By applying, participating, attending, or vending at the Dia De Los Muertos Festival, you agree to the following terms and conditions. These terms are legally binding and intended to ensure a safe, fair, and enjoyable event for all parties involved.
1. Liability and Hold Harmless AgreementGoin’ Social Events, Luna Del Rio, and The Mill on Etowah shall not be held liable or responsible for any personal injury, theft, loss, damage, accident, delay, or disruption, whether direct or indirect, caused to any person or property during the event.
Participants, vendors, performers, and attendees assume full responsibility for their participation and agree to release, waive, and hold harmless Goin’ Social Events, Luna Del Rio, The Mill on Etowah, and their affiliates, partners, staff, contractors, and volunteers from any and all claims, liabilities, demands, or damages resulting from participation in the event.
2. No Guarantee of Profit or ExposureParticipation as a vendor, performer, or sponsor does not guarantee a return on investment, sales, exposure, or foot traffic. All participants are responsible for their own setup, promotion, and engagement. Goin’ Social Events makes no financial promises or commitments beyond the scope of event access and designated vendor space.
3. Refund and Cancellation PolicyThis event is a no refund event. Fees paid for vendor spaces, sponsorships, or other participation are non-refundable and non-transferable under any circumstance, including but not limited to:
4. Rain or Shine PolicyThe Dia De Los Muertos Festival is a rain or shine event. The festival will proceed regardless of weather conditions, unless conditions are deemed unsafe by local authorities or event management. No refunds or credits will be issued due to inclement weather.
Vendors and attendees are responsible for preparing appropriately, including bringing tent weights, covers, and weather-resistant materials.
5. Event Regulations & On-Site ConductAll participants and attendees agree to follow all posted signage, onsite staff instructions, and local, state, and federal laws. This includes but is not limited to:
Failure to comply may result in immediate removal from the event and forfeiture of any participation fees.
6. Vendor & Booth GuidelinesVendors must stay within their assigned booth space.
No open flames are allowed.
Propane tanks must be pre-approved and properly secured.
Booths must be staffed and operational for the full duration of the event.
Vendors must remove all trash and items at the conclusion of the event.
Only pre-approved vendors may sell food, merchandise, or services on site.
Vendor Parking: After unloading, vendors are required to park in designated areas furthest from the event footprint, preferably in the dirt lot, to allow attendees better access to prime parking.
7. Smoking PolicySmoking is strictly prohibited on the main event grounds. Smoking is only permitted in the designated parking lot areas. Violators may be asked to leave the premises.
8. Photography and Media ReleaseBy attending or participating in the event, you consent to be photographed or recorded for promotional and archival purposes. Goin’ Social Events, Luna Del Rio, and The Mill on Etowah reserve the right to use any images, video, or audio recordings from the event in marketing, advertising, social media, and other platforms without compensation.
9. Enforcement and Right to RefuseEvent organizers reserve the right to:
Refuse entry to any individual, vendor, or entity
Remove any person for violation of these terms
Shut down any booth or display deemed unsafe or inappropriate
Make changes to the event schedule, layout, or logistics as needed
AcknowledgementYour participation in this event signifies that you have read, understood, and agreed to abide by the Terms & Conditions listed above. These rules are in place to protect the safety, fairness, and integrity of the event.
