

Vendor placement is determined solely by Foodees Fest and is final. Vendor placement may be adjusted at any time for safety, operational, venue, weather, permitting, compliance, or logistical reasons.

No Guarantee of Sales, Attendance, Placement, or Exclusivity
Foodees Fest does not guarantee sales, revenue, profit, attendance, foot traffic, weather conditions, vendor placement, customer volume, event layout, visibility, proximity to entrances, parking, entertainment, or other vendors.

Vendor fees are paid for the opportunity to participate in the event and do not guarantee any financial outcome.

Unless expressly approved in writing by Foodees Fest, vendors are not granted category exclusivity. Foodees Fest may approve multiple vendors within similar or overlapping categories when deemed appropriate for the event.

Approved Items, Menus & Category Restrictions
Vendors may sell only the items, menu items, products, services, and categories submitted in their application and approved in writing by Foodees Fest.

Unauthorized items, substitutions, additions, shared menus, hidden menu items, or unapproved products are prohibited and may result in immediate removal without refund.

Foodees Fest may restrict, remove, or deny any item due to category limits, vendor balance, venue restrictions, tenant conflicts, safety concerns, permitting requirements, or event needs.

Food vendors may not sell lemonade, coffee, or other restricted beverage items unless those items were specifically submitted, reviewed, and approved in writing by Foodees Fest. Lemonade and coffee are reserved for dedicated/standalone vendors unless an exception is expressly approved in writing.

Alcohol, counterfeit goods, replica designer items, weapons, political campaigning, offensive merchandise, illegal items, or any items prohibited by the venue, property owner, municipality, or Foodees Fest are not permitted.

Foodees Fest reserves the right to require removal of any item at any time.

Booth Size, Footprint & Setup
Vendors must remain within the booth size and footprint approved and paid for.

Tents, trailers, trucks, tables, signage, cooking equipment, generators, displays, awnings, storage, staff areas, lines, and merchandise may not extend beyond the assigned space.

Vendors may not obstruct walkways, emergency access lanes, sidewalks, roads, entrances, exits, neighboring vendor spaces, venue operations, fire lanes, or staff-only areas.

Vendors may not move, swap, expand, or modify their assigned location without written approval from Foodees Fest management.

All booths must be professional, clean, safe, and event-ready before opening to the public.

Tents, Weights & Equipment
All tents must be properly weighted and secured at all times. Stakes are not permitted unless expressly approved in writing by Foodees Fest and the venue.

Vendors are responsible for bringing all equipment required for their setup, including tents, tables, chairs, generators, extension cords, lighting, displays, cooking equipment, signage, weights, grease containment, and any other operational supplies.

Foodees Fest does not provide electricity, water, tents, tables, chairs, generators, extension cords, or booth equipment unless specifically stated in writing.

Generators must be quiet/silent operation and may not exceed 70 decibels. Generators must be operated safely and in accordance with all fire, venue, and local regulations.

Electrical cords, fuel, cooking equipment, generators, propane, and all other equipment must be safely maintained, protected, and secured.

No Charcoal Grills
NO CHARCOAL GRILLS OF ANY KIND ARE PERMITTED.

This includes, but is not limited to, charcoal grills, charcoal smokers, open charcoal cooking equipment, or any cooking operation using charcoal as a fuel source.

Fire, Health, Safety & Compliance
Vendors must comply with all applicable city, county, state, health department, fire department, venue, property owner, and permitting requirements.

Cooking equipment, generators, fuel, propane, electrical connections, fire suppression equipment, and all booth operations must be operated safely and in accordance with all applicable regulations.

A fire extinguisher must be readily accessible if required by local authorities, fire officials, Foodees Fest, or the venue.

Food vendors are responsible for maintaining safe food handling practices, proper temperatures, sanitation, handwashing requirements, and all required health department standards.

Foodees Fest, venue management, fire officials, health officials, law enforcement, or any authority having jurisdiction may inspect vendor spaces at any time.

Failure to comply with safety, fire, health, venue, or operational requirements may result in immediate removal without refund.

Permits, Licenses, Insurance & Required Documentation
Vendors are solely responsible for obtaining, maintaining, submitting, and displaying all required licenses, permits, health approvals, fire approvals, certificates, insurance documents, and any other documentation required for participation.

Vendors must submit required documentation by the stated deadline. Failure to submit required documentation may result in denial, removal, or inability to participate without refund.

If a vendor is denied approval, restricted, shut down, removed, or unable to participate due to missing documentation, failure to pass inspection, noncompliant equipment, menu issues, permit issues, insurance issues, or a decision by any city, county, state, health department, fire department, venue, property owner, or authority having jurisdiction, no refund, transfer, or credit will be issued.

