PARADE PARTICIPANT AGREEMENT, WAIVER AND HOLD HARMLESS

In consideration of being permitted to participate in the parade, the applicant, organization, group, business and all persons participating under this application agree to the following:

VOLUNTARY PARTICIPATION AND ASSUMPTION OF RISK
I understand that participating in a parade may involve risks, including but not limited to crowds, traffic, moving vehicles, floats, trailers, animals, uneven surfaces, weather conditions, equipment, falls, collisions and the actions of other participants or spectators.

I voluntarily accept and assume all risks associated with participation, whether known or unknown, to the fullest extent permitted by Georgia law.

RELEASE AND HOLD HARMLESS
To the fullest extent permitted by law, I release, waive and agree to hold harmless the Buford Business Alliance, the City of Buford, event organizers, sponsors, property owners, volunteers, officers, directors, employees, agents and representatives (“Released Parties”) from claims, demands, damages, losses, liabilities, costs or expenses arising from or related to my participation or the participation of anyone included in my entry.

This release includes claims involving personal injury, illness, death, property damage, loss or theft, including claims arising from the ordinary negligence of a Released Party. This agreement does not release conduct that cannot legally be waived under Georgia law.

INDEMNIFICATION
I agree to defend, indemnify and hold the Released Parties harmless from claims, damages, liabilities, costs and reasonable attorney fees arising from:

My actions or the actions of my organization, employees, volunteers, guests or participants;
My parade vehicle, float, trailer, equipment, decorations or animals;
My failure to follow parade rules, safety instructions or applicable laws; or
Injury or damage caused by anyone participating under my application.
RESPONSIBILITY FOR PARTICIPANTS AND MINORS
I certify that I am authorized to complete this application on behalf of the organization or group listed. I accept responsibility for communicating the parade rules and this agreement to every person participating with my entry.

If minors participate, I certify that each minor has permission from a parent or legal guardian. I understand that the organizer may require a separate parent or guardian waiver.

VEHICLES, FLOATS AND INSURANCE
I certify that all vehicles, floats, trailers and equipment used by my group are safe, properly maintained and operated by qualified individuals. Every driver must possess a valid driver’s license and any vehicle used must carry legally required insurance.

I am responsible for securing riders, decorations and equipment and for ensuring that no participant rides in an unsafe location.

COMPLIANCE WITH RULES
I agree that everyone included in my entry will follow parade rules, staging instructions, safety requirements, traffic directions and instructions from parade officials or law enforcement.

The organizer may reject or remove an entry that is unsafe, disruptive, inappropriate, materially different from the approved application or not compliant with parade rules. Decisions concerning safety and participation are final.

MEDICAL AUTHORIZATION
If an emergency occurs, I authorize event personnel to contact emergency services. I understand that I am responsible for medical or emergency expenses incurred on behalf of myself or anyone participating with my entry.

PHOTOGRAPHY AND PUBLICITY
I authorize the organizer and its representatives to photograph, record and display my entry and its participants for lawful promotional, editorial and community purposes without compensation. I understand that parents or guardians should be informed when minors may be photographed.

WEATHER, CHANGES AND CANCELLATION
I understand that parade activities may be delayed, changed or canceled because of weather, emergencies, safety concerns or circumstances outside the organizer’s control. Unless otherwise stated in writing, registration fees and participation expenses are nonrefundable.

ACKNOWLEDGMENT
I certify that the information in this application is accurate. I have read and understand this agreement, have had an opportunity to ask questions and voluntarily agree to its terms. I understand that I am giving up certain legal rights by accepting this agreement.
