**THIS IS A RAIN OR SHINE EVENT**

 

This application is for local schools, marching bands, and performance ensembles wishing to participate in the 2025 404 Day Parade.

 

Definition of a School/Marching Band Group:

A school or marching band group, as defined by parade standards, is any organized group of students, musicians, or performers participating in the parade on foot that meets the following criteria:

  • Consists of five (5) or more individuals representing a school, marching band, or performance group.
  • Includes school bands, drumlines, dance teams, cheer squads, step teams, or other school-affiliated performance groups.
  • Performs or marches together in coordinated attire, uniforms, or themed outfits.
  • Does not utilize floats, vehicles, or motorized equipment (unless pre-approved for specific performance needs).
  • Adheres to the parade’s guidelines for spacing, safety, and orderly conduct throughout the parade route.
  • Applications for organizations identified as corporate, small business, non-profit, and/or political groups will not be accepted under this application. Those groups should complete the appropriate application for parade inclusion.

IMPORTANT: NOTHING MAY BE THROWN BY PARADE PARTICIPANTS, INCLUDING FROM FLOATS, VEHICLES, OR WALKING GROUPS.

Hosted by the 404 Collective, this celebration of everything Atlanta will take over Peachtree Street with a blend of culture, community, and fun. Parade route is 1.1 miles from start to finish. 404 Day 2026 Parade Terms and Conditions

By submitting an application to participate in the 404 Day 2026 Parade (the "Parade"), you ("Participant" or "Organization") agree to be bound by these Terms and Conditions. The Parade is organized and hosted by the 404 Collective and ButterATL, LLC (collectively, "Organizers").

 

1. Event Details
The 404 Day 2026 Parade will take place on April 4, 2026, in Atlanta, Georgia. THIS IS A RAIN OR SHINE EVENT. The Parade will proceed regardless of weather conditions unless deemed unsafe by Organizers or local authorities.

 

2. Application Process
2.1 Application Fee
A nonrefundable application fee is required with each submission. The amount varies by application type. This fee will not be refunded under any circumstances, including if you complete the wrong application form. If you have questions about which form to complete, please email hello@butteratl.com before submitting.

2.2 No Guarantee of Acceptance
Submission of an application does not guarantee acceptance into the Parade. Organizers reserve the right to accept or reject any application at their sole discretion.

2.3 Correct Application
Participant is responsible for completing the correct application form for their category (Small Business, Car & Motorcycle Club, School & Marching Band, Walking Group, Nonprofit, Corporate Partner, or Political). Completing the wrong form does not entitle Participant to a refund or transfer of fees.

2.4 Organizational Responsibility
By submitting this application, the applying organization ("Organization") represents and warrants that:

A. The Organization has the legal authority to enter into this agreement on behalf of all individuals who will participate in the Parade under the Organization's entry, including employees, members, volunteers, guests, and any minors.

B. The Organization is solely responsible for:

Obtaining all necessary permissions, releases, and waivers from its individual participants, including parental/guardian consent for any minors
Ensuring all participants comply with these Terms and Conditions
Supervising and controlling the conduct of all participants in its group
Ensuring all participants are physically capable of participation
Managing any injuries, incidents, or emergencies involving its participants
Carrying appropriate liability insurance covering its participants and activities
C. The Organization agrees to indemnify and hold harmless the Organizers from any claims brought by the Organization's individual participants, including minors and their parents/guardians.

D. The Organization acknowledges that Organizers have no relationship with, control over, or responsibility for the Organization's individual participants, and that all such relationships and responsibilities rest solely with the applying Organization.

 

3. Parade Entry Definitions
Float: Any motorized vehicle with a total length of eighteen (18) feet or more as measured from the farthest front portion to the farthest back portion, including any trailers or attached decor. The price includes up to 100 pedestrian participants. Limited to a maximum of one (1) per parade entry.

