About the application

PLEASE READ THE ENTIRE APPLICATION PRIOR TO FILLING IT OUT. This application is for primary food vendors and alcohol vendors (restaurants, food trucks, etc.) that are looking to sell open-container food and beverages. Please fill out the Food & Beverage partner application and wait for approval. Arrival information will go out 2 weeks prior to the event. Applications submitted after the deadline will be automatically placed on a waiting list. This is an electronic agreement and by paying the fee and submitting your application, you are validating and approving this agreement electronically.

The City of Celina invites you to join the monthly Friday Night Market in the heart of Downtown Celina! These free-to-attend Markets offer a great way for attendees to get outside, shop locally, eat delicious food, and listen to live music. The mission of Friday Night Market on the Square is to provide locally grown, fresh, and high- quality produced products while giving local farmers, producers, and artisans an economic outlet within Celina. Terms & Conditions

Any vendor intending to sample or sell open-container food or beverage must obtain a food permit from the corresponding City/County Health Department for the event(s) in which you are confirmed. Failure to do so may result in loss of vendor fees paid, barring from future events, or prohibition from entering the event grounds without the issuance of a refund or credit transfer. Health permit documentation is due to the City/County Health Department no less than 14 days prior to the event start date. Vendor is prohibited from performing any business activity outside of its space. Vendor may bring additional furnishings, so long as all items fit within the designated booth space. Vendor is responsible for all necessary equipment, including extension cord. All vendors serving food or beverage must receive a Temporary Event Food Vendor Health Permit and Mobile Fire Suppression Permit. 

 

Only menu items submitted on the application form and approved may be sold at the event. No glass containers are permitted. Menu exclusivity is not guaranteed; other vendors may be permitted to sell similar items.


The vendor is responsible for maintaining required permits, licenses, and certifications for all products they produce. Vendors will be responsible for their own cash boxes and receipts. Vendors must apply for the Texas State Sales Tax ID# and report their earnings as being sold in Celina, Texas. The State Sales Tax Rate is 8.25%. FOOD & BEVERAGE VENDORS - All Food & Beverage Vendors (excluding Texas Cottage Food Law Vendors) are

responsible for providing the required proof of minimum insurance coverage within 10 business days after vendor

acceptance notification. Vendors will send proof of insurance to events@celina-tx.gov.

 

Insurance should:

• Be issued by a carrier licensed or authorized to do business in the State of Texas.

• Name City of Celina, 142 N. Ohio St., Celina, TX 75009 as an additional insured.

• Include coverage for specific date of the event.

• Show Commercial General Liability coverage of at least $1,000,000 per occurrence.

• Show General Aggregate coverage of at least $1,000,000.

• List the vendor’s business name and address as shown on the vendor application.

 

In accordance with Texas HB 2844, the City of Celina will no longer regulate the permitting and inspection of

Mobile Food Units (MFU)/Food Trucks. All MFU permitting and inspection will now be conducted and

regulated by the State of Texas. However, the City of Celina retains authority over local time, place, and manner

restrictions (e.g., local zoning and parking ordinances). Prior to being approved for a specific event, all Mobile Food

Vendors are required to provide event organizers with proof of a current and valid State of Texas MFU permit, along

with proof of a passed State inspection not older than six months. Tented Temporary Food Vendors will continue to

be permitted and inspected by the City of Celina.

Food Trucks: When applying to participate in a specific event, all MFUs must provide proof of a valid State of Texas

Mobile Food Unit permit and proof of a passed inspection not older than six months.

 

Tented Temporary Food & Beverage Vendors: Once the City of Celina approves a Tented Temporary Food &

Beverage Vendor or Cottage Food Vendor with live sampling, the vendor must apply for a City of Celina Temporary

Event Food Vendor (TEFV) Health Permit. Please do not submit a Health Permit application until contacted by

Celina Health Department.

 

Health Permitting: All food & beverage vendors* must have a current State of Texas Mobile Food Unit permit, or

City of Celina TEFV Health Permit. All food items being served MUST be prepared completely on-site, or at a licensed

and inspected commercial kitchen. FOOD PREPARED IN A HOME KITCHEN WILL NOT BE ALLOWED. Proof of

agreement with a licensed and inspected facility will be required, if applicable.

