Sponsor Terms & Conditions
The Fried Green Tomato Festival values the generous support of our sponsors and is committed to providing a successful partnership experience. By submitting a sponsorship commitment and payment, sponsors agree to the following terms and conditions.
Sponsorship Acceptance
The Fried Green Tomato Festival reserves the right to accept or decline any sponsorship application at its sole discretion. Sponsorship opportunities are available on a first-come, first-served basis and are subject to availability.
Payment Terms
Full payment is required to secure sponsorship benefits and recognition. Sponsorship opportunities are not guaranteed until payment has been received and confirmed by the festival.
If payment is not received by the specified deadline, the Fried Green Tomato Festival reserves the right to release the sponsorship opportunity to another interested sponsor.
Sponsorship Benefits
Sponsors will receive the benefits outlined in the selected sponsorship package. Benefits may include, but are not limited to, recognition on festival signage, promotional materials, social media, websites, event programs, announcements, and on-site displays.
The festival will make every reasonable effort to fulfill all sponsorship benefits as described; however, benefits may be modified due to operational needs, production timelines, weather conditions, or circumstances beyond the festival's control.
Logo and Marketing Materials
Sponsors are responsible for providing high-resolution logos, advertisements, promotional materials, and other requested assets by the deadlines established by the festival.
The Fried Green Tomato Festival is not responsible for errors, omissions, or delays resulting from late submissions or the failure to provide requested materials by the specified deadlines.
If artwork is not received by the deadline, the festival reserves the right to use an existing logo or omit certain recognition opportunities.
Exclusivity
Unless specifically stated in writing within the sponsorship agreement, sponsorships do not include category exclusivity. The Fried Green Tomato Festival reserves the right to accept sponsorships from multiple businesses, including businesses within similar industries.
Sponsor Displays and Activations
Sponsors receiving booth space or activation opportunities are responsible for providing their own equipment, displays, staffing, and materials unless otherwise noted in the sponsorship agreement.
All sponsor displays must be family-friendly, professionally presented, and approved by festival organizers. The festival reserves the right to require the removal of any display or promotional material deemed inappropriate or inconsistent with the values of the event.
Event Changes and Force Majeure
The Fried Green Tomato Festival reserves the right to modify the event schedule, layout, entertainment lineup, sponsor placement, and operational plans as necessary.
Should the festival be delayed, interrupted, relocated, or canceled due to circumstances beyond its control, including but not limited to severe weather, natural disasters, public emergencies, government restrictions, acts of terrorism, labor disputes, or other force majeure events, the festival shall not be liable for any resulting losses.
Any consideration of refunds, credits, or transfer of sponsorship benefits due to cancellation shall be determined solely at the discretion of festival organizers.
Use of Sponsor Name and Logo
By entering into a sponsorship agreement, sponsors grant the Fried Green Tomato Festival permission to use their business name, logo, trademarks, and approved promotional materials for the purpose of advertising, promoting, and recognizing sponsorship participation in connection with the festival.
Photography and Media Release
Sponsors acknowledge and agree that photographs, video recordings, and other media captured during the festival may include sponsor representatives, displays, and branding. Such media may be used by the Fried Green Tomato Festival for promotional, advertising, and archival purposes without compensation.
Liability
Sponsors participate in the festival at their own risk. The Fried Green Tomato Festival, its organizers, volunteers, sponsors, the City of Juliette, and affiliated partners shall not be responsible for any loss, theft, damage to property, personal injury, or claims arising from a sponsor's participation in the event.
Sponsors agree to indemnify and hold harmless the Fried Green Tomato Festival, its organizers, volunteers, the City of Juliette, and affiliated partners from any claims, liabilities, damages, costs, or expenses resulting from the sponsor's actions, products, services, displays, employees, representatives, or participation in the festival.
Compliance
Sponsors agree to comply with all applicable federal, state, and local laws, regulations, and ordinances. Sponsors must also comply with all festival policies, procedures, and instructions provided by festival management.
Right to Refuse or Remove
The Fried Green Tomato Festival reserves the right to refuse, revoke, or terminate a sponsorship without refund if a sponsor engages in conduct that is unlawful, misleading, discriminatory, disruptive, or inconsistent with the mission, reputation, and family-friendly atmosphere of the festival.
Entire Agreement
These Terms & Conditions, together with the selected sponsorship package and any written sponsorship agreement, constitute the entire understanding between the sponsor and the Fried Green Tomato Festival.
If the sponsor package you chose includes a vendor booth option, guidelines, terms & conditions of vendors participating the Fried Green Tomato Festival applies. Please see attached documentation.
By submitting this application, the sponsor acknowledges that they have read, understand, and agree to abide by these Terms & Conditions.