Vendors must display all required permits, licenses, certificates, and approvals onsite as required by local authorities.

Insurance Requirement
Vendors must carry general liability insurance with a minimum of $1,000,000 per occurrence and list Foodees, LLC as additionally insured.

Additional insured language, certificate holder requirements, or venue-specific insurance requirements may be required and must be provided upon request.

Insurance may be purchased through Eventeny’s insurance partner after approval, if available.

Failure to provide valid insurance when required may result in removal from the event without refund.

Load-In
Load-in for this event will take place during assigned windows on Thursday morning and Friday morning only.

Vendors must arrive, check in, and set up during their assigned load-in time. Vendors may not arrive outside of their assigned load-in window unless approved in writing by Foodees Fest management.

Late arrivals may be turned away without refund.

Early arrival, unauthorized staging, blocking entrances, blocking roads, parking in unapproved areas, or attempting to load in outside the assigned schedule may result in removal from the event without refund.

Vendors must follow all load-in instructions provided by Foodees Fest staff, Tanger property management, security, venue representatives, law enforcement, fire officials, and local authorities.

Foodees Fest reserves the right to modify load-in procedures as needed for weather, safety, venue requirements, traffic flow, inspections, or operational needs.

Attendance, Event Hours & Early Exit
Vendors are required to participate for the full event duration.

Partial participation, single-day participation, late opening, early closing, packing up early, or leaving before the approved load-out time is not permitted unless approved by Foodees Fest management.

Vendors who leave early, close early, arrive late, no-show, or fail to operate for the full event may forfeit their deposit, lose future booking eligibility, and may be permanently disqualified from future Foodees Fest events.

Vendors must be fully operational and ready to serve or sell during all posted event hours unless otherwise directed by Foodees Fest management.

Load-Out
Vendors may not begin load-out until authorized by Foodees Fest management.

Early breakdown is not permitted.

Vendors must fully clean their space, remove all equipment, dispose of trash properly, and complete any required inspection before leaving the property.

Vendors must be fully packed, cleaned, inspected, and off property by the deadline provided for this event.

Failure to leave by the required deadline may result in forfeiture of deposit, additional fees, venue charges, towing, removal from future events, or permanent disqualification.

No Overnight Stays or Unauthorized Property Use
Vendors may not sleep, camp, stay overnight, or use vehicles, trailers, RVs, campers, tents, or equipment as lodging on event property.

Vendors may only be on property during approved load-in, event, and load-out hours unless expressly approved in writing by Foodees Fest and Tanger property management.

Unauthorized overnight parking, staging, storage, camping, or remaining on property outside approved hours is strictly prohibited and may result in removal from the event, forfeiture of deposit, and disqualification from future Foodees Fest events.

Pricing & Signage
All prices must be clearly displayed using professionally printed signage. Handwritten signs are not permitted.

Prices must be submitted for approval in advance if requested by Foodees Fest.

Price gouging, inconsistent pricing, misleading pricing, hidden fees, or charging different prices than what is posted may result in removal from the event without refund and permanent disqualification from future Foodees Fest events.

All signage must be professional, clean, family-friendly, and contained within the approved booth space.

Foodees Fest reserves the right to require removal or replacement of any signage deemed unprofessional, unsafe, misleading, inappropriate, or noncompliant.

Waste Management, Grease & Cleanup
Vendors must leave their space in the same condition as it was upon arrival.

All trash and food waste must be disposed of in designated dumpsters. Cardboard must be broken down.

No grease, oil, food residue, sauces, wastewater, gray water, ice melt, beverages, or other liquids may be dumped, rinsed, spilled, or poured onto the ground, pavement, grass, drains, landscaping, storm drains, sidewalks, parking lots, or surrounding areas.

Grease mats or containment trays are required for all food vendors.

Any spills, stains, leaks, or residue must be cleaned immediately using proper absorbents and cleaning materials.

A Foodees Fest staff member must inspect and sign off on each vendor space prior to departure.

Failure to comply, including grease stains, food or liquid spillage, trash left behind, broken-down equipment left onsite, improper disposal, damage, or failure to obtain staff sign-off, will result in forfeiture of deposit and may result in additional remediation fees exceeding $500 based on cleanup costs, venue charges, labor, and documented damages.

Vendors are responsible for any damage, stains, cleanup costs, fines, fees, or remediation costs caused by their booth, staff, equipment, products, cooking operation, vehicle, trailer, or waste.

Deposits
A cash-only deposit is required at check-in unless otherwise stated in writing by Foodees Fest.

Deposit amounts are as follows:

• $100 for food trucks and tented food vendors
• $50 for artisans, crafters, merchandise vendors, and non-food vendors

Sponsors are exempt from the onsite cash cleanup deposit unless otherwise stated in a separate sponsorship agreement.

