This application is for nonprofit organizations that wish to engage with Festival attendees by sharing information about their mission, services, or community impact. This category is intended for organizations that will not be selling products, services, or conducting financial transactions on-site during the Festival.

 

As a nonprofit organization, Friends of John Coltrane, Inc. does not accept political candidates advocating for election, partisan campaigns, or organizations directly affiliated with a political party or partisan issue.

Terms & Conditions

Introduction:

This Agreement is between Friends of John Coltrane, Inc., hereinafter referred to as the “Festival Organizer,” a nonprofit organization hosting the John Coltrane International Jazz and Blues Festival (JCIJBF) in High Point, North Carolina, and the Nonprofit Informational Exhibitor, participating for the purpose of showcasing information, services, or mission-based programming at the Festival.

 

This Agreement outlines the terms under which the Nonprofit Informational Exhibitor will participate in the 2026 Festival, scheduled for September 5–6, 2026.

 

This category is limited to nonprofit organizations engaged in educational, cultural, civic, or mission-based outreach. No on-site sales, transactions, or fee-based activity are permitted under this application type.

 

By submitting their application and paying the required fee, the Exhibitor acknowledges their commitment to these terms and contributes to the Festival’s atmosphere and community engagement efforts.

Vendor Presence and Compliance with Setup and Breakdown Instructions:

The Nonprofit Informational Exhibitor agrees to maintain a continuous presence throughout the entire duration of the Festival, from opening to closing each day, as specified in the Festival schedule. The Exhibitor must adhere to all instructions provided by the Festival Organizer regarding the setup and breakdown of their exhibition space.

 

Setup Dates:

Exhibitors must arrive on September 4 or September 5, 2026, with exact arrival times to be scheduled with the Festival Organizer in advance. Detailed setup instructions will be provided prior to the event.

 

Breakdown:

Breakdown will take place immediately following the conclusion of the Festival on September 6, 2026. The Exhibitor is required to clear their booth and all associated materials in a timely manner, ensuring a clean and orderly event space.

 

Safety and Emergency Protocols:

Exhibitors are required to comply with all safety protocols and emergency procedures as outlined by the Festival Organizer. This includes, but is not limited to, evacuation routes, fire safety measures, and any health and safety guidelines established by local authorities.

 

Failure to comply with these instructions may result in termination of this Agreement and forfeiture of any fees paid.

 

Participation Fee:

The Nonprofit Informational Exhibitor shall pay a non-refundable flat fee of $600 to participate in the 2026 Festival. This fee covers the cost of exhibiting for both days of the event.

 

No commissions or additional payments are required under this category, as on-site sales are not permitted.

 

No Sales Policy:

Nonprofit Informational Exhibitors may not conduct retail sales, accept payment for goods or services, solicit donations through digital or physical payment platforms, or process transactions on-site. Displaying QR codes, donation links, or payment platform signage for on-site financial transactions is prohibited.

 

Organizations wishing to sell merchandise or conduct financial transactions must apply under the appropriate Commercial Vendor category and comply with all applicable vendor policies.

 

Violation of this policy may result in immediate removal from the Festival without refund.

 

Facilities and Equipment Provision:

Each Nonprofit Informational Exhibitor will be provided with a 10’ x 10’ canopy tent or equivalent space in the Coltrane Marketplace, along with basic lighting and access to a standard power source as part of their participation fee.

 

Tables and chairs are not included but may be rented from the Festival Organizer for an additional fee if requested in advance.

 

Exhibitors are responsible for bringing any additional display materials or equipment needed for their booth. All setup must be safe, stable, and compliant with applicable local regulations and Festival guidelines.

 

The Festival Organizer reserves the right to determine final booth format and placement based on operational needs, site layout, and overall event planning considerations.

 

ADA Compliance:

In alignment with the John Coltrane International Jazz and Blues Festival’s commitment to inclusivity, Exhibitors are required to adhere to the Americans with Disabilities Act (ADA) guidelines and make all reasonable accommodations for individuals with disabilities.

 

The Exhibitor is expected to:

 1. Provide accommodations for individuals with mobility, visual, or auditory impairments, including offering assistance upon request.

 2. Make reasonable efforts to assist individuals with other specific needs to ensure full participation in the Festival experience.

 

By complying with these requirements, the Exhibitor helps foster an inclusive environment where all Festival guests can engage fully with the event.

