Terms & Conditions
SECTION 1: Permits
All food trucks must have a permit issued by the City of New Braunfels Health Department. https://www.newbraunfels.gov/3438/Food-Safety
SECTION 2: Vendor Scope and Responsibility of Services
VENDOR will be required to carry off any trash or waste their operation creates. This would include items such as cardboard boxes, plastic, cooking oil and ashes. Failure to do so may result in assessment of additional fees or loss of future opportunities to operate with the New Braunfels Parks & Recreation Department ("DEPARTMENT"). This statement is not intended to apply to serving containers, cups or utensils issued to customers. The distribution of glass containers is prohibited. Generators must be off the ground.
SECTION 3: Schedule of Payment
Compensation to the DEPARTMENT for participation in the DEPARTMENT’S event, shall be as follows:
The VENDOR agrees to remit to the City of New Braunfels Parks and Recreation Department 10% of their gross food and beverage sales. Payment will be in the form of a check written to the City of New Braunfels no more than ten (10) days after the event along with a statement providing sales from that event.
SECTION 4: Vendor Indemnification
VENDOR agrees to protect, indemnify, and hold harmless the DEPARTMENT from and against suits, actions, claims, losses, liability or damage of any character, and from and against costs and expenses, including attorney fees incidental to the defense of such suits, actions, claims, losses, damages or liability on account of any injury arising in part or in whole from VENDOR’s performance related to the services defined above.
SECTION 5: INSURANCE
Maintain in effect a comprehensive general liability insurance policy naming the CITY as an additional insured, in an amount of $1,000,000 per occurrence; $1,000,000 aggregate. Documentation of this policy must be submitted to the CITY prior to the beginning of the scheduled use for each site.
