2023 Volunteer Waiver
INDEMNIFICATION:
The Parties herein agree to indemnify and hold each other harmless, along with our respective officers, directors, agents, members, and employees, from and against any and all claims, demands, obligations, causes of action and lawsuits and all damages, liabilities, fines, judgments, costs (including settlement costs), and expenses associated therewith (including the payment of reasonable attorney fees and disbursements), arising out of: (1) the failure of Parties, their employees or agents, to comply with the terms and conditions of these terms or any attached letter agreements; (2) the negligent acts or omissions of Parties and their employees, agents, or subcontractors; (3) the services performed or actions taken by the Parties their employees or agents, including the operation and management of any event or activity incidental thereto. Each of our obligations to indemnify contained above will survive the expiration or termination of our agreement and the attached letter agreement.
MEDIATION:
If a dispute arises relating to this agreement, the Parties agree to the following procedure before pursuing any other remedy:
• Parties will promptly meet to work, in good faith, to negotiate a resolution of the dispute. Within thirty (30) days of the above meeting, if the Parties have not resolved the dispute, they will submit it to good faith mediation in accordance with standard accepted practices in the State of Arizona and will bear equally the costs of that mediation.
• After a mediator is appointed, the Parties will participate in good faith in the mediation. If the dispute is not resolved within thirty (30) days, it will be settled in accordance with the rules of the State of Arizona and judgment upon the award rendered by the arbitrator may be entered in any court having jurisdiction.
EVENT, in its sole discretion, may prohibit the conduct of any activity whatsoever which is deemed deleterious and not in the Event's best interest.
For failure to provide the correct information or to abide by the rules and regulations listed herein, EVENT, in its sole discretion, may prohibit the participation of any Volunteer.
No waivers, modifications, or amendments shall be valid unless approved in writing by EVENT’s management.
General security will be provided on the Event grounds and parking areas, but EVENT will not be responsible for injuries or lost stolen or damaged property or caused by, but not limited to, calamity, any Act of God, public enemy, strikes.
