As a food vendor, I agree:
The booth space I rent shall be used exclusively for the sale of the submitted and agreed-upon menu.
To remain in compliance with applicable federal, state, and local laws, ordinances, and regulations, I will always comply with health and safety requirements and obtain necessary licensing, permits, and insurance for the sale of food and beverages at the food booth.
I shall maintain the booth and the area surrounding the booth in conformity with all applicable sanitary and health laws and regulations and shall also keep the booth and the surrounding area neat, clean, and free of accumulated refuse and debris. I will place a tarp or something similar on the ground in my booth to keep the pavement clean. I will dump NOTHING into the sewer.
Amplified sound is not permitted to come from my booth.
To consent to the assignment of my booth space by the Festival organizers, the organizer reserves the right to reassign booth locations at any time prior to the beginning of the Festival.
Booth rental fees are due and payable by April 10, 2023. Failure to pay the fee may result in the loss of my space at the May Day Festival. Rental fees are non-refundable.
I will not assign any rights under this Agreement to any person.
My relationship with the organization under this agreement shall be that of an independent contractor. I shall not have the authority to bind the organization to any contract or agreement, nor shall I represent to any person that I am the agent or representative of the organization.
The organization nor I shall be liable to the other for any delay or failure to perform due to government action, court order, civil disturbance, inclement weather, an act of God, or other cause beyond the reasonable control of the party whose performance is delayed or prevented.
Except as otherwise specified in this agreement, neither party shall be liable to the other party for consequential damages, including lost profit or no revenue, for any breach of the agreement.

For onsite cooking- All food vendors shall use hot boxes, sterno burners, or electric cooking equipment. No open gas or propane flames and no deep frying or oil vats unless PRIOR WRITTEN OWNER and PROPERTY MANAGEMENT APPROVAL and subject to certain rules and restrictions.
No coolers or “bring your own drinks” shall be permitted. Any alcohol available for the event shall be provided by licensed vendors which shall require age verification and shall comply with any other requirements by applicable law. Any guest attending the event shall be required to be ID’d prior to the sale of alcohol. The alcohol vendor shall provide wristbands or other indications of the proper drinking age. No alcohol shall be permitted to leave the Event Area.
In the event of imminent severe or heavy rain conditions, the scheduled May Day Festival may be suspended. The decision to postpone the event is left solely up to the discretion of the Directors of the May Day Festival. If this occurs, we will try to reschedule for May 7th, 2023. If severe weather continues into May 7th, 2023, the May Day Festival will be canceled. No refunds will be provided due to issues beyond the organizer's control, such as weather.
The following is needed when accepted to participate in our event:
A check or electronic payment to cover your booth fee.

A copy of your insurance certificate listing a single limit liability of not less than $_1_ million, and general aggregate liability of not less than $_2_ million. Auto liability with a combined single limit not less than $ _1_million, and Umbrella/Excess Liability of not less than $_3_million. Capitol View JV-E, Capitol View JV-D, Boyle Investment Company, and Boyle Nashville, LLC shall be named as an additional insured of said policy. Certificate Holder will be Boyle Nashville, LLC 2000 Meridian Blvd, Suite 250 Franklin, TN 37067.
