Terms & Conditions

SPONSORSHIP TERMS & CONDITIONS

1. Sponsorship Agreement
By submitting a sponsorship application and payment, the sponsor (“Sponsor”) acknowledges that it has read, understood, and agrees to the following Terms and Conditions established by Goin’ Social Events (“GSE”).

Sponsorship is not considered confirmed until the completed application has been accepted and payment has been received in full.

2. Sponsorship Benefits
GSE will provide the sponsorship benefits associated with the Sponsor’s selected sponsorship package, as outlined in the applicable sponsorship materials.

GSE will make reasonable efforts to fulfill all stated benefits. However, specific benefits may be modified, relocated, rescheduled, substituted, or otherwise adjusted due to weather, safety concerns, venue requirements, operational considerations, scheduling conflicts, or circumstances beyond GSE’s reasonable control. Any material changes affecting sponsorship benefits will be communicated to the Sponsor when reasonably practicable.

3. Payment Terms
All sponsorship fees are due in full at the time of submission unless otherwise agreed to in writing by GSE.

Payments may be made by credit/debit card or electronic invoice through the payment methods provided by GSE.

Failure to submit payment by the applicable deadline may result in the cancellation of the sponsorship reservation and forfeiture of associated sponsorship benefits.

4. Cancellation & No-Refund Policy
All sponsorship fees are non-refundable and non-transferable, except where otherwise required by applicable law or expressly agreed to in writing by GSE.

Sponsors who wish to cancel their participation must notify GSE in writing. Cancellation does not create an entitlement to a refund, credit, transfer, or other compensation. If the event is postponed due to weather, safety concerns, government action, venue requirements, or other circumstances beyond GSE’s reasonable control, GSE may transfer the Sponsor’s benefits to the rescheduled event or, at GSE’s discretion, provide substantially similar benefits at an alternative event.

5. Marketing Materials & Deadlines
Sponsors are responsible for providing all required logos, artwork, promotional materials, company information, signage requirements, and other requested materials by the deadlines established by GSE. Failure to provide materials by the applicable deadline may result in the Sponsor being omitted from printed, digital, social media, LED screen, signage, or other promotional materials. Such omission will not entitle the Sponsor to a refund, credit, or other compensation.

Sponsors are responsible for ensuring that all submitted materials are accurate and that they have the necessary rights and permissions to use any logos, images, trademarks, or other content provided to GSE.

6. Vendor Booths — If Applicable
Sponsors receiving vendor booth space as part of their sponsorship package are responsible for providing all equipment and supplies necessary for their booth unless otherwise stated in writing.

This includes, but is not limited to:

Tent
Tables
Chairs
Displays
Lighting
Promotional materials
Inventory and supplies
Booth staffing

Each booth must remain within the assigned space and may not obstruct walkways, entrances, neighboring spaces, emergency access, or other event areas.

Sponsors are responsible for complying with all applicable health, safety, fire, and other regulations related to their booth and activities.

Electricity is not provided unless specifically arranged and confirmed in advance by GSE.

7. Brand Representation & Content
Sponsor logos, promotional materials, products, services, and other brand representations must be appropriate for the family-friendly and culturally respectful nature of the Día de los Muertos Festival.

GSE reserves the right to reject or remove any promotional material, product, display, messaging, or activity that GSE reasonably determines to be inappropriate, offensive, unsafe, discriminatory, unlawful, or inconsistent with the event’s purpose or standards.

8. Assumption of Risk & Liability
Sponsor acknowledges that participation in the event involves inherent risks associated with attending, exhibiting, operating equipment, interacting with attendees, and participating in an outdoor or public event. To the extent permitted by applicable law, Sponsor agrees to release and hold harmless GSE, The Mill on Etowah, their respective owners, officers, employees, agents, volunteers, contractors, and affiliates from claims arising from Sponsor’s participation in the event, except to the extent caused by conduct for which such a release is prohibited by applicable law. Sponsors are responsible for securing any insurance coverage appropriate for their business, products, employees, equipment, and activities. GSE may require proof of insurance for certain sponsorship activities or booth operations.

9. Event Modifications
GSE reserves the right to modify the event’s layout, schedule, programming, entertainment, activities, vendor placement, operating hours, or other event details when reasonably necessary for safety, weather, venue requirements, operational considerations, or other circumstances.

GSE will make reasonable efforts to communicate material changes affecting Sponsors as soon as practicable. Changes to event programming, layout, schedule, entertainment, or other event details do not automatically entitle a Sponsor to a refund or other compensation.

10. Sponsor Conduct
Sponsors, their employees, representatives, contractors, and guests are expected to conduct themselves professionally and comply with all event rules, venue policies, applicable laws, and reasonable instructions from GSE and venue personnel.

GSE reserves the right to remove a Sponsor or its representatives from the event for unsafe, disruptive, unlawful, or inappropriate conduct. Removal does not entitle the Sponsor to a refund.