Standard Vehicle: Any motorized vehicle with a total length of less than eighteen (18) feet as measured from the farthest front portion to the farthest back portion, including any trailers or attached decor. The price includes up to 50 pedestrian participants per vehicle. Limited to a maximum of three (3) per parade entry.

Walking Group: A group of five (5) or more individuals participating on foot under a shared theme, purpose, or organization. Walking groups do not utilize motorized vehicles or floats and must maintain an orderly formation throughout the parade. Walking groups may include community organizations, themed participants in coordinated attire, or performers.

Participant Add-on: An additional 50 participants for your entry. No regular parade entry may have a total of more than 200 total pedestrians (maximum varies by application category).

 

4. Insurance and Vehicle Requirements
All drivers must possess a valid Driver's License. All vehicles must carry valid insurance as required by Georgia Law. Participant is responsible for ensuring compliance with all applicable vehicle and insurance requirements.

The Organization represents that it maintains, or will maintain prior to the Parade, adequate liability insurance covering its parade entry and all associated participants. The Organization may be required to provide proof of insurance upon request.

 

5. Critical Safety Rules
5.1 No Items May Be Thrown
IMPORTANT: NOTHING MAY BE THROWN BY PARADE PARTICIPANTS, INCLUDING FROM FLOATS, VEHICLES, OR WALKING GROUPS. Violation of this rule may result in immediate removal from the Parade without refund.

5.2 Prohibited Behaviors
Participants shall not engage in:

Burnouts, excessive revving, or stunt riding (for motorized entries)
Unsafe maneuvers of any kind
Disruptive or dangerous behavior
Any activity that endangers participants, spectators, or staff


6. Conduct and Compliance
Participants agree to:

Follow all instructions provided by Parade organizers, volunteers, and law enforcement
Conduct themselves in a professional and respectful manner
Comply with all applicable federal, state, and local laws and regulations
Respect the safety and enjoyment of other participants and spectators
Maintain control of their vehicles, floats, and pedestrian participants at all times
Adhere to parade guidelines for spacing, safety, and orderly conduct throughout the parade route
Organizers reserve the right to remove any Participant from the Parade at any time for unsafe behavior, failure to comply with these Terms and Conditions, or any other reason deemed appropriate by Organizers, without refund.

 

7. Assumption of Risk and Liability Waiver
7.1 Acknowledgment of Risks
Participant acknowledges and agrees that participation in the Parade involves inherent risks, including but not limited to:

Physical injury, bodily injury, illness, or death
Property damage or loss
Exposure to weather conditions (heat, rain, cold, etc.)
Interaction with crowds, other participants, and vehicles
Slips, trips, and falls
Vehicle accidents or collisions
Any other risks associated with outdoor public events
7.2 Voluntary Assumption of Risk
BY PARTICIPATING, PARTICIPANT VOLUNTARILY ASSUMES ALL SUCH RISKS AND AGREES TO PARTICIPATE AT THEIR OWN RISK.

7.3 Assumption of Risk on Behalf of All Participants
The Organization assumes all risks on behalf of all individuals participating under its entry, including employees, members, volunteers, guests, and minors.

7.4 Scope of Assumption
This assumption of risk applies to risks arising from any cause, including but not limited to:

The negligence of the Organizers or other participants
Dangerous or defective conditions of premises or equipment
Weather conditions
Acts or omissions of other participants or spectators
Failure of Organizers to warn of dangerous conditions
7.5 Health and Physical Condition
The Organization affirms that all individuals participating under its entry:

Are in good physical and mental health
Are physically capable of participating in the Parade
Have no medical conditions that would impair their ability to safely participate
Are not under the influence of alcohol, illegal drugs, or any substances that would impair judgment
Have consulted with a physician if they have any concerns about their ability to participate
The Organization is solely responsible for ensuring the health and fitness of all its participants.

