First City Pride Center PRIDE MARKET AGREEMENT
2023 Savannah Pride Festival Friday-Saturday October 20–21, 2023
By clicking that you agree to this PRIDE MARKET AGREEMENT (“Agreement”) for the 2023 Savannah Pride Festival, Pride Market Participant(s) agree to each and all clauses set forth in this Agreement.
Failure by the Pride Market Participant(s) or any employee or associate of the Pride Market Participant(s) to abide by any clause set forth in this Agreement of the 2023 Savannah Pride Festival grants The First City Pride Center and/or the authorized agents of First City Pride Center the right to: (1) immediately terminate this Agreement (2) require Pride Market Participant(s), immediately upon notice of violation of this Agreement, to cease operations and vacate the premises, and (3) forfeit any and all fees paid to The First City Pride Center for the right and privilege of participating in the Pride Market of the 2023 Savannah Pride Festival. No clause of this Agreement may be altered or changed in any way without the written consent of First City Pride Center.
1. Pride Market hours are Friday October 20th, 2023, 5:00PM-11:00PM and October 21th, 2023, 1:00PM to 11:00PM. 2. Non Profits may be asked to provide proof of non-profit 501c(3) status. 3. First City Pride Center does not give non-profit rates to political candidates, or political parties. 4. Vehicles are permitted during Setup for loading and unloading only before 4:00PM Friday and 9:00AM on Saturday. Vehicles are permitted 15 minutes to load and unload then must find valid parking to provide access to emergency vehicles. A schedule will be sent prior to the festival.5. Motorized Vehicles are NOT ALLOWED ON THE SQUARE. 6. Merchants will be given a merchant pass for temp parking to unload. 7. First City Pride Center accepts no responsibility for items lost due to theft or breakage.One security guard will be onsite, otherwise, merchant booths are not protected overnight. 8. Upon acceptance to the Pride Market, the vendor will select their booth for the event. Instructions on check in procedures will also be included. 9. Any vehicles illegally parked are subject to towing at the owner’s expense. 10. Pride Market participants shall not display, offer for view, or sell any illegal or contraband items at any and all sites and operations of the 2023 Savannah Pride Festival. The laws of the State of Georgia and local ordinances of the City of Savannah and Chatham County shall be observed.. 11. Pride Market participants shall not display, offer for view, or sell any items that are unlicensed and/or copies/interpretations of licensed or registered items at any and all sites and operations of the 2023 Savannah Pride Festival. 12. Pride Market participants shall not display, offer for view, take orders for or sell any items that are imprinted, emblazoned or marked in any manner with the words “Savannah Pride Mermaid Festival" "Mermaid Fest" "First City Pride Center" or "Savannah Pride". Even when printed with other words, Pride Market participants shall not offer phrases, logos or artwork with any variations of these words. 13. Anyone wishing to sell or serve either food and/or non-alcoholic beverages at the 2023 Savannah Pride Festival must complete and submit the Merchant Application indicating your intent to sell such items with complete description to First City Pride Center. Only prepackaged food and drink allowed.14. At the festival site, serving or selling any form of alcoholic beverage is strictly prohibited. 15. Merchants are provided with a tent space in a communal tent. Merchants may not opt to bring their own branded tent unless they have signed up for one of those dedicated spots. However, sponsors may have tents approved by First City Pride Center prior to the event date. EVERY MERCHANT MUST HAVE A TENT! 16. Pride Market Participant(s) acknowledges and understands that they are responsible for sales and use tax and shall in no way hold First City Pride Center or its representatives responsible for any tax or fee required by Federal, State, or Local authorities. 17. Refund Policy: No refunds will be given. In the event Savannah Pride 2023 is canceled or postponed, your vendor application and fee will apply to the new date of Savannah Pride. 18. First City Pride Center makes no representation or guarantees towards actual festival attendance. 19. Pride Market Participant(s) shall hold harmless First City Pride Center for any losses that could arise because of weather, acts of God, acts of terrorism, governmental intervention, or any other cause that may prevent, and or interrupt, the festival. 20. First City Pride Center reserves the right to place Pride Market Participant(s) in a booth location at the complete discretion of First City Pride Center Pride Market Participant(s) may request a preference of placement; however, First City Pride Center. shall have sole and complete authority to place the participant in any location contained in the MarketPlace, irrespective of the participant’s request. 21. Failure to provide notice of electrical service request may result in the participant’s placement in a booth with no electrical service and no guarantee of First City Pride Center’s ability to provide such service. 22. Merchants agree to clean up their assigned space at the end of the event and remove any items brought by their organization/business. An ADDITIONAL FEE may be assessed if the area is not properly cleaned. 23. NO OBSCENE CONTENT or items displaying any profanity will be permitted in the Pride Market. This is to include props, costumes, merchandise, and advertisements. The First City Pride Center has the right to pull any items that may violate this policy. Refusal to comply may result in the removal of Pride Market participants without refund. If you have any questions regarding the approval of props, costumes, merchandise, or advertisements, please do not hesitate to contact any First City Pride Center Board Member. 24. In order to process this application, the Merchant must agree to the above terms and conditions, and this Agreement must be signed and dated with the amount due submitted. Any applications received without Agreement signed and/or without payment included will not be processed. Payment must be received by the deadline for the application to be considered complete. 25. First City Pride Center reserves the right to move merchants' space numbers despite merchant space requests. No refunds will be given if a merchant is moved.26. No vendor shall have a mobile cart during the event and shall bring any additional booth supplies needed to conduct their business in accordance with all guidelines listed above.
*FOOD MERCHANT REQUIREMENTS: FOOD MERCHANTS CAN ONLY PROVIDE PRE-PACKAGED FOOD. NO COOKING ON SITE. ALL COOKING MUST TAKE PLACE IN A COMMERCIAL KITCHEN. MUST APPLY AND HAVE A FOOD SERVICE PERMIT FROM THE CHATHAM COUNTY HEALTH DEPARTMENT. FOOD MERCHANTS MUST PASS INSPECTIONS BY THE HEALTH DEPARTMENT THE MORNING OF THE EVENT. FIRST CITY PRIDE CENTER TAKES NO PART IN THIS PROCESS. INSURANCE IS REQUIRED FOR ALL RETAIL & FOOD MERCHANTS. YOU ARE RESPONSIBLE FOR PROVIDING YOUR OWN INSURANCE.
When you complete your application you are agreeing to the following:
This Agreement has been read, understood and entered into freely, voluntarily and absent of duress by the parties submitting this application. Any modification of this Agreement shall be null and void unless said modification is set forth in writing and signed by the same parties (or his/her representatives) having signed this Agreement.
