VOLUNTEER AGREEMENT, RELEASE OF LIABILITY, AND PHOTO RELEASE
1. Parties and Event
• "Releasor" means the individual participant/volunteer signing below (and, if applicable, the participant’s parent or legal guardian).
• "Released Parties" means the City of Huntington Park, the Huntington Park City Council, their officers, employees, volunteers, agents, sponsors, and representatives.
• "Event" means the Huntington Park Holiday Parade and all related activities (setup, staging, participation, and breakdown).
2. Assumption of Risk
I understand that participating in a public parade and related activities involves inherent risks, including but not limited to: bodily injury, illness, property damage, vehicle accidents, slips and falls, crowd-related incidents, and unpredictable weather. I knowingly and voluntarily assume all inherent risks of the Event and accept sole responsibility for any injury, loss, or damage I may suffer.
3. Release of Liability & Covenant Not to Sue (Ordinary Negligence Only)
I hereby release, waive, discharge, and covenant not to sue the Released Parties from any and all claims, liabilities, or demands arising out of my participation in the Event, including claims caused by the ordinary negligence of the Released Parties. This agreement does not release claims arising from gross negligence, willful misconduct, or intentional acts of the Released Parties.
4. Indemnification (Hold Harmless)
I agree to defend, indemnify, and hold harmless the Released Parties from any and all claims, liabilities, damages, or costs (including attorney fees) arising out of my own negligent or wrongful actions, or those of the minor participant on whose behalf I sign, during the Event.
5. California Civil Code Section 1542 Waiver
I expressly waive all rights under California Civil Code Section 1542, which states:
"A GENERAL RELEASE DOES NOT EXTEND TO CLAIMS THAT THE CREDITOR OR RELEASING PARTY DOES NOT KNOW OR SUSPECT TO EXIST IN HIS OR HER FAVOR AT THE TIME OF EXECUTING THE RELEASE AND THAT, IF KNOWN BY HIM OR HER, WOULD HAVE MATERIALLY AFFECTED HIS OR HER SETTLEMENT WITH THE DEBTOR OR RELEASED PARTY."
I understand that this means I am waiving claims I do not currently know exist, which if known, would affect my decision to sign.
6. Photo, Video, and Media Release I grant the City of Huntington Park the unrestricted, royalty-free right to record and use my (or my minor child’s) likeness, voice, and appearance captured at the Event in any media format for promotional or educational purposes.
7. Governing Law and Severability This Agreement shall be governed by California law. If any portion is held invalid, the remaining terms shall continue in full legal force.
ACKNOWLEDGMENT & SIGNATURE
BY SIGNING, I CERTIFY THAT I AM AT LEAST 18 YEARS OLD, HAVE READ AND UNDERSTOOD THIS ENTIRE AGREEMENT, AND VOLUNTARILY AGREE TO WAIVE CERTAIN LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE FOR NEGLIGENCE.
