MISSION & PARTNERSHIP
None of this programming would be possible without the invaluable support of our partners, the Huntington Village Business Improvement District (BID) and Northwell/Huntington Hospital. Together we bring free, community-wide holiday programming to downtown Huntington, and the Spectacular Markets give local artists, makers, and small businesses a place at the heart of it.
Why Your Support Matters: Your fee supports independent musicians, staffing, and community-wide marketing. Colored Colors does not receive state or county funding; our programs are fueled by your participation.
We appreciate your interest and look forward to reviewing your application!

About the event
Terms & Conditions
2026 VENDOR AGREEMENT & TERMS AND CONDITIONS
This agreement is between Colored Colors ("Organizer") and the applicant ("Vendor"). It applies to the Spectacular Markets at the Huntington Holiday Spectacular, Huntington, NY (each an "Event"), and to every application the Vendor submits for an Event, including make-up date applications.
1. SERVICE DEFINITION & VENDOR EXPECTATIONS
- Nature of Service: Colored Colors provides rental of ground space only ("Booth Space") within a public setting, together with general event marketing.
- No Guarantees of Performance: Colored Colors does not guarantee sales, foot traffic, or the number of participating vendors on any date.
- Market Fluctuations: As a grassroots, open-air event, the layout, vendor count, and attendance fluctuate with weather, vendor cancellations, and other variables. A reduced vendor count or a changed floor plan is not a material deviation from the advertised Event and is not grounds for a refund, credit, or dispute.
- Sales Responsibility: Colored Colors takes no commission. Lack of sales, low foot traffic, or dissatisfaction with the atmosphere are not grounds for a refund or credit.
2. LIABILITY AND INDEMNIFICATION
- Neither Colored Colors nor its partners, sponsors, hosts, affiliates, officers, agents, or employees are liable for accidents, personal injury, or lost, stolen, or damaged goods during an Event.
- Indemnification: The Vendor agrees to indemnify and hold harmless Colored Colors and its associated partners — including but not limited to the Town of Huntington, the Huntington Village Business Improvement District, Northwell Health / Huntington Hospital, the Huntington Holiday Spectacular organizers, and event sponsors — from any claims, damages, or liabilities arising from the Vendor's participation or negligence.
- Insurance: Vendors are strongly encouraged to carry temporary event insurance for their own inventory and liability.
3. REFUND POLICY (NO CASH REFUNDS) & CREDIT SYSTEM
- Non-Refundable Fees: All fees are non-refundable. Monetary refunds are not issued except in the single circumstance stated in Section 8.
- What a Credit Is: Where this agreement provides for a Credit, one Credit equals one Event date in the same space type the Vendor originally purchased, at the next edition of the same Event (for example, a Credit from Holidays At The Park 2025 is valid only for Holidays At The Park 2026). Credits carry no cash value and no cash difference is paid if prices change.
- Redemption: Credits are redeemed through a private make-up date application sent to the Vendor's email on file before the public application deadline. Credit holders who submit by the priority placement deadline stated in the invitation receive the dates they select; after that deadline, placement is subject to availability. See Section 7.
- Expiry: A Credit must be redeemed for a date at the next edition of the Event. Credits not redeemed during that edition's season are forfeited. Credits do not roll over to a later season.
- Not Transferable: Credits cannot be applied to a different Colored Colors event, transferred to another vendor or business, or upgraded to a larger space.
4. VENDOR CANCELLATION POLICY
A cancellation request must be made in writing through holidays@coloredcolors.com.
Credit eligibility is determined by the date the written notice is received:
- 60+ days prior: Full Credit, less a $10 administrative fee per event day.
- 15 to 59 days prior: 50% Credit.
- 3 to 14 days prior: 25% Credit.
- Less than 72 hours prior: No Credit.
- Weather Opt-Out Windows: Colored Colors may, at its discretion, announce an opt-out window before a date with a poor forecast. A Vendor who opts out through the designated form before the stated cutoff will not be charged the No-Show Fee. Unless the announcement states otherwise, the booth fee for that date is forfeited and no Credit is issued, because the Event proceeds rain or shine.
- Personal cancellations (illness, travel, scheduling conflicts) follow the schedule above regardless of reason.
5. ATTENDANCE CONFIRMATION, NO-SHOW, LATE ARRIVAL & EARLY BREAKDOWN
- Confirmation: Approximately 48 hours before each date, Colored Colors sends a confirmation request by text message or email, with a confirmation form. Vendors must confirm by the cutoff stated in that message.
- Unconfirmed Space: If a Vendor does not confirm by the cutoff, Colored Colors may release the space to a waitlisted vendor. A space released for non-confirmation is treated as a cancellation under Section 4.
- Load-In: Load-in begins 90 minutes before the posted opening time. Vendors must check in before opening. Full logistics are sent in the vendor packet by email after onboarding.
- No-Show / Late Arrival: A Vendor who does not cancel and fails to attend, or who arrives after the load-in window without prior notice, forfeits the booth fee in full (0% Credit) and is charged a $50 No-Show Fee to the card on file.