 

8. Comprehensive Release, Waiver, and Indemnification
To the fullest extent permitted by law, Participant, on behalf of itself and its agents, personal representatives, assigns, heirs, next of kin, executors, administrators, estate, and all individuals participating under its entry (collectively, "Releasors"), hereby:

8.1 Waiver of Right to Sue
WAIVES ANY AND ALL RIGHTS to bring any claim, lawsuit, or legal action against the Organizers for any injury, death, property damage, or loss arising from or related to participation in the Parade.

8.2 Release of Liability
RELEASES, WAIVES, and DISCHARGES the Organizers (the 404 Collective and ButterATL, LLC), the City of Atlanta, their officers, directors, employees, agents, volunteers, contractors, representatives, sponsors, vendors, affiliates, subsidiaries, successors, and assigns (collectively, "Released Parties") from ANY AND ALL LIABILITY, CLAIMS, DEMANDS, ACTIONS, AND CAUSES OF ACTION WHATSOEVER, whether in law or equity, arising out of or related to any loss, damage, injury, or death that may be sustained by Participant, any of Participant's individual participants, or any property belonging to Participant or its participants, WHETHER CAUSED BY THE NEGLIGENCE, FAULT, OR CONDUCT OF THE RELEASED PARTIES OR OTHERWISE, EXCEPT for claims arising from the Released Parties' gross negligence or willful misconduct.

8.3 Indemnification
AGREES TO INDEMNIFY, DEFEND, AND HOLD HARMLESS the Released Parties from and against any and all claims, demands, losses, liabilities, damages, costs, and expenses (including reasonable attorneys' fees and court costs) arising from:

Participant's acts or omissions during the Parade
Participant's violation of these Terms and Conditions
Participant's violation of any applicable laws or regulations
Any injury to third parties or damage to third-party property caused by Participant or any of its individual participants
Any claims brought by the Organization's individual participants, members, employees, volunteers, contractors, or guests, including claims by or on behalf of minors
Any failure by the Organization to obtain proper releases, waivers, or parental consents from its individual participants
Any claims brought by Participant's guests, employees, representatives, or participants
8.4 Third-Party Claims
Participant agrees to indemnify and hold harmless the Released Parties from any claims brought by third parties (including spectators, other participants, property owners, or members of the public) arising from Participant's actions or participation in the Parade, or the actions of any individuals participating under Participant's entry.

8.5 Property Damage
Participant assumes full responsibility for any damage to public or private property caused by Participant, their vehicles, floats, or any individuals participating under their entry, and agrees to reimburse all costs associated with repair or replacement of damaged property.

8.6 Scope of Release
This release applies to:

Personal injury, bodily injury, illness, or death
Property damage or loss
Economic losses
Emotional distress or psychological injury
Any and all other losses or damages of any kind
This release is intended to be as broad and inclusive as permitted by law, and includes claims that are presently unknown or unsuspected, and claims arising in the future.

8.7 Survival
The provisions of this Section 8 shall survive the termination of these Terms and Conditions and the conclusion of the Parade.

 

9. Photography, Video, and Media Rights
Participant grants Organizers and their designees the irrevocable, perpetual, worldwide, royalty-free right and license to use, reproduce, modify, distribute, display, and create derivative works from photographs, videos, audio recordings, and other media (collectively, "Media") captured during the Parade, including Media featuring Participant's name, image, likeness, voice, performance, and any signage, logos, or branding associated with Participant and any of its individual participants, for any purpose, including but not limited to promotional, marketing, advertising, commercial, and archival purposes, in any medium now known or hereafter developed, without further compensation, notice, or approval. Participant waives any right to inspect or approve the finished Media or any use thereof.

Participant represents that it has obtained all necessary permissions and releases from its individual participants for such Media use.

 

10. Cancellation and Changes
Organizers reserve the right to cancel, postpone, or modify the Parade route, schedule, or format at any time due to weather, safety concerns, permitting issues, or any other reason. In the event of cancellation, Organizers will make reasonable efforts to notify Participants, but Organizers are not liable for any costs, expenses, or damages incurred by Participant.

Application fees and entry fees are nonrefundable regardless of cancellation, modification, or Participant's inability to attend.

