Terms & Conditions:
    If you are selected to perform at the Festival, these are the terms. In exchange for the following mutual consideration and promises, the sufficiency of which is hereby acknowledged, the parties agree as follows:
1. Place, date, and time of Show. The parties agree that the time and place of show will be on May 6th, 2023 during your assigned time slot. Please be aware that there will be road closures on this day so plan to arrive early. Your group must check in with the stage manager 20 minutes before your performance time. Failure to do so may result in the forfeiture of your performance time.
2. Description of the Show. If for any unforeseen circumstance such as weather, technical complications, etc., your performance, if it starts late, will still end at the time stated. Please refrain from profanity, sexual innuendo, and political statements in your performance. Audio technical requirements must be provided three weeks prior to the performance time. 3. The main stage is equipped for full band performance. Performers are responsible for bringing all ¼ inch instrument cables. 4. Sound. Sound volume is at the complete discretion of the sound tech provided by contractors hired by the May Day Festival5. In the event of heavy rain or other severe weather conditions, the scheduled May Day Festival may be suspended. The decision to postpone the event is left solely up to the discretion of the Directors of May Day Festival. If this occurs, we will try to reschedule to May 7th, 2023. If severe weather continues into May 7th, 2023 the May Day Festival will be canceled. If the Festival is canceled or performers cannot be at the date to which the Festival is postponed to, they will receive half of their agreed-upon payment. ACCIDENT WAIVER AND RELEASE OF LIABILITY FORMIn consideration of considering or approving my application for permitting me to participate in the activity and event described below, I hereby agree on behalf myself, my executors, administrators, heirs, next of kin, successors, and assigns as follows:
- Acknowledgement and Assumption of Risk of Injury to the performer. I understand and agree that there are risks of significant injury to the performer, whether caused by the performer or someone else, in their use of or presence on the May Day Festival premises. I understand and agree that these risks of injury include, but are not limited to, slips, trips, falls, collisions, thefts, equipment failure, or other such accidents or incidents that may result in injury, harm or damage, including but not limited to economic, property, emotional, mental, physical, or any other type of damage, including but not limited to sprains, torn muscles or ligaments, broken bones, strokes, heart stress, heart attacks, paralysis, disfigurement, death, or other forms of pain or suffering. On my behalf, and on the behalf of the minor performer above, I fully understand, voluntarily accept, and specifically assume these risks of injury to the performer.
- Waiver Liability and Indemnification Agreement. This Release and Waiver of Liability (the “release”) releases The May Day Festival and each of its directors, officers, employees, volunteers, and agents. The Performer desires to perform at The May Day Festival (‘Event”) in Nashville, TN on May 6th, 2023. In consideration of my application and permitting me to participate in this activity, I hereby take action for myself, my executors, administrators, heirs, next of kin, successors, and assigns as follows:
- (A) I WAIVE, RELEASE, AND DISCHARGE from any and all liability, including but not limited to, liability arising from the negligence or fault of The May Day Festival any claims or damages for my death, disability, personal injury, property damage, property theft, or actions of any kind which may hereafter occur to me including my traveling to and from this activity, the following entitles and persons: May Day Festival’s directors, officers, employees, volunteers, representatives, and agents, and the activity holders, sponsors, and volunteers (the “Released Parties);
- (B) I INDEMNIFY, HOLD HARMLESS, AND PROMISE NOT TO SUE the Released Parties and release them from any and all liabilities or claims made as a result of participation in this activity, whether caused by the negligence or fault of the May Day Festival.
- I acknowledge that the May Day Festival and their directors, officers, volunteers, representatives, and agents are NOT responsible for the errors, omissions, acts, or failures to act of any third party or entity conducting a specific activity at or during the Event. The Accident Waiver and Release of Liability Form shall be construed broadly to provide a release and waiver to the maximum extent permissible under applicable law. I CERTIFY THAT I HAVE READ THIS DOCUMENT AND I FULLY UNDERSTAND ITS CONTENT. I AM AWARE THAT THIS DOCUMENT IS A RELEASE OF LIABILITY AND A CONTRACT AND I ACKNOWLEDGE AND AGREE TO ITS TERMS.
3. Medical Treatment Release. I hereby authorize the May Day Festival to secure, and I consent to, any medical treatment that may be given to me should the May Day Festiva determine, in its sole discretion, that I need medical care and am unable to consent at the time, as a result of participating in the Activity. I accept full responsibility for all costs related to the medical treatment, including any transport costs, and I release all parties involved from any type of liability for anything that may happen during my treatment or transport. By signing this Agreement, I certify that I have thoroughly read, fully understand, and voluntarily accept and agree to its terms.
