About the application
Entertaiment at the Fall Festival is intended to showcase local talent in singing/songwritting, dance and other means of celebrating the Fauquier arts & entertainment industry. Examples include but are not limited to the following.
- Live acoustic music performances
- Kids Storytelling
- Pumpkin carving demonstrations or similar themed design
- Face painting station
- Hands-on craft workshops for all ages (e.g., leaf printing, scarecrow making)
- Roaming costumed characters (e.g., friendly scarecrows, woodland creatures)
- Apple bobbing and other traditional fall games
- Street performers (jugglers, stilt walkers) in harvest-themed costumes
Since the Entertainment is intended to not compliment the Festival but also to showcase local talent, there will be no cost to entertainers. Addtionally, entertainers will be held to the terms & conditions of all vendors regardless of type as indicated in the terms & conditions section.
About the event
Terms & Conditions
- The Old Town Warrenton Fall Festival is are held rain or shine. Inclement weather is unpredictable and may create delays. Event organizer reserves the right to halt or delay events if we feel the weather is creating unsafe conditions for vendors, staff and attendees.
- All sales are final
- Provided the nature of our business and events, we cannot and do not offer refunds under any circumstances.
- Vendors may not request a credit/rain-check due to weather or other acts of Mother Nature.
- In the event an approved applicant cannot attend the event then you may choose one of two options:
- Forfeit the purchase amount
- Sell your ticket to another individual (after the sale, you can use your original ticket confirmation link to transfer and reissue the ticket in the buyer's name) Vendors wishing to sell their space MUST contact the event organizer in advance for approval. Sales made without prior approval will result in the vendor being unable to exhibit.
ACKNOWLEDGEMENT OF RISK AND LIABILITY RELEASE
- Acknowledgement of Risk: The applicant acknowledges that participating in the Event involves inherent risks, including but not limited to the risk of physical injury, property damage, and loss of personal property.
- Liability Release: The applicant hereby releases and forever discharges the Fauquier Chamber of Commerce, its officers, employees, agents, contractors, and volunteers from any and all claims, damages, or liabilities arising from or related to the applicant’s participation in the Event, whether caused by the Fauquier Chamber of Commerce’s negligence or otherwise.
ASSUMPTION OF RISK
- Assumption of Risk: The applicant assumes all risks associated with participation in the Event, including but not limited to the risk of physical injury, property damage, and loss of personal property.
- Acknowledgement of Responsibility: The applicant acknowledges and agrees that he or she is solely responsible for his or her own safety and well-being during the Event, and that the Fauquier Chamber of Commerce shall not be liable for any injuries or damages that may occur as a result of the applicant participation in the Event.
INDEMNIFICATION
- Indemnification: The applicant agrees to indemnify, defend, and hold harmless the Fauquier Chamber of Commerce, its officers, employees, agents, contractors, and volunteers from any and all claims, damages, or liabilities arising from or related to the applicant participation in the Event, including but not limited to any claims brought by third parties.
- Scope of Indemnification: The applicant’s obligation to indemnify the Fauquier Chamber of Commerce shall include, without limitation, any damages, expenses, or attorneys’ fees incurred by the Fauquier Chamber of Commerce in connection with any claims, demands, or actions arising from or related to the applicant’s participation in the Event.
RELEASE OF LIABILITY
- Release of Liability: The applicant hereby releases and forever discharges the Fauquier Chamber of Commerce, its officers, employees, agents, contractors, and volunteers from any and all claims, damages, or liabilities arising from or related to the applicant’s participation in the Event, whether caused by the Fauquier Chamber of Commerce’s negligence or otherwise.
- No Third-Party Claims: The applicant acknowledges and agrees that this Agreement is intended to release the Fauquier Chamber of Commerce only from liability to the applicant, and that it does not release the Fauquier Chamber of Commerce from liability to any third party.
GOVERNING LAW
- Governing Law: This Agreement shall be governed by and construed in accordance with the laws of the state in which the Event is held, without giving effect to any choice or conflict of law provision or rule.
- Jurisdiction and Venue: The parties hereby submit to the exclusive jurisdiction of the courts located in the state in which the Event is held for any disputes arising under or related to this Agreement.
ENTIRE AGREEMENT
- Entire Agreement: This Agreement constitutes the entire agreement between the applicant and the Fauquier Chamber of Commerce with respect to the subject matter hereof, and supersedes all prior and contemporaneous agreements and understandings, whether oral or written.
- Amendments: This Agreement may not be amended or modified except in writing signed by both parties.
PERFORMANCE DISCLAIMER (applicable to Entertainment Applications ONLY):
By agreeing to participate in this festival, all entertainers acknowledge and agree that:
- All performances are to be provided free of charge.
- No direct compensation will be given for any performances or services rendered during the festival.
- Entertainers are prohibited from soliciting or accepting payment from festival attendees.
- Any attempt to charge for performances may result in immediate removal from the festival.
- This agreement does not constitute an employer-employee relationship.
- Entertainers retain all rights to their intellectual property.
- The festival organizers reserve the right to use images and recordings of performances for promotional purposes.
Applicants acknowledge that approval of submitted applications indicate full acceptance of these terms.
