MUSIC ARTIST PERFORMANCE AGREEMENT

This Music Artist Performance Agreement ("Agreement") is made and entered into as of the date of signing by and between:

Festival Organizer: Hamburg Music Fest organized By Hamburg Area Art Alliance located at State Street Square 222 State Street Hamburg, Pa 19526

1. PERFORMANCE DETAILS

The Artist agrees to perform a set lasting between 30 to 45 minutes (Depending on setup requirements) at Hamburg Music Fest scheduled to take place on June 13th  at State Street Square.
Performance time will be determined by the Organizer and communicated to the Artist in advance. Please reach out to the Organizer if there are any scheduling requests.
The Artist is expected to arrive at least 1 hour before their scheduled performance for check-in and setup
2. COMPENSATION OPTIONS The Artist may choose one of the following options:

Option A (No Performance Fee): The Artist will perform at no charge to the Organizer and will be permitted to sell their merchandise at the event, retaining 100% of their profits.
Option B (Paid Performance): The Artist will receive a performance fee of $__________  [agreed amount] but will not be allowed to sell any merchandise at the event. 
Option C (Paid Performance): The Artist will receive a performance fee of $__________  [agreed amount] but will be required to pay 15% of all merchandise sold at the event to the Hamburg Area Art Alliance 
The Artist must select their compensation option at the time of signing this Agreement.

3. PROMOTION REQUIREMENTS

The Organizer agrees to promote the event and feature the Artist in promotional materials, including but not limited to social media, event flyers, and the festival website.
The Artist agrees to promote their participation in the event on their social media platforms and other promotional channels at least 2 times prior to the event.

4. EQUIPMENT & TECHNICAL REQUIREMENTS

The Organizer will provide basic sound equipment, including PA systems, microphones, and stage monitors.
The Artist is responsible for providing their own instruments and any additional equipment required for their performance.
A soundcheck time will be scheduled prior to the event, and the Artist must adhere to the agreed-upon schedule.
5. CANCELLATION POLICY

If the Artist needs to cancel their performance, they must notify the Organizer at least 14 days in advance.
This is a Rain or Shine Event 
The Organizer reserves the right to cancel or reschedule the event due to unforeseen circumstances.

6. LIABILITY & CONDUCT

The Artist is responsible for their own safety and the security of their equipment.
The Artist agrees to conduct themselves professionally and respectfully towards staff, attendees, and other performers.
The Organizer shall not be held liable for any injury, loss, or damage incurred during the event.
Our Town Foundation’s insurance does not cover liability for performers

If the event is canceled through no fault of the promoter, I understand this Agreement is null and void and the obligation of both parties is waived.  Neither the performer nor the venue will be held liable for any failure to perform its obligations where such breach is due to any of the following:  acts or regulations of public authorities, severe inclement weather, epidemic or illness, acts of God or any other legitimate cause beyond the reasonable control of the performer and the venue.   Initial ________

I understand that Our Town Foundation’s insurance does not cover liability for performers and I/we are performing at our own risk and will provide for our own insurance coverage.  Initial _________

I agree that Our Town Foundation may use my/our name, photograph and any likeness of me for purposes of promoting the Festival or other downtown events. Initial _________

Performance Clause: The artist/band must be at the designated stage no later than 30 minutes prior to your performance time with all your gear. TOHF must be notified immediately upon any changes with the artist/band. Failure of this agreement will result in jeopardizing any chance of performing at any future festivals. Initial  ________

Dress clause: Shirts are required by anyone on a stage.  Initial _______

Profanity Clause: No profanity may be used at any time by any member of the performing artist/band that can be heard thru the PA system. If there is a curse word in the song, change it. There will be no exceptions. Violation of this clause will result in the forfeiture of any agreed upon compensation and immediate removal from the stage.  Initial ______

I will send at least one photo in a jpeg file format to hmusicfest@gmail.com  as soon as this agreement is signed to be used for publicity purposes.   Initial  _______

By signing this agreement you and/or your band members shall save, keep harmless and defend the festival and all of its officers, employees and agents and volunteers against any and all liability claims, costs of whatever kind and nature, for injury to or death of any person or persons and for loss and damage to any property occurring in connection with or in any way incident to or arising out of the occupancy, use, service, operation or performance of work in connection with this contract and acts or omissions of the Hamburg Music Fest employees, agents or representatives, or volunteers.