Deposits are refundable only if the vendor:

• Remains onsite for the full event
• Operates during all required event hours
• Properly cleans their space
• Removes all trash, equipment, and materials
• Complies with all rules, protocols, and venue requirements
• Receives final space inspection and approval from Foodees Fest staff before departure

Any vendor who leaves early, closes early, no-shows, fails to clean their space, damages the property, violates event rules, or fails to receive staff sign-off before leaving will forfeit their deposit.

Deposit forfeiture does not limit Foodees Fest’s right to collect additional fees for damages, cleanup, remediation, fines, chargebacks, or venue-imposed costs.

Fees, Taxes, Processing & Refunds
Vendor invoices may include the vendor fee, applicable sales tax, processing fees, and any required platform fees.

All fees are non-refundable once the application has been approved and payment has been processed unless Foodees Fest cancels the event entirely and does not reschedule, relocate, postpone, or provide an alternate participation opportunity.

Vendor fees are non-transferable unless Foodees Fest expressly approves a transfer in writing.

No refunds, credits, or transfers will be issued for vendor cancellation, no-show, early exit, low sales, weather, reduced attendance, travel issues, staffing issues, equipment failure, illness, permit failure, inspection failure, missing documentation, menu restrictions, category restrictions, placement, layout changes, venue rules, or inability to participate.

Processing fees, platform fees, taxes, and administrative fees are non-refundable.

Weather, Rescheduling, Venue Changes & Operational Changes
Foodees Fest events operate rain or shine.

A postponement, reschedule, venue change, layout change, date adjustment, hour adjustment, operational pause, delayed opening, early closure, relocation, emergency closure, or required operational change is not considered a cancellation and is not grounds for refund.

Weather-related decisions are made in coordination with Foodees Fest management, Tanger property management, public safety officials, law enforcement, fire officials, emergency personnel, and local authorities.

Severe weather, high winds, lightning, flooding, emergency conditions, unsafe conditions, or government directives may require temporary pauses, delayed opening, adjusted hours, early closure, evacuation, relocation, or other operational changes.

All vendors must follow instructions from Foodees Fest staff, venue management, security, law enforcement, fire officials, emergency responders, and local authorities.

Vendors are responsible for monitoring weather conditions and securing tents, signage, displays, merchandise, equipment, generators, and all booth materials as conditions change.

Conduct & Professionalism
Vendors are responsible for the conduct, safety, and professionalism of their employees, contractors, volunteers, family members, representatives, and anyone working within or on behalf of their booth.

Vendors must treat guests, other vendors, Foodees Fest staff, venue representatives, security, public officials, and emergency personnel professionally and respectfully.

Harassment, threats, abusive language, unsafe behavior, intoxication, public disputes, social media attacks, discrimination, violence, or conduct that damages the reputation or operations of Foodees Fest may result in immediate removal without refund and permanent disqualification from future events.

Foodees Fest reserves the right to remove any vendor, staff member, representative, or booth participant whose conduct is deemed unsafe, unprofessional, disruptive, noncompliant, or harmful to the event.

Staffing & Booth Responsibility
Vendors must ensure their booth is properly staffed during all required event hours.

Vendor staff must be trained, professional, and capable of safely operating the booth.

Vendors are responsible for all actions, omissions, damages, violations, sales, customer interactions, and safety issues caused by their staff, helpers, contractors, or representatives.

Foodees Fest is not responsible for staffing shortages, employee issues, vendor scheduling conflicts, or vendor operational problems.

Vehicles, Parking & Trailers
Vendors must follow all parking, vehicle, trailer, and traffic instructions provided by Foodees Fest, Tanger property management, security, and local authorities.

Vehicles may not remain in unauthorized areas, block fire lanes, block drive aisles, block entrances, block sidewalks, or obstruct venue operations.

Unauthorized vehicles, trailers, or equipment may be towed or removed at the vendor’s expense.

Foodees Fest is not responsible for towing fees, parking violations, tickets, vehicle damage, theft, or property loss.

Health, Cleanliness & Sanitation
Vendors must maintain a clean, sanitary, safe, and professional booth space at all times.

Food vendors must follow all required food safety, handwashing, glove use, temperature control, storage, prep, service, and sanitation requirements.

Vendors must keep trash contained throughout the event and may not allow waste, grease, liquids, boxes, supplies, or personal items to create unsafe or unsightly conditions.

Foodees Fest reserves the right to require immediate cleanup, correction, or removal of any unsafe, unsanitary, or unprofessional condition.

