Cafe Deals Application

This application is for our fast casual dining establishments offering a cafe deal, including smoothies, snacks, combos, lunch or drink specials. Suggested for deals under $10.  APPLICATION FEE:For the cafe deals application, we require a $50 gift card. Gift cards are due in the DDA offices at 350 SE 1st Street, Delray Beach, FL by AUGUST 1st. DEADLINES:

Menu and Gift Card Deadline: Tuesday, August 1, 2023 GENERAL RULES and REGULATIONS: Must be a Downtown Delray Beach food establishment, within the DDA/Downtown district. *The DDA reserves the right to refuse any establishment.*  DDA OVERVIEW: The DDA is a special taxing authority, governing over the downtown within the City of Delray Beach. The Downtown Delray Beach Restaurant Month highlights our diverse dining destination. We ask our dining establishments to offer a deal, prix fixe menu or culinary event during the month of September 2023 and the Downtown Development Authority spends our time and resources marketing the event to drive traffic to your business during a slower month. By completing this application, artist/vendor acknowledges that they have read and understand the information provided and requirements for participation and agree to the terms herein. INDEMNIFICATION AND HOLD HARMELESS AGREEMENT
By completing this application, Exhibitor shall indemnify, defend and save harmless to the extent of its insurance coverage, the Downtown Development Authority (DDA) and its member entities which consist of the City of Delray Beach (CITY); Business agrees to defend, indemnify and save harmless the Indemnitees, their officers, agents and employees, against any liability arising from or based upon the violation of any federal, state, county or city laws, by-laws, ordinances or regulations, including but not limited Trademark and Copyright Laws by the Contractor, his subcontractors, agents, servants or employees. Business further agrees to defend, indemnify and save harmless the Indemnitees, their officers, agents, or employees from all such claims, fees, and from any and all suits and actions for every name and description that may be brought against the Indemnitees or their officers, agents or employees on account of any claims, fees, royalties, or costs for any invention or patent, and from any and all suits and actions that may be brought against the Indemnitees, their officers, agents or employees for the infringement of any and all patents or patent rights claimed by any person, firm, or corporation.
The indemnification provided above shall obligate the Business to defend, at his/her own expense or to provide for such defense, at the Indemnitees' option, any and all claims or liability and all suits and actions of every name and description that may be brought against the Indemnitees, their officers, agents, or employees which may result from the operations and activities under this Contract whether the work be performed by the Business, his/her subcontractor or by anyone directly or indirectly employed by either. This Indemnification and Hold Harmless Agreement include all costs and fees including attorney's fees and costs at trial and appellate levels.