 

*The City of Celina follows Texas Cottage Food Laws, and generally, Cottage Food Vendors do not require a TEFV

Health Permit. However, if a Cottage Food Vendor conducts ‘live’ sampling at the event, a TEFV Health Permit will

be required. If you have questions regarding proper sampling and possible permit requirements, please contact the

Celina Health Department.

 

If you already have a City of Celina TEFV Health Permit for the current calendar year, you do not need to submit a new

application. If you are unsure whether or not you have a valid TEFV permit for the current calendar year, please contact

Bruce Koliba at bkoliba@celina-tx.gov.

 

GREASE AND OTHER WASTE - Food vendors are prohibited from dumping grease on-site at any event. Food vendors agree to transport and remove all grease and other food-related waste to appropriate locations as required by both SBG Hospitality and municipal law of the city in which the event is held. Please contact the Health Department for the corresponding City/County for questions/concerns. 

 

VENDOR FEES - All vendors must pay the assigned fee in advance in order for space to be confirmed. No vendors will be granted access to the event grounds or pre-event communications without a paid invoice on file.

 

SPACE IS ONLY CONFIRMED ONCE PAYMENT IS RECEIVED. Vendors with unpaid invoices will not be granted entrance to the event grounds.
 
BOOTH SPACE: Food & Beverage partners are provided either a 10'x10' or a 10'x20' space. A space will be assigned upon approval. SBG Hospitality and the City of Celina WILL NOT PROVIDE the following items: Tables, tents, chairs, lights, batteries, extension cords, weights, ice, water, coolers, dollies, storage, booth staffing, set-up assistants, or other materials, used for a vendor's tent set-up. SIGNAGE - Vendor can display signage within its assigned vendor space. All signage and decor shall be properly displayed and mounted. The vendor shall not place signage or advertisement flyers in any other locations aside from its designated vendor space. Signs, banners or displays of any kind of inappropriate messaging, shall not be displayed by the vendor in the booth/tent space or at any other event location 

 

INSURANCE & PERMITTING - All food & alcohol vendors (excluding Texas Cottage Food Law Vendors) are responsible for providing the required proof of minimum insurance coverage within 10 business days. The Temporary Event Food Vendor (TEFV) permit is valid through the end of the calendar year, for all Celina events within the same year.  If cooking with gas, oil, or open flame, vendors are also required to have a Mobile Fire Suppression Permit (MFS), issued by the Celina Fire Department. Please contact CFD with questions regarding MFS permitting and inspection requirements. 


EVENT DURATION - All vendors are required to remain set up and in place for the duration of the event in order to provide a consistently high-quality experience for our patrons. Vendors may NOT depart the event prior to the conclusion without direction from SBG Hospitality management staff.
 
ELECTRICITY - To receive power, the vendor must upload a photo of the plug that will be used at the event. 30AMP/50AMP will be available for food trucks. 110v will be available for other electrical needs. Generators will not be permitted without prior written permission from SBG Hospitality management staff.  If electricity is provided by the City, the vendor will be required to provide a 100' extension cord or 25' (30 amp/50 amp extension cord). If an electrical connection is not available, only a food vendor can use its own generator. Generators will not be provided. If a vendor plans on using their own generator, they must notify SBG Hospitality and generator guidelines will be sent to the vendor.   

 

ALCOHOL VENDORS - Alcohol vendors may serve out of food trucks/trailers, or fire retardant/resistant 10'x10' or 10'x20' tents with 25 lb. weights per tent leg for their booth spaces. Vendor is encouraged to bring its own battery-operated LED lights for the assigned booth. Vendor will provide its own tables, chairs, or other booth accessories as needed. No glass containers permitted. Vendor must show proof of and display in its booth a temporary permit to sell beer and wine obtained by the TABC. Import/specialty beer, wine and wine-based cocktails may be sold. Liquor as defined by the TABC is not permitted. Vendor selling beer and wine shall show proof of the proper liquor liability endorsement on its insurance policy upon acceptance for Vendor participation. Vendor is solely responsible for checking the identification of event patrons prior to serving.
Alcohol vendor must file all necessary permits to TABC. Once vendor application is approved, SBG Hospitality will issue the vendor an approval letter to be given to TABC. Alcohol vendor must abide by the TABC code and all ordinances, laws, rules, regulations, standards, and policies in accordance of the event. Alcohol vendor must apply for a City of Celina Temporary Event Food Vendor Permit (TEFV). See Insurance & Permitting Guidelines for instructions.  Vendors will be responsible for their own cash boxes and receipts. Vendors must apply for the Texas State Sales Tax ID# and report their earnings as being sold in Celina, Texas. The State Sales Tax Rate is 8.25%. TRASH - All vendors are responsible for cleaning their own immediate area at the conclusion of the event. All liquid or solid waste must be disposed of properly and may not be left at the venue. Violation of this policy may result in a $200 fine, barring from future events, or prohibition from entering the event grounds on the next confirmed event date without issuance of a refund or credit transfer.
 