10A. Force Majeure
Organizers shall not be liable for any failure or delay in performance of the Parade due to causes beyond their reasonable control, including but not limited to: acts of God, weather conditions, natural disasters, public health emergencies, epidemics or pandemics, acts of war or terrorism, civil unrest, strikes, labor disputes, governmental actions or restrictions, or any other circumstances beyond the Organizers' reasonable control. In such events, Organizers may cancel, postpone, or modify the Parade without liability, and no refunds will be provided.

 

11. Limitation of Liability
To the maximum extent permitted by law, Organizers shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising out of or related to Participant's involvement in the Parade, even if Organizers have been advised of the possibility of such damages.

THE TOTAL LIABILITY OF ORGANIZERS FOR ANY CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS AND CONDITIONS OR THE PARADE SHALL NOT EXCEED THE AMOUNT OF THE APPLICATION FEE PAID BY PARTICIPANT.

 

12. Participant Categories and Eligibility
Participant understands that different application forms exist for different categories of participants, and Participant has selected the appropriate form based on their organization type:

Small Business: Annual gross revenue of less than $1 million for the most recent fiscal year and employs fewer than twenty (20) full-time employees
Car & Motorcycle Clubs: Four (4) or more vehicles representing a recognized club, organization, or collective
Schools & Marching Bands: Five (5) or more individuals representing a school, marching band, or performance group
Walking Groups: Five (5) or more individuals participating on foot under a shared theme, purpose, or organization
Nonprofit Organizations: Registered as a nonprofit under relevant local, state, or federal laws, operating with a primary mission to benefit the public or a specific community
Corporate Partners: Annual gross revenue of over $1 million for the most recent fiscal year or employs twenty (20) or more full-time employees
Political Groups: Politicians, political groups, and campaigns either currently serving in or seeking elected office


13. Minors
13.1 Organizational Responsibility for Minors
If any individuals participating under the Organization's entry are under 18 years of age, the Organization represents and warrants that:

A parent or legal guardian of each minor has provided written consent for the minor's participation
The Organization has obtained appropriate liability waivers and releases signed by each minor's parent or legal guardian
The Organization assumes all responsibility for the supervision, safety, and conduct of all minors in its group
13.2 Indemnification for Minor-Related Claims
The Organization agrees to indemnify and hold harmless the Released Parties from any and all claims brought by or on behalf of minors participating under the Organization's entry, or by their parents, guardians, heirs, or legal representatives.

 

14. Alcohol and Substance Use
Participant agrees that no individual participating under its entry will participate in the Parade while under the influence of alcohol, illegal drugs, or any substance that impairs judgment or physical ability. Organizers reserve the right to remove any Participant whose members appear to be intoxicated or impaired, without refund. The Organization acknowledges that consumption of alcohol before or during the Parade by any of its participants is at the Organization's own risk, and the Organization assumes all liability for any alcohol-related incidents involving its participants.

 

15. Severability
If any provision of these Terms and Conditions is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be replaced with a valid and enforceable provision that most closely reflects the intent of the original provision.

 

16. Governing Law
These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of Georgia, without regard to its conflict of law provisions. Any disputes arising under these Terms and Conditions shall be resolved in the courts of Fulton County, Georgia.

 

17. Dispute Resolution
17.1 Mandatory Arbitration
Any dispute, claim, or controversy arising out of or relating to these Terms and Conditions or the Parade shall be resolved through binding arbitration in accordance with the Commercial Arbitration Rules of the American Arbitration Association. The arbitration shall be conducted in Atlanta, Georgia. The decision of the arbitrator shall be final and binding upon the parties.

17.2 Class Action Waiver
PARTICIPANT AGREES THAT ANY ARBITRATION OR LEGAL PROCEEDING SHALL BE CONDUCTED IN PARTICIPANT'S INDIVIDUAL CAPACITY AND NOT AS A CLASS ACTION OR OTHER REPRESENTATIVE ACTION. PARTICIPANT EXPRESSLY WAIVES ANY RIGHT TO FILE A CLASS ACTION OR SEEK RELIEF ON A CLASS BASIS.