 

Intellectual Property Rights:

The Exhibitor acknowledges that Friends of John Coltrane, Inc. owns all intellectual property rights associated with the John Coltrane International Jazz and Blues Festival, including logos, branding materials, and proprietary marks.

 

The Exhibitor is granted a limited, non-exclusive license to use such intellectual property solely for promoting their participation in the 2026 Festival. Any use of the Festival’s name or branding must be pre-approved in writing by the Festival Organizer.

 

Exhibitors may not produce or distribute items using the Festival’s name, the name John Coltrane, or the word Coltrane without prior written approval.

 

Unauthorized use may result in revocation of participation privileges and potential legal action.

 

Cancellation Policy:

If the Exhibitor cancels participation for any reason:

 1. Forfeiture of Fees: All fees paid will be forfeited. No refunds will be issued.

 2. Future Participation: The Festival Organizer reserves the right to consider cancellation history when reviewing future applications.

 

Festival Cancellation:

If the Festival is canceled due to unforeseen circumstances (including Force Majeure Events):

 1. Participation fees will be refunded.

 2. The Festival Organizer will not reimburse additional costs incurred by the Exhibitor.

 3. Registered Exhibitors will be notified promptly.

 

Indemnification:

The Exhibitor agrees to indemnify and hold harmless Friends of John Coltrane, Inc., its officers, directors, employees, agents, and affiliates from any claims arising from participation in the Festival, including:

 1. Injury or property damage caused by the Exhibitor’s booth or activities.

 2. Violations of local, state, or federal laws.

 3. Failure to comply with Festival rules or safety protocols.

 

This obligation survives termination of the Agreement.


Insurance:

The Exhibitor is responsible for maintaining adequate insurance coverage for their operations and booth setup. The Festival Organizer is not responsible for losses or damages incurred during the event.

 

Force Majeure:

Neither party shall be liable for failure to perform due to causes beyond reasonable control, including acts of God, weather, government restrictions, labor disputes, or transportation disruptions.

 

If such events extend beyond Festival dates, either party may terminate this Agreement without further liability, and participation fees will be refunded.

 

Non-Exclusivity Agreement:

This Agreement does not create an exclusive relationship. The Exhibitor may participate in other events provided such participation does not interfere with Festival obligations.

 

The Festival Organizer reserves the right to engage with other exhibitors and organizations.

 

Penalty for Non-Compliance:

In the event of non-compliance:

 1. Booth Setup Violations may require immediate correction.

 2. Failure to Maintain Professional Presence may result in removal.

 3. Schedule Non-Compliance may result in forfeiture of fees.

 4. Violation of Rules or Regulations may result in removal without refund.

 5. Other Breaches may result in immediate termination of participation.

 

Contract Execution:

 

This Agreement becomes effective once the Exhibitor submits their application, is accepted by the Festival Organizer, and the non-refundable $600 participation fee is successfully processed.

 

Booth locations are subject to change based on final site planning and operational needs.

 

Definitions:

 1. Festival Organizer: Friends of John Coltrane, Inc.

 2. Nonprofit Informational Exhibitor: A nonprofit organization approved to present information, services, or mission-based outreach without engaging in on-site sales or financial transactions.

 3. Festival: The 2026 John Coltrane International Jazz and Blues Festival held September 5–6, 2026.

 4. Booth: The designated 10’ x 10’ canopy tent or equivalent space in the Coltrane Marketplace assigned to the Exhibitor.

 5. Coltrane Marketplace: A larger shared tented structure within the Festival grounds that houses multiple approved exhibitors or vendors, typically positioned alongside the official Coltrane Store, which sells Festival merchandise. Exhibitors assigned to the Coltrane Marketplace will receive an equivalent display footprint within the shared structure, as determined by the Festival Organizer.

 6. Booth Location: The specific area assigned within Festival grounds.

 7. Festival Schedule: Includes setup, public exhibition hours, and breakdown.

 8. Participation Fee: The non-refundable $600 fee for participation in the 2026 Festival.

 9. Event Protocol: All rules and operational procedures established by the Festival Organizer.

 10. Festival Merchandise: Goods branded with the Festival’s official marks. Distribution by Exhibitors is prohibited unless authorized in writing by the Festival Organizer.

An applicant may withdraw their application at any time prior to acceptance by notifying the Festival Organizer in writing. Once accepted, the fee becomes non-refundable.