- Early Breakdown: Vendors may not begin packing up earlier than 30 minutes before the posted closing time unless approved by a Colored Colors staff member on site. Unapproved early breakdown incurs a $25 Early Breakdown Feecharged to the card on file and is recorded against future applications.
- Space Sharing: Spaces may not be shared, sublet or transferred. One approved Vendor per space; undeclared sharing results in removal without refund or Credit.
6. WEATHER & POSTPONEMENT POLICY
Events proceed rain or shine. Rain dates are not scheduled in advance. A date may be postponed only (a) at the sole discretion of Colored Colors, or (b) by order of the venue partner or host — the Town of Huntington, the Huntington Village BID, or the Huntington Holiday Spectacular organizers — in cases of Extreme Weather or Safety Hazards, defined as:
- Lightning; sustained winds exceeding 30 mph, or any wind or gust conditions that Colored Colors or the venue host deems unsafe for tents, huts, or displays; snow accumulation over 3 inches or an active Winter Weather Advisory.
- Extreme temperatures (below 20°F or above 95°F).
- Closure of public transport hubs serving the venue, government-mandated closures, or closure of the venue by its host.
- Postponed Date: If a date is postponed under this section, the Vendor receives a Full Credit for that date under Section 3. No cash refund is issued.
- Delayed Opening or Shortened Hours: Colored Colors may delay opening, end early, or shorten a date for weather, safety, or venue operations. A date that operates for at least half of its scheduled hours is a held date and no Credit is issued. A date that operates for less than half of its scheduled hours, or does not open, is treated as postponed.
- Timing of Decisions: Colored Colors will make and communicate postponement decisions as early as the forecast allows — the evening before where possible, and otherwise no later than the start of the load-in window. Decisions made during a date, once vendors are on site, are made only for safety.
- Notice: Postponement notices are sent to the email on the application and, where selected, by text message. The notice states the remedy.
7. MAKE-UP DATES
- Priority Placement: Credit holders receive a private make-up date application before, or alongside, the public application. Vendors who submit by the priority placement deadline in the invitation are placed on the dates they select ahead of new applicants, subject to the space type of the original purchase. Submissions after that deadline are placed as availability allows.
- One Credit, One Date: Each Credit is redeemed for a single date of the same space type. Vendors with multiple Credits select one date per Credit.
- Regular Dates: A make-up date is a regular Event date. Every section of this agreement applies to it in full, including confirmation, no-show, cancellation, audits, and this weather policy. Receiving a make-up date does not exempt the Vendor from any policy.
- Make-Up Date Postponed: If a make-up date is itself postponed under Section 6, the Credit is re-issued in full for the next edition of the Event.
- Unclaimed Credits: Credits not redeemed for a date during the next edition's season are forfeited.
- Additional Dates: Credit holders who want dates beyond those owed apply through the public application at the standard rate; placement for additional dates is not guaranteed.
8. FULL EVENT CANCELLATION (FORCE MAJEURE)
- If an Event is cancelled in its entirety due to Unforeseen Circumstances (natural disasters, acts of God, government mandates, civil unrest, pandemics, infrastructure failures, or loss of the venue), Vendors receive a Full Credit for every date purchased, valid for the next edition of the Event under Section 3.
- Refund if the Event Does Not Return: If no edition of the Event is held within the redemption period of the Credit issued under this section, Colored Colors will refund the fees paid for the cancelled Event to the original payment method. This is the only circumstance in which a cash refund is issued.
9. AUDITS & PRODUCT COMPLIANCE
- Audits are conducted before the Event opens. The Vendor's setup must match the products and professional standards listed in the approved application.
- Prohibited Items: Alcohol and THC products are strictly prohibited.
- Non-Compliance: If a discrepancy is found, Colored Colors may remove the Vendor from the Event immediately without refund or Credit.
10. CHARGEBACK & DISPUTE POLICY
By submitting an application, the Vendor acknowledges that all sales are final. Filing a dispute or chargeback claiming "Services Not Provided" or "Item Not as Described" when the Booth Space was made available, or when a Credit was issued under this agreement, is a breach of contract and will be treated as fraud.
- Colored Colors will submit the signed application, these terms as displayed within it, the postponement or confirmation notices sent, and check-in logs as evidence to the financial institution.
- Vendors who file fraudulent chargebacks are permanently banned from all future Colored Colors events.
11. COMMUNICATION
- Official Channels: Eventeny messaging and the Event inbox (Spectacular Markets: holidays@coloredcolors.com). Messages sent elsewhere may not be received or acted on.
- Delivery: A notice is deemed delivered when sent to the email address or mobile number on the Vendor's application. Vendors are responsible for keeping those details current and for checking spam folders.
- Logistics: Vendor packets, load-in windows, and space assignments are sent by email the week of each date.
12. ENTIRE AGREEMENT
The Vendor's application, its electronic signature, these Terms and Conditions as displayed within the application, and the Vendor Booth and Event Requirements Agreement (2026) together form the complete agreement between the Vendor and Colored Colors for the Event. Where this document and an application description differ, this document controls.
