Acceptance of Terms By purchasing, receiving, or using a ticket to the Handmade Arcade Holiday Market (the "Event"), you ("Ticketholder" or "Attendee") agree to these Terms and Conditions. These terms apply to every person entering the Event, including guests admitted on a ticket purchased by someone else. If you do not agree, please do not purchase or use a ticket. Handmade Arcade ("HA") is a Pittsburgh-based 501(c)(3) nonprofit organization. HA may update these terms before the Event. The version posted at the time of the Event will apply. Tickets and Admission • All sales are final. Tickets are nonrefundable and may not be exchanged for any reason, including cancellation of the Event. • Each ticket admits one person for the date and time listed on it. Please have your ticket (printed or on your phone) ready at the door. • Tickets may not be resold for more than face value. HA may cancel any ticket obtained through unauthorized resale, without a refund. • Everyone ages 10 and older must have their own ticket. • Children must be supervised by a responsible adult at all times. • Re-entry and security policies are set by HA and the David L. Lawrence Convention Center ("DLCC").Attendees must follow all posted venue rules and staff instructions. Code of Conduct: The Holiday Market is a celebration of our maker community, and HA wants every attendee, maker, volunteer, and staff member to feel safe and welcome. The following are prohibited at the Event: • Harassment of any kind, including verbal, physical, or written intimidation, threats, unwanted contact, or discriminatory conduct toward any person. • Unsafe behavior, including actions that endanger yourself or others, damage property, or disregard instructions from HA staff, venue staff, or security. • Unauthorized commercial activity, including selling, soliciting, distributing marketing materials, recruiting makers or customers, or filming for commercial purposes without HA's written approval. HA and DLCC staff may ask anyone who violates this Code of Conduct, or whose behavior we reasonably believe threatens the safety or experience of others, to leave the Event. Attendees asked to leave will not receive a refund. HA may also refuse admission to future events. Photography, Video, and Audio: HA and its authorized photographers, videographers, and media partners will capture photographs, video footage, and audio recordings at the Event. By entering the Event, you grant HA permission to record your image, likeness, voice, and participation, and to use, reproduce, and distribute those recordings in any media for promotional, educational, fundraising, and archival purposes, without compensation or further approval. If you prefer not to be featured, please let a staff member or the photographer know at the Event, and we will make reasonable efforts to honor your request. Attendees taking their own photos are asked to respect makers' booth policies, as some makers do not permit photography of their work. Assumption of Risk and Limitation of Liability • Assumption of Risk: Attendance at a public event involves inherent risks, including crowds, foot traffic, and handling of goods. You attend voluntarily and assume all risks of bodily injury, illness, and loss of or damage to personal property. HA is not responsible for lost, stolen, or damaged personal items. • Release: To the fullest extent permitted by law, you release Handmade Arcade, its directors, officers, employees, volunteers, agents, representatives, successors, and assigns from all liabilities, claims, demands, and losses arising out of or related to your attendance at the Event, except to the extent caused by HA's gross negligence or willful misconduct. Indemnification. You agree to indemnify, defend, and hold harmless Handmade Arcade, its directors, officers, employees, agents, representatives, successors, and assigns from and against all liabilities, expenses, suits, claims, actions, demands, judgments, settlements, costs, losses, fines, and penalties, including but not limited to attorney fees, costs, and expenses of litigation, that arise out of or are related to any bodily injury or property damage caused by your conduct, or the conduct of any minor or guest in your care, at the Event. • Venue: Handmade Arcade disclaims all liability for any bodily injury or property damage to Attendees as a result of any negligence, gross negligence, or willful misconduct caused by the David L. Lawrence Convention Center and/or any DLCC employees and/or agents. • Makers' Products: Purchases are made directly between Attendees and independent makers. HA is not a party to those sales and is not responsible for the quality, safety, or fitness of any maker's products. Return and exchange policies are set by each maker. Event Changes and Force Majeure HA may change the Event's schedule, hours, layout, participating makers, or programming without notice. Such changes do not entitle Ticketholders to a refund. These Terms and the obligations of Handmade Arcade are subject to conditions beyond the reasonable control of Handmade Arcade, such as grave illness, accidents in transportation or otherwise, fire, flood, strikes, riots, acts of God, global pandemics, inclement weather deemed an emergency by official authorities, labor disputes, war emergencies, closure or unavailability of the DLCC, or other similar circumstances. If the Event is prevented, postponed, or shortened for any of these reasons, this force majeure policy will apply. Handmade Arcade will be under no obligation to present the Event at a different time, nor to compensate Ticketholders for any expenses incurred in connection with the Event, including travel, lodging, or parking. Tickets will not be refunded. HA's total liability to any Ticketholder will not exceed the face value of the ticket purchased. General: These terms are governed by the laws of the Commonwealth of Pennsylvania. If any provision is found unenforceable, the remaining provisions remain in effect. HA's failure to enforce any provision is not a waiver of that provision. Questions about these terms can be sent to info@handmadearcade.org
