Vendor Terms & Conditions
The 2026 Midway Bourbon & Blues Festival is produced by the Midway Business Association (MBA) and will take place on Saturday, June 13, 2026, on Main Street in Midway, Kentucky.
By submitting an application, all vendors agree to the following Terms & Conditions:
1. Application Review & Acceptance
Submission of an application does not guarantee acceptance. The Midway Business Association reserves the sole right to accept or deny any application for any reason, including but not limited to space limitations, product mix, community standards, or overall event fit. All decisions by the MBA are final.
2. Application Fee
The application fee is fully non-refundable from the moment the application is submitted, regardless of acceptance status, withdrawal, or cancellation by the applicant.
3. Event Schedule & Setup
Event Date: Saturday, June 13, 2026
Location: Main Street, Midway, Kentucky
Vendor setup begins late Friday night prior to the event and continues through 11:00 AM on Saturday morning. Exact setup times, load-in instructions, and vehicle access details will be provided to accepted vendors closer to the event date.
All vendors must be fully set up and ready for business by the designated opening time on Saturday.
4. Vendor Fees & Refund Policy
All vendor booth fees are non-refundable after May 13, 2026.
No refunds shall be issued for any reason after this date, including but not limited to vendor cancellation, illness, travel issues, weather, emergencies, or failure to comply with event requirements.
If the event is postponed, delayed, or canceled due to circumstances beyond the control of the MBA—including but not limited to weather, acts of God, government restrictions, or safety concerns—vendor fees will not be refunded.
5. Weather & Force Majeure
The Midway Bourbon & Blues Festival is a rain or shine event. Vendors acknowledge and accept all risks associated with outdoor events. The MBA is not responsible for losses due to weather conditions, power outages, or other uncontrollable circumstances.
6. Booth Operations & Conduct
Vendors must operate only within their assigned space.
Booth sharing, subleasing, or transferring space without written approval from the MBA is prohibited.
Vendors must maintain a clean, professional, and safe booth area at all times.
Vendors may sell only those items listed and approved in their application.
The MBA reserves the right to require immediate removal of any vendor whose conduct, products, or operations are deemed unsafe, inappropriate, or inconsistent with event standards. No refunds will be issued in such cases.
7. Licenses, Permits & Compliance
Vendors are solely responsible for obtaining and complying with all required local, state, and federal licenses, permits, and tax obligations, including Kentucky sales tax requirements where applicable.
Food and beverage vendors must comply with all applicable health department regulations and inspection requirements.
8. Insurance Requirements
All vendors are responsible for maintaining appropriate insurance coverage for their operations.
Food Vendors:
All food vendors are required to carry general liability insurance with a minimum coverage of $1,000,000 (one million dollars).
The policy must list the Midway Business Association (MBA) as an additional insured.
Proof of insurance must be submitted by the deadline provided by the MBA and prior to participation in the event. Failure to provide valid proof of insurance will result in removal from the event without refund.
The MBA reserves the right to request proof of insurance from any vendor category.
9. Liability & Indemnification
Vendors participate in the event at their own risk. The Midway Business Association, the City of Midway, event staff, volunteers, sponsors, and property owners shall not be held liable for injury, loss, theft, or damage to persons or property.
Vendors agree to indemnify, defend, and hold harmless the Midway Business Association and all associated parties from any claims, damages, or expenses arising from the vendor’s participation in the event.
10. Event Changes
The Midway Business Association reserves the right to adjust the event layout, vendor placement, schedule, or event details as necessary for safety, logistics, or overall event success.
11. Agreement
Submission of an application constitutes agreement to all Terms & Conditions outlined above. Vendors acknowledge that they have read, understand, and agree to comply with these requirements.
