Cool Spring Downtown District, its volunteers, the City of Fayetteville, or its representatives, and/or employees are not responsible for any damages arising out of the sales of my products or from my presence during 4th Friday. Vendors agree to sell only those items approved by the Cool Spring Downtown District as noted.
Vendor Age Requirements: Children under the age of 18 participating in the 4th Friday should be always supervised by an adult onsite.
Attendance: If you miss more than 2, 4th Friday events without notice, you will no longer be able to participate in our 4th Friday events. If you cannot make the 4th Friday event, please let me know as soon as possible.
Inclement Weather: 4th Friday is a rain-or-shine event. If the event is not canceled by Cool Spring Downtown District, an absence will be counted against you. Every effort will be made by the Cool Spring Downtown District staff to host the 4th Friday event. The Cool Spring Downtown District staff will closely monitor weather conditions before and during events.
Amplified Sound Electricity: We will not provide electricity. You are required to use your own amplification system for your space.
Assigned Locations: Cool Spring Downtown District (CSDD) may, from time to time, be required to reassign locations. CSDD does not provide tables or other equipment. Please contact the CSDD office in writing (info@coolspringfay.org) if you have any special requirements.
PRODUCTS / SERVICES
Vendors are required to submit product photos and/or services with this application. List must be attached as a .doc, .jpeg, or .pdf files. The Cool Spring Downtown District reserves the right to deny vendors, the sale of certain products and/or merchandise. Applications must include a photograph clearly showing the entire booth setup or photos of products.
First Amendment: Please understand that the organizer of the 4th Fridays event in downtown Fayetteville is Cool Spring Downtown District, a private, 501(c)(3) nonprofit corporation, and not the City of Fayetteville or any other state actor. As such, we are incapable of infringing upon any of your First Amendment rights, and the § 1983 case you reference below is inapposite. We certainly honor and respect all political and religious affiliations, but, as a community non-profit organization dedicated to supporting artistic, cultural, civic, and commercial activity in downtown Fayetteville, we have determined, and it is entirely within our purview to do so, that, in order to remain a place that is welcoming to all, we must remain neutral on political and religious matters. For us, that means no partisan political or religious groups will be approved to table at our events. This is a policy applied equally to all political and religious groups. Our purpose for having these booths, like the purpose of the 4th Friday event in general, is to promote downtown Fayetteville’s dynamic arts and entertainment district while supporting local independent galleries, bistros, artisans, shops, and the like. It is a secular event designed to foster civic pride and awareness, not to provide an advocacy forum for those who wish to put their message, whether political, religious, ideological, or otherwise, before the public. These issues, as important as they may be, simply are not consistent with the purpose of 4th Fridays. For these reasons, our table/booth spaces, which are in high demand, are reserved for vendors from sectors such as the arts, entertainment, food, etc. that align with the nature of the event.