17.3 Waiver of Jury Trial
TO THE FULLEST EXTENT PERMITTED BY LAW, PARTICIPANT WAIVES ANY RIGHT TO A TRIAL BY JURY.

17.4 Costs and Fees
Each party shall bear its own costs and attorneys' fees in any dispute, except that the prevailing party in any arbitration or litigation may be awarded reasonable attorneys' fees and costs at the discretion of the arbitrator or court.

 

18. Organizational vs. Individual Participation
18.1 Nature of Agreement
This agreement is between the Organizers and the applying Organization. The Organization is the Participant under this agreement, not individual members or participants of the Organization.

18.2 Individual Participant Waivers
The Organization is solely responsible for obtaining appropriate liability waivers, releases, and consents from all individuals participating under its entry, including:

Adult participants
Minor participants (requiring parental/guardian consent)
Volunteers
Employees
Guests
Any other individuals associated with the Organization's parade entry
18.3 No Direct Relationship
Organizers have no direct contractual relationship with the Organization's individual participants. All rights, responsibilities, and liabilities between the Organization and its individual participants are solely the Organization's responsibility.

18.4 Organization's Insurance
The Organization represents that it maintains, or will maintain prior to the Parade, adequate liability insurance covering its parade entry and all associated participants. The Organization may be required to provide proof of insurance upon request.

 

19. Explicit Acknowledgment and Voluntary Agreement
BY SUBMITTING THIS APPLICATION AND PARTICIPATING IN THE PARADE, THE ORGANIZATION EXPLICITLY ACKNOWLEDGES AND AGREES THAT:

A. The Organization has carefully read this entire agreement and fully understands its contents.

B. The Organization is voluntarily agreeing to these Terms and Conditions.

C. The Organization understands this is a release of liability and a contract that affects the Organization's legal rights and the rights of all individuals participating under its entry.

D. The Organization is aware it is giving up substantial legal rights, including the right to sue.

E. The Organization signs freely and voluntarily without any inducement, assurance, or guarantee.

F. No oral representations, statements, or inducements have been made apart from what is contained in this written agreement.

G. This agreement is intended to be as broad and inclusive as permitted by Georgia law.

H. If any portion of this agreement is found to be void or unenforceable, the remaining portions shall remain in full force and effect.

I. The Organization has the legal authority to bind all individuals participating under its entry to these Terms and Conditions.

J. The Organization will obtain all necessary individual waivers and consents from its participants.

K. The Organization assumes all responsibility for its participants' actions, safety, and well-being.

L. The Organization will ensure all participants comply with parade rules and regulations.

THE ORGANIZATION UNDERSTANDS THAT THIS IS A LEGALLY BINDING DOCUMENT AND HAS HAD THE OPPORTUNITY TO SEEK LEGAL COUNSEL BEFORE SIGNING.

 

20. Acknowledgment
By submitting an application and participating in the 404 Day 2026 Parade, the Organization (not individual participants) acknowledges that it:

Has read, understood, and agrees to be bound by these Terms and Conditions
Has the legal authority to bind all individuals participating under its entry
Will obtain all necessary individual waivers and consents
Assumes all responsibility for its participants' actions and safety
Will ensure all participants comply with parade rules and regulations


21. Entire Agreement
These Terms and Conditions constitute the entire agreement between the Organization and the Organizers concerning the subject matter hereof and supersede all prior or contemporaneous agreements, understandings, negotiations, and discussions, whether oral or written, between the parties.

 

22. Amendment
Organizers reserve the right to modify these Terms and Conditions at any time. Any modifications will be posted on the Parade website or communicated to applicants via email. Continued participation in the Parade following notification of changes constitutes acceptance of the modified Terms and Conditions.

 

23. Waiver
No waiver by Organizers of any breach or default hereunder shall be deemed to be a waiver of any preceding or subsequent breach or default.
