About the application

Welcome to Gasparilla Pirate Fest! Each year, hundreds of thousands of pirates, families, and visitors from across the country gather in Tampa for this iconic tradition.

 

Please review the application and all vendor requirements carefully before submitting. 

 

This application serves as an electronic agreement. By selecting your booth space and submitting your application, you acknowledge that you have read, understand, and agree to all terms and conditions associated with participation in the event.

Terms & Conditions

Any changes in pricing or specifications of products to be sold (including additions or deletions to these agreed upon items) must be signed by BOTH parties and attached to this Agreement as an Addendum prior to them being sold.

 

Fees and Payment Requirements

All prices include applicable state sales tax.

Vendor agrees to submit a $50.00 non-refundable Application Fee per location at the time of application.

Upon acceptance into the Event, Vendor shall be responsible for payment of the required Concessionaire's Fee and security deposit per location.

Vendor agrees to pay EventFest, Inc. a Concessionaire's Fee equal to the greater of (a) $1,750.00 per location or (b) 30% of gross sales.

The minimum Concessionaire's Fee of $1,750.00 per location is due no later than January 4, 2027. If 30% of gross sales exceeds the minimum Concessionaire's Fee, Vendor shall remit the additional amount owed ("Overage") together with the completed Vendor Settlement Sheet no later than February 12, 2027.

Failure to submit required payments and/or the completed Vendor Settlement Sheet by the applicable deadlines may, at EventFest, Inc.'s sole discretion, result in forfeiture of Vendor's deposit(s) and suspension from participation in EventFest events for up to three (3) years. 

Note: Location(s) cannot exceed 10’ x 20’.  Larger locations will require additional fees.

 

Vendor Rules, Requirements & Operating Policies

 

1. Sales Reporting, Inventory & Audits

Inventory Requirements
EventFest, Inc. reserves the right to inventory all concession products supplied by Vendor to assist in accurately determining gross revenue earned by Vendor. Vendor shall provide sufficient product inventory to maximize sales opportunities and revenues for the Event.

Sales Audits
EventFest, Inc. reserves the right to conduct random spot audits of Vendor inventory, cash receipts, and point-of-sale (POS) register readings at any time during the Event.

2. Vendor Location & Event Placement

Vendor sales outlet(s) shall be located only within spaces specifically designated by EventFest, Inc. management. Vendor locations are subject to change at any time at the discretion of EventFest, Inc., the 2027 Gasparilla Pirate Fest, or applicable government authorities.

Vendor shall not set up, operate, or park on any City Right-of-Way unless such Right-of-Way has been officially closed by the City through the approved Maintenance of Traffic (MOT) plan for the Event.

3. Sponsor Product Exclusivity & Required Purchases

EventFest, Inc. reserves the right to offer exclusive sponsorship opportunities that may require Vendor participation in mandatory product purchase programs (including, but not limited to, products such as sausage, hot dogs, soda, water, or other sponsor-category items).

Vendor acknowledges that sponsor exclusivity and required purchase programs are important to the success of the Event and agrees to comply with all applicable requirements established by EventFest, Inc.

Any exclusive sponsor product categories and/or mandatory vending purchase program requirements will be communicated to Vendors no later than January 4, 2027.

4. Vendor Responsibilities & Required Equipment

Vendor is responsible for providing all personnel, tables, chairs, equipment, signage, and other operational supplies necessary for participation in the Event.

Vendor shall obtain and maintain all required health permits, occupational licenses, and approvals necessary to operate.

Vendor agrees to comply with all applicable city, state, and federal laws, rules, and regulations related to Vendor's activities at the 2027 Gasparilla Pirate Fest.

Vendor shall provide fire extinguishers and any other required safety equipment in accordance with applicable laws and regulations.

Failure to comply with required regulations resulting in Vendor being shut down during the Event will not result in a refund of any fees paid.

5. Insurance Requirements

Vendor, at its sole cost and expense, shall procure, maintain, and keep in force throughout the term of this Agreement the required insurance coverage. All insurance policies shall be issued by a carrier licensed to do business in the State of Florida.

