Assumption of Risk I understand that by participating in the Magical Midwinter Market (the “Event”), I may be exposed to various risks, including but not limited to: • physical activities (walking, standing, climbing stairs, uneven surfaces, crowds, slipping or tripping hazards) • use of interactive exhibits, lighting effects, sound, exhibits with moving parts • exposure to weather or environmental conditions (if outdoors) • possible health risks including fatigue, allergies, sensory overload, etc. I represent that I am in good physical and mental health, free of any conditions that might prevent my safe participation. I am not under the influence of alcohol, drugs, or any other substances that could impair my participation. ⸻ Release of Liability, Waiver, and Indemnification In consideration of being permitted to attend and participate in the Event, I, on behalf of myself, my heirs, executors, administrators, and assigns, do hereby release, waive, discharge, and covenant not to sue the organizers, promoters, sponsors, vendors, volunteers, employees, agents, and their respective officers and successors (collectively “Organizers”) from any and all liability, claims, demands, causes of action, losses or damages arising out of or in any way connected with my participation in the Event or my presence at the Event premises, whether caused by the negligence of the Organizers or otherwise, to the fullest extent permitted by law. I agree to indemnify and hold harmless the Organizers from any loss, liability, damage, or costs, including court costs and attorneys’ fees, incurred due to my participation in the Event or my breach of this agreement. ⸻ Medical Treatment I consent to receive medical treatment which may be deemed advisable in the event of injury, accident, or illness during my participation in the Event. I understand that I am financially responsible for any medical expenses incurred. ⸻ Photo / Video / Media Release I hereby grant to the Organizers full right and permission to photograph, video, audio-record, or otherwise capture my likeness, image, voice, and/or performance (“Likeness”) during the Event. I authorize the Organizers and their agents, successors, assigns, licensees, and those acting with permission, to use, reproduce, distribute, publish, broadcast, or otherwise exploit my Likeness in all media now known or hereafter devised, for any lawful purpose, including but not limited to advertising, promotion, publicity, social media, and marketing, in perpetuity, without compensation to me. I waive any right that I may have to inspect or approve the finished product in which my Likeness appears. I also waive any claim to royalties, proceeds or other benefits derived from such use. ⸻ Minors If the participant is under 18 years of age, a parent or legal guardian must sign, acknowledging that they have read this waiver and consent to all of its terms. Minors must be accompanied at all times by a parent or guardian. ⸻ Acknowledgment of Understanding & Binding Effect I have carefully read this document, and I fully understand its contents. I am aware that by signing this, I am giving up certain legal rights. I sign this freely and voluntarily, without any inducement or duress.
