About the application

Calling all food trucks, food booths, sweet treat makers, and specialty drink vendors! ✨ Join Fairytale Finds Market and bring your delicious offerings to a community that loves shopping small and supporting local businesses.

Please include your proposed menu, pricing, photos of your setup, booth or vehicle dimensions, and any power or generator needs. Themed menu items are encouraged to add a little extra magic!

Vendors are selected based on menu variety, quality, presentation, and available space. Submitting an application does not guarantee acceptance. Approved vendors must have all applicable permits and licenses and follow food safety, fire, and event requirements.

Terms & Conditions

1. Parties and Acceptance

These Terms and Conditions constitute an agreement between Hundred Acre Holdings LLC, doing business as Fairytale Finds Market (“Organizer”), and the individual or business accepting these terms (“Vendor”). The person accepting on behalf of a business represents that they have authority to bind that business.

These terms apply to the event identified in Vendor’s application and booking confirmation (“Event”). Submission of an application does not guarantee acceptance.

2. Approval, Fees, and Booth Assignments

Participation requires Organizer’s written approval and timely payment of the fees disclosed before booking. Vendor may sell only the products or services approved in its application. Booth sharing, transfers, and substitutions require prior written approval.

Organizer may adjust booth assignments for safety, accessibility, or operational needs. Booth fees include only the items expressly identified in the booking confirmation. Organizer does not guarantee attendance, sales, profits, exclusivity, or a particular booth location.

3. Cancellations and Event Changes

Vendor cancellations and no-shows are nonrefundable unless otherwise stated in the booking confirmation or required by law.

If Organizer cancels the Event before it begins, Vendor will receive a refund of its booth fee or may voluntarily accept a credit toward a rescheduled event. If the Event is interrupted after opening by weather, an emergency, or a government directive, refunds will be handled under the cancellation policy provided before booking and applicable law.

Organizer is not responsible for Vendor’s travel, inventory, staffing, or other independent expenses arising from changes outside Organizer’s reasonable control.

4. Setup, Operations, and Safety

Vendor must comply with the setup and breakdown schedule, remain open during advertised hours, and keep its assigned area clean and accessible. Early departure requires approval unless necessary for safety.

Vendor must comply with applicable laws, permit requirements, venue rules, and reasonable safety instructions. Vendor is responsible for required licenses, taxes, insurance, food permits, approved electrical equipment, and properly secured tents and displays. Required insurance limits and documentation must be disclosed before booking.

5. Products and Intellectual Property

Vendor is responsible for the safety, legality, labeling, and authenticity of its products and services and for obtaining any necessary intellectual-property permissions.

Participation does not grant Vendor a license to use third-party characters, trademarks, artwork, or other protected material. Vendor may use Organizer’s promotional assets only as authorized to advertise its approved participation.

6. Conduct and Removal

Harassment, threats, discriminatory conduct, unsafe activity, and materially false representations are prohibited.

Organizer may suspend or terminate participation for a material breach. When reasonably practicable, Organizer will provide notice and an opportunity to correct the issue. Immediate removal may occur when reasonably necessary to address safety concerns, unlawful activity, or serious misconduct. Removal for a substantiated material breach does not entitle Vendor to a refund, except as required by law.

7. Confidential Information

Vendor shall not use or disclose Organizer’s nonpublic business information provided in confidence, including private vendor contact lists, negotiated pricing, internal financial information, and unreleased operational or marketing plans, except as necessary for approved participation.

Confidential information excludes information that is public through no breach, lawfully obtained from another source, previously known without restriction, or independently developed. Public vendor listings, general event themes, and Vendor’s own customer relationships are not confidential information.

This obligation continues for five (5) years after Vendor’s final participation. Information qualifying as a trade secret remains protected for as long as applicable law provides. Legally required disclosures and reports to government authorities are permitted.

8. Limited Non-Competition — Proposed Five-Year Restriction

For purposes of this section:

“Competing Event” means [precisely describe the type of market and activities restricted].

“Restricted Territory” means [identify the specific cities or geographic radius supported by Organizer’s business interests].

During Vendor’s participation and for five (5) years following the last event in which Vendor participates under this agreement, Vendor shall not own, organize, produce, or exercise operational control over a Competing Event within the Restricted Territory.

This restriction does not prohibit Vendor from selling products or services at other events, operating its ordinary retail business, or advertising its own products. The restriction does not apply to preexisting event operations identified in writing and expressly excluded by both parties before acceptance.

The parties identify the specific legitimate business interest supporting this restriction as [describe the actual confidential information or business goodwill being protected]. Participation alone does not establish that Vendor received confidential information.

This provision requires completion of the definitions above and separate written acceptance before it is included in the final agreement.

9. Responsibility and Indemnification

Vendor is responsible for its personnel, merchandise, equipment, and business operations.

To the extent permitted by law, Vendor shall indemnify Organizer against third-party claims and reasonable associated costs to the extent caused by Vendor’s negligence, willful misconduct, unlawful products, or material breach of this agreement. This obligation does not extend to losses caused by Organizer’s negligence or willful misconduct.

10. Enforcement and Disputes

A party alleging a breach may pursue remedies available under applicable law, subject to required proof. This agreement does not establish automatic penalties or an automatic right to injunctive relief.

Arizona law governs this agreement. Unless applicable law requires otherwise, disputes shall be brought in a court of competent jurisdiction in Maricopa County, Arizona.

11. Entire Agreement and Severability

These terms and the accepted booking confirmation constitute the agreement concerning Vendor’s participation. Material amendments require both parties’ written acceptance.

If a provision is held unenforceable, the remaining provisions remain effective to the extent legally permissible. This clause does not authorize a court to rewrite a restriction beyond its lawful authority.

12. Acceptance

By signing or electronically accepting these terms, Vendor confirms that it has read and understood the agreement and agrees to be bound by its completed provisions. Section 8 requires the separate acceptance specified above.
