Kimmswick Merchant Application

FOR CITY OF KIMMSWICK MERCHANTS ONLY

Kimmswick merchants are persons who have a brick and mortar within our city limits and hold an annual business license within the City of Kimmswick

PLEASE READ THIS APPLICATION VERY CAREFULLY BEFORE APPLYING TO BE A MERCHANT VENDOR AT THIS EVENT. 

DEADLINE TO APPLY IS April 27th 2026

Thank you for your interest in becoming a Kimmswick Merchant Vendor in the Kimmswick Strawberry Festival.  Each Kimmswick Merchant Vendor spaces: 10 feet X 10 feet for $145.   

All Kimmswick festival merchant vendor spaces require payment through Eventeny. No checks or cash will be accepted for merchant vendor spaces at City of Kimmswick festivals.  

No merchant vendor spaces will be secured as complimentary by any business or nonprofit organization that engages in the sale of goods, products or services at City of Kimmswick festivals.  

No partial or half merchant vendor spaces will be made available or sold at City of Kimmswick festivals.   

No merchant vendor spaces will be utilized to promote other vendors businesses that rent space within the merchant's business. The space provided at this price is for KIMMSWICK MERCHANTS ONLY WHO HAVE A VALID KIMMSWICK BUSINESS LICENSE. 

Businesses displaying products within your business location must have a separate business license to sell on the public streets within Kimmswick City Limits. This is to ensure that each business is properly regulated and accountable for its own activities. Businesses not properly licensed with the City of Kimmswick will be removed from the event and will be denied for any future events until re-approval by the Board of Alderman.

No merchant vendors are permitted to conduct private property space- leasing/donating space to vendors. No temporary business licenses will be issued by the City of Kimmswick to private property space-leased vendors. Violators will be required to shut down all operations and will be denied for any future events until re-approval is made by the Board of Alderman.

BOOTH ASSIGNMENTS

Booths available to merchants are highlighted in purple on the map. Merchants are only able to purchase the booths highlighted in purple in front of their businesses. 

SETUP

Please be certain to set up in your assigned rented space(s). If you do not set up in your assigned rented space(s) a city/event official will attempt to reach you to move your items immediately. If necessary, the contents/products of your space/booth will be moved to the correct space. The city/event official will not be responsible for any damage done during the transfer/storage of items.

GENERAL RULES and REGULATIONS

The rules and regulations set by the City of Kimmswick and the Kimmswick Events Committee are binding for Kimmswick Merchant Vendors renting space(s) for the Kimmswick Strawberry Festival.  

This application is an electronic agreement. By submitting it, you affirm you have read these terms and conditions and agree to them.  

The City of Kimmswick and the City of Kimmswick Events Committee reserve the right to accept or refuse any festival space rental application, in their sole and absolute discretion

 The Event Committee Has the right to refuse all vendors at any time before or during the Festival and request that they leave the premises.

We reserve the right to determine vendor location. This determination will be based on the size and space available as well as the type of craft, product, or attraction.

At the festival (event) committee discretion, vendor location may be moved, prior to set up, for any reason.

DISCRIMINATION & HARRASSMENT POLICY

· The City of Kimmswick and the Kimmswick Event Committee desires to provide a positive and productive business and entertainment environment. To that end, the festival is committed to providing a business and entertainment environment that is free of discrimination and harassment, and to provide a means of dealing with such incidents should they occur.

 · Harassment or discrimination, in any form, will not be tolerated at the festival 

 · The festival will not condone retaliation against any individual who reports possible harassment or discrimination or assists in an investigation of possible harassment or discrimination.

 ·The festival has the discretion to apply any sanctions or a combination of sanctions to eliminate any unlawful conduct and remedy the impact of any harassment or discrimination.

By submitting this application, I affirm that I am a City of Kimmswick Merchant with a physical store/business within the city limits of Kimmswick.  I affirm that I possess a current valid business license and I owe no delinquent licensing or late fees issued by, and payable to, the City of Kimmswick. I affirm that my business is properly registered and current with the Missouri Secretary of State. I affirm that I owe no tax due under sections 144.010 to 144.510 or sections 143.191 to 143.261 with the Department of Revenue. I understand that being delinquent in these areas, or not being properly registered with the Secretary of State makes my business illegitimate and am not able to conduct business with the City of Kimmswick. I understand that if I am found to be registering as a merchant for the Strawberry Festival while knowingly delinquent or not properly registered, my application will be denied for the current and any future Events/Festivals until re-approval is made by the Board of Alderman.

No merchant storefront or business-adjacent festival spaces within the City of Kimmswick may be rented for the Strawberry Festival to any unlicensed Kimmswick merchant business/organization.  

No merchant is allowed to rent or "donate" their booth spaces to profit or non-profit business/organizations. No merchant is allowed to "share" their booth space with an unlicensed profit or non-profit business/organization. Discovery of doing so, will result in booth not participating in remainder of festival and future events/festival until re-approved by the Board of Alderman.

I hereby release the City of Kimmswick, Missouri, and its agents, employees, private property owners, the Events Committee, and its individual members from responsibility for any damage to the arts/crafts/food or products displayed/sold and my personal possessions as well as for any personal injury to myself or others.  I am also responsible for any injury that occurs to my booth/tent. I also agree to indemnify and hold harmless said organizations and individuals for any damage or injury which may result from the sale or display of my products. The City of Kimmswick and the City of Kimmswick Events Committee reserve the right to accept or refuse any space rental application, in their sole and absolute discretion.

By completing this application, you acknowledge and confirm your understanding that no refunds will be issued after May 1st.