WEATHER POLICY AND REFUNDS/TRANSFERS - The event is rain or shine. Should you need to cancel a 100% refund will be granted >14 days prior to the event. A 50% refund will be granted 7-14 days prior to the event. NO REFUND will be issued less than 7 days prior to the event. SBG Hospitality and the City of Celina reserve the right to cancel any vendor at any time. Vendors canceled by SBG Hospitality or the City of Celina shall receive a full refund unless the vendor has violated the terms and conditions of the "Vendor Policy and Guidelines" in which case the vendor forfeits the refund. Any vendor that does not show up without a written notification to coordinator@sbghospitality.com can result in exclusion from future events.

 

WAIVER AND RELEASE OF LIABILITY AND HOLD HARMLESS -

I do hereby waive all claims, release, indemnify, defend and hold harmless the City of Celina and all of its departments, officials, officers, agents and employees, in both their public and private capacities, from any and all liability, claims, suits, demands, expenses of litigation or causes of action which may arise by reason of injury to persons or loss of, damage or loss of use by any property occasioned by error, omission or negligent act of myself or any other persons with regard to this agreement, and I will, at my own cost and expense, defend and protect the City of Celina against any and all such claims and demands. I do hereby further agree to indemnify, defend and hold harmless the City of Celina and all of its departments, officials, officers, agents, employees, from and against any and all claims, losses, damages, causes of action, suits and liability of every kind, including all expense of litigation, including but not limited to court costs and attorney fees for death, personal injury or debt of any person; or for loss, damage to or loss of use of any property arising out of or in connection with this agreement. Such indemnity shall apply whether the claims, losses, damages, causes of action, suits or liability arise in the whole or in part from the negligence of the City of Celina, its departments, officers, officials, agents or employees. It is the express intention of the parties hereto, both myself and the City of Celina, that the indemnity provided for in this paragraph is indemnity by the undersigned to indemnify and protect the City of Celina from the consequences of the City of Celina’s own negligence, whether that negligence is the sole or concurring cause of injury, death or damage. It is further agreed that the execution of this Waiver, Release and Indemnity Agreement will not constitute a waiver by the City of Celina of the defense of governmental immunity, where applicable, or any other defense recognized by the courts of the State of Texas. I am voluntarily participating in the Event listed above and I am participating in the Event entirely at my own risk. I have read the Waiver, Release and Indemnity Agreement and understand its terms. I execute it voluntarily and with full knowledge of its significance.

 

FINAL ACKNOWLEDGMENTS, for myself, my guests, and anyone entitled to act on my behalf, waive and release SBG Hospitality LLC and the City of Celina, all SBG-affiliated event venues, all SBG-affiliated City government agencies, all affiliated sponsors, and vendors, volunteers, and their representatives, and successors from all claims or liabilities of any kind arising out of my participation in this event, even though that liability may arise out of negligence or carelessness on the part of the persons named in this waiver; further releases, forever discharges, and covenants not to sue the aforementioned parties and its officials, officers, employees, representatives, agents, and volunteers in connection therewith to the extent allowed by Texas Law. I authorize SBG Hospitality to photograph or take video footage of me and my property in connection with the events selected in this application. I authorize the use of any such photographic and video footage of me for all marketing and advertising purposes including, but not limited to, the following mediums: Web content, print ads, social media marketing, etc. I understand that this application does not constitute confirmation of vendor space and that only payment of a vendor invoice may confirm booth space. Without receipt of payment, no booth space will be provided to me. I authorize SBG Hospitality to use my information to send me information via email and SMS. The digital signature of this application constitutes a fully enforceable agreement to the terms listed hereof once payment is received. Vendors will be confirmed once payment is received.