Prohibited Activities
The following are prohibited unless expressly approved in writing by Foodees Fest:

• Charcoal grills or charcoal cooking equipment
• Alcohol sales or sampling
• THC, CBD, vapes, nicotine, or related products
• Weapons or weapon-related merchandise
• Counterfeit, replica, or unauthorized designer goods
• Political campaigning or political booths
• Unauthorized amplified sound
• Unauthorized generators or unsafe fuel storage
• Unauthorized raffles, giveaways, contests, or solicitation
• Subleasing, sharing, transferring, or selling booth space
• Selling unapproved menu items, beverages, products, or services
• Dumping grease, gray water, wastewater, ice, or liquids on the property
• Overnight stays, camping, RV use as lodging, or sleeping on property
• Blocking emergency access lanes, sidewalks, entrances, exits, or neighboring vendors

Foodees Fest reserves the right to prohibit additional items or activities based on venue rules, municipal requirements, safety concerns, tenant conflicts, or event needs.

Chargebacks & Payment Disputes
Vendors agree to contact Foodees Fest directly regarding any billing concern before initiating a chargeback or payment dispute.

Vendor acknowledges that approved vendor fees are non-refundable under these Terms.

Any chargeback, reversed payment, failed payment, or payment dispute may result in cancellation of participation, removal from the event, forfeiture of deposit, collection of outstanding balances, and permanent disqualification from all future Foodees Fest events.

Foodees Fest reserves the right to pursue recovery of any chargeback amount, fees, costs, damages, or losses associated with a payment dispute.

Removal from Event
Foodees Fest reserves the right to remove any vendor from the event without refund for violation of these Terms & Conditions, venue rules, safety requirements, permitting requirements, health department requirements, fire department requirements, payment requirements, or staff instructions.

Removal may also occur for unprofessional conduct, unauthorized items, unsafe operations, early exit, no-show, failure to clean, failure to provide documentation, failure to pass inspection, or any action that negatively impacts the event, venue, guests, vendors, staff, or partners.

Removal from one event may result in disqualification from future Foodees Fest events.

Sponsorships
Sponsors are not required to pay the onsite cash cleanup deposit unless otherwise stated in a separate written agreement.

Sponsorship fees, activation fees, deliverables, space size, benefits, and participation requirements are governed by the sponsor’s invoice, agreement, or written approval from Foodees Fest.

Sponsors must still comply with all venue, safety, insurance, load-in, load-out, conduct, signage, and operational requirements.

Media Release
Vendors grant Foodees Fest permission to photograph, film, record, and use the vendor’s booth, products, signage, staff, brand name, logo, and likeness for marketing, advertising, social media, promotional, press, and archival purposes.

Media captured by or on behalf of Foodees Fest is the property of Foodees Fest.

Vendors waive the right to inspect, approve, or receive compensation for the use of event-related photos, videos, or promotional materials.

Liability
Vendors assume all risk related to their property, products, equipment, vehicles, trailers, staff, contractors, representatives, setup, operations, and participation.

Foodees Fest is not responsible for lost, stolen, damaged, or unattended items.

Foodees Fest is not responsible for vendor sales, revenue, product loss, equipment failure, weather damage, staffing issues, travel costs, permit issues, inspection failures, customer disputes, theft, vehicle damage, or personal property damage.

Vendors are responsible for any claims, damages, injuries, losses, fines, fees, cleanup costs, chargebacks, or liabilities caused by their booth, staff, products, services, equipment, operations, vehicles, trailers, conduct, or failure to comply with these Terms.

Indemnification
Vendor agrees to defend, indemnify, and hold harmless Foodees, LLC, Foodees Fest, Tanger property ownership and management, venue representatives, municipalities, event partners, sponsors, staff, contractors, representatives, affiliates, and agents from and against any claims, damages, losses, fines, penalties, injuries, costs, cleanup fees, chargebacks, legal fees, or liabilities arising from the vendor’s products, services, equipment, staff, conduct, setup, operations, permits, insurance, or failure to comply with these Terms & Conditions.

Communication
Vendors consent to receive event-related communications by email, phone, and SMS, including application updates, payment notices, permit reminders, insurance reminders, load-in instructions, compliance updates, weather updates, operational notices, and event announcements.

Vendors may also receive marketing communications where permitted by law. Opt-out instructions will be provided where required.

Vendors understand that opting out of communications may prevent them from receiving important event updates, and failure to receive or read event communications does not excuse noncompliance with event requirements.

Vendors are responsible for monitoring the email address, phone number, Eventeny account, and communication channels used during the application process.

Agreement
By submitting an application, receiving approval, completing payment, checking in, setting up, or participating in the event, the vendor confirms that they have read, understood, and agreed to these Terms & Conditions.

Failure to comply with these Terms & Conditions may result in denial, removal, forfeiture of deposit, loss of payment, additional fees, and/or permanent disqualification from future Foodees Fest events.
