Terms and Conditions for Vendors – Taste of the Fourth

By completing the vendor application and/or participating in the Taste of the Fourth (the "Event"), you (the "Vendor") agree to be bound by the following Terms and Conditions.
1. Event Details & Participation a. Event Name: Taste of the Fourth b. Event Date(s): October 9, 2025 c. Event Location: Studioplex, 659 Auburn Ave NE, Atlanta, GA 30312. d. Event Hours (for public): 6:00 pm to 9:00 pm EST e. Vendor Set-up Hours: 4:00 - 6:00 pm EST f. Vendor Breakdown Hours: 9:00 pm EST g. Vendor Application & Acceptance: Submission of an application does not guarantee acceptance. Old Fourth Ward Neighborhood Association ("Organizer") reserves the right to select vendors based on various factors, including but not limited to, product variety, quality, and alignment with the Event's theme. h. Assigned Space: Vendor will be assigned a designated space at the Event. The Organizer reserves the right to change vendor locations at its sole discretion. Vendors are responsible for their own tent, tables, chairs, and all other equipment necessary for their operation unless otherwise specified in writing.
2. Fees & Payment a. Vendor Fee: Not applicable.
3. Vendor Responsibilities & Conduct a. Setup & Breakdown: Vendors must adhere strictly to the designated set-up and breakdown times. All vendor materials and waste must be removed from the site by the end of breakdown hours. Any materials left behind will be disposed of at the Vendor’s expense. b. Appearance & Presentation: Vendor booths must be clean, professional, and well-maintained throughout the Event. c. Staffing: Vendor must adequately staff their booth to handle anticipated crowds and provide excellent customer service. All staff must be professional and courteous. d. Waste Management: Vendor is responsible for the proper disposal of all their waste, including food waste, packaging, and recycling, in designated receptacles. No grease or liquid waste should be poured down drains or onto the ground. e. Noise Levels: Amplified music or excessive noise from vendor booths is prohibited unless explicitly approved by the Organizer. f. Security: Vendor is responsible for the security of their own merchandise, equipment, and cash. The Organizer is not responsible for any loss, theft, or damage to vendor property. g. Compliance with Laws: Vendor must comply with all federal, state, and local laws, ordinances, and regulations.
5. Marketing & Promotion a. Use of Vendor Name/Logo: By participating, Vendor grants the Organizer permission to use the Vendor's name, logo, and images of their products/booth for promotional purposes related to the Event. b. Promotional Materials: Vendors are encouraged to promote their participation in the Event.
6. Miscellaneous a. Breach of Terms: Any breach of these Terms and Conditions by the Vendor may result in immediate expulsion from the Event without refund and may jeopardize future participation in Organizer's events. b. Amendments: The Organizer reserves the right to amend these Terms and Conditions at any time. Vendors will be notified of any significant changes. c. Governing Law: These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of [Your State], without regard to its conflict of laws principles. d. Dispute Resolution: Any dispute arising out of or relating to these Terms and Conditions shall be resolved through [Specify preferred method, e.g., informal negotiation, mediation, or binding arbitration in accordance with the rules of [Arbitration Body] located in [City, State]]. e. Entire Agreement: These Terms and Conditions constitute the entire agreement between the Vendor and the Organizer regarding the Event and supersede all prior or contemporaneous communications, understandings, and agreements, whether oral or written.
By proceeding with your application or participation, you acknowledge that you have read, understood, and agree to these Terms and Conditions.