Vendor shall provide EventFest, Inc. with current Certificates of Insurance prior to participation and shall maintain required coverage throughout the duration of the Event.

Required coverage shall include:

  • Workers' Compensation Insurance:
    Vendor shall provide Workers' Compensation coverage for all employees working at the Event site with statutory limits as required by law.
  • Commercial General Liability, Automobile Liability & Product Liability Insurance:
    Vendor shall provide coverage for all operations, including contractual liability and products/completed operations coverage, with limits of not less than:
    • $1,000,000 per occurrence/claim; and
    • $2,000,000 aggregate.

Vendor shall provide proof of insurance covering any damages caused by Vendor, its employees, equipment, products, or operations.

 

Vendor agrees to indemnify and hold harmless EventFest, Inc., Ye Mystic Krewe of Gasparilla, the City of Tampa, and all Title and Presenting level sponsors from any loss, damage, or liability attributable to any act or omission of Vendor.

All required additional insureds shall be listed as additional insureds on applicable policies.

6. Agreement Assignment, Termination & Compliance

This Agreement shall be void upon assignment or attempted assignment by Vendor.

EventFest, Inc. reserves the right to terminate this Agreement for any of the following reasons:

  • Vendor sells or attempts to sell products or services other than those approved;
  • Vendor breaches any terms or conditions of this Agreement; or
  • Vendor violates Event rules, regulations, or operating requirements.

If EventFest, Inc. terminates this Agreement, Vendor shall immediately cease operations and remove all equipment, personnel, and property from the Event site.

Any fees paid to EventFest, Inc. shall be forfeited.

7. Prohibited Items & Operating Restrictions

Vendors are prohibited from selling or serving:

  • Styrofoam products;
  • Glass products;
  • Snap n' pops;
  • Silly string;
  • Spray urine products.

Additional restrictions:

  • Sponsor products must be sold exclusively where applicable.
  • No tent staking is permitted.
  • No charcoal use is permitted.
  • No oil dumping is permitted.
  • Used oil must be removed from the Event site and legally disposed of or recycled by Vendor.
  • Subcontracting is prohibited unless approved in writing by EventFest, Inc

8. Security Deposit Requirements

As a participating Vendor in the 2027 Children's Gasparilla Parade, Vendor shall provide a refundable security deposit of $500.00 per location.

The security deposit will be held to cover incidental damages caused by Vendor operations, including but not limited to:

  • Grease spills;
  • Sod damage;
  • Property damage; or
  • Failure to comply with EventFest, Inc. terms and conditions.

The security deposit may be forfeited for violations of this Agreement, including but not limited to:

  • Oil dumping;
  • Tent staking;
  • Unauthorized subcontracting; or
  • Other violations of Event rules and regulations.

Prices

Application fees $50.00 Non-refundable There is a $50 non-refundable application fee which is charged upon application.
Single booth $1,750.00 Non-refundable Charged at a later date upon approval. If your application is approved, the same credit card used to pay the non-refundable application fee will be charged for this fee. Vendor agrees to pay EventFest, Inc. a Concessionaire's Fee equal to the greater of (a) $1,750.00 per location or (b) 30% of gross sales. The minimum Concessionaire's Fee of $1,750.00 per location is due no later than January 4, 2027. If 30% of gross sales exceeds the minimum Concessionaire's Fee, Vendor shall remit the additional amount owed ("Overage") together with the completed Vendor Settlement Sheet no later than February 12, 2027. Note: Location(s) cannot exceed 10’ x 20’.  Larger locations will require additional fees.
Cleaning fees $500.00 Charged at a later date upon approval. If your application is approved, the same credit card used to pay the non-refundable application fee will be charged for this fee. $500 refundable deposit provided your area is left clean post event. To receive your deposit back, no trash or oil can be left onsite. Additionally, any and all barricades that are moved to load in or out must be replaced to ensure route security. If you do not replace these barricades, it will result in a loss of your deposit.
