Terms & Conditions

By submitting an application to participate as a Food Vendor or Food Truck at the Seneca Falls Canal Side Social, the applicant agrees to the following terms and conditions:

1. Application and Acceptance
Submission of an application does not guarantee acceptance into the event. All applications are subject to review and approval by event organizers. The festival reserves the right to accept or deny any application at its sole discretion based on space limitations, product variety, operational needs, and overall fit for the event.

2. Vendor Eligibility
This application is intended for food vendors, concessionaires, and food trucks offering prepared food, beverages, snacks, desserts, or other approved consumable items. Vendors must accurately describe the items they intend to sell. Only approved menu items may be sold at the event.

3. Booth Fees and Payment
If selected, vendors will be notified of acceptance and provided with payment instructions. Space is not reserved until full payment has been received. All fees are non-refundable unless the event is canceled by the organizer.

4. Permits, Licenses, and Compliance
Food vendors are solely responsible for obtaining and maintaining all required permits, licenses, certifications, and approvals required by local, county, state, and federal authorities. This includes, but is not limited to, food service permits, fire safety approvals, business licenses, sales tax registration, health department permits, and temporary event permits where applicable. Vendors must comply with all applicable food safety, sanitation, and public health regulations.

5. Insurance Requirements
Food vendors and food trucks are strongly encouraged, and may be required, to carry valid general liability insurance and any other insurance required by law or the event organizer. Vendors must provide proof of insurance upon request. Participation in the event is at the vendor’s own risk.

6. Booth and Vehicle Space
Each vendor will be assigned a designated space by event organizers. Vendors must operate only within their assigned footprint and may not expand into walkways, neighboring spaces, or public areas. Food trucks, trailers, tents, tables, generators, signage, and service areas must fit entirely within the assigned space.

7. Setup and Breakdown
Vendors must follow all designated load-in, setup, service, and load-out times. Late arrival may result in forfeiture of space without refund. Early breakdown is not permitted unless approved by event organizers. Vendors are expected to remain open and fully operational during the required event hours.

8. Utilities and Equipment
Electricity, water, grease disposal, ice, and other utilities or services are not guaranteed unless explicitly stated by the event organizers. Vendors are responsible for supplying all equipment necessary for operation, including extension cords, hoses, fire extinguishers, handwashing stations, tents, generators, and point-of-sale systems, unless otherwise specified.

9. Generator Use
If generators are permitted, they must be quiet, safe, and well maintained. Event organizers reserve the right to prohibit the use of any generator deemed excessively noisy, hazardous, leaking, or disruptive to neighboring vendors or attendees.

10. Fire and Safety Regulations
Vendors using cooking equipment, propane, open flame, or other heat sources must comply with all fire code requirements and safety regulations. Proper fire extinguishers and safety equipment must be present and accessible at all times. Vendors are responsible for securing any required fire inspections or approvals.

11. Food Safety and Sanitation
Vendors must maintain safe food handling, sanitation, storage, preparation, and serving practices at all times. All food must be prepared, stored, and served in accordance with applicable health department standards. Vendors are responsible for the cleanliness of their booth, truck, workspace, and food service areas throughout the event.

12. Menu and Product Restrictions
Only the menu items approved through the application process may be sold. Event organizers reserve the right to limit duplicate menu offerings and to prohibit the sale of items not listed in the original application. Vendors may not sell alcoholic beverages unless specifically authorized in writing by the event organizers and permitted by law.

13. Waste Disposal and Cleanliness
Vendors are responsible for maintaining a clean and orderly space and for disposing of all trash, wastewater, grease, food waste, packaging, and debris in compliance with event rules and applicable regulations. No dumping of grease, gray water, or waste on festival grounds, streets, drains, or surrounding properties is permitted.

14. Weather Policy
This event is rain or shine unless otherwise canceled or delayed by the organizers for safety reasons. Vendors are responsible for preparing for all weather conditions and securing their vehicles, tents, and equipment appropriately. No refunds will be issued due to weather unless the event itself is canceled by the organizer.

15. Vendor Conduct
Vendors are expected to conduct themselves in a professional, respectful, and cooperative manner. Disruptive behavior, harassment, unsafe practices, excessive noise, or failure to follow event staff instructions may result in removal from the event without refund.

16. Pricing and Sales Responsibility
Vendors are responsible for setting their own prices, processing transactions, managing cash or card payments, and collecting and remitting all applicable taxes. The festival is not responsible for lost income, low sales volume, equipment failure, or transaction issues.

17. Liability Waiver
The Seneca Falls Canal Side Social, its organizers, sponsors, partners, volunteers, venue representatives, and affiliates shall not be responsible for any injury, illness, loss, theft, spoilage, damage, or liability arising from vendor participation in the event. Vendors assume all risks associated with food service operations and public event participation.

18. Indemnification
By participating, vendors agree to indemnify, defend, and hold harmless the Seneca Falls Canal Side Social, its organizers, sponsors, partners, staff, volunteers, and affiliates from and against any claims, damages, losses, liabilities, costs, or expenses arising from the vendor’s participation, including but not limited to foodborne illness claims, personal injury, property damage, fire code violations, or violations of applicable laws and regulations.

19. Cancellations
If a vendor must cancel participation, written notice must be provided as soon as possible. Booth and space fees are non-refundable unless otherwise stated by the event organizers. The festival reserves the right to fill canceled spaces at its discretion.

20. Event Changes
The event organizers reserve the right to adjust the event layout, vendor placement, schedule, operational requirements, and other logistics at any time as needed for safety, compliance, or event success.

21. Photography and Promotion
By participating in the event, vendors grant permission for the Seneca Falls Canal Side Social and its representatives to photograph, film, and use images of vendor vehicles, booths, staff, menus, products, and branding for promotional, marketing, archival, and media purposes without compensation.

22. Right to Removal
The festival reserves the right to remove any food vendor or food truck from the event for noncompliance with these terms, unsafe operations, health or fire code violations, unauthorized menu items, misrepresentation on the application, or behavior deemed harmful to the event or attendees. No refund will be issued in such cases.

23. Agreement
By submitting an application, the vendor acknowledges that they have read, understood, and agreed to these Terms and Conditions in full.
