About the event

The Cabbage, Potato & Bacon Festival is a free, family-friendly celebration in downtown Hastings honoring the area’s agricultural heritage, local flavors, and community spirit. Enjoy live music, artisan vendors, lawn mower races, and cooking demonstrations — all included with free festival admission. For guests looking to enhance their experience, the festival also features three ticketed events: the Brunch Tasting Experience, the Miss Potato Queen Pageant, and the Saturday night Potato Ball, a semi-formal fundraiser with dinner, auction, music, and dancing. Come for the day or stay for the weekend — there’s something for everyone in Hastings.

Vendor Terms & Conditions

 

Potato, Bacon, & Cabbage Festival

These Vendor Terms & Conditions (“Agreement”) are entered into by and between Hastings Main Street, Inc., a Florida nonprofit corporation (“HMS”), and the undersigned vendor, exhibitor, or organization (“Vendor”).

By applying to participate and/or selecting “Yes, I agree” electronically, Vendor acknowledges that they have read, understand, and agree to the following terms.

 

1.1 Independent Vendor Status / No Partnership

Vendor acknowledges and agrees that participation in the Potato, Bacon, & Cabbage Festival (the “Event”) does not create a partnership, joint venture, agency, or employer-employee relationship between Vendor and HMS.

Any vendor fees, revenue sharing, sponsorships, or participation arrangements do not constitute a legal partnership or shared liability. Vendor remains solely responsible for its operations, products, services, employees, volunteers, agents, and invitees.

 

 1.2 Minor Vendors

Vendors must be at least eighteen (18) years of age to enter into this Agreement. If a vendor participant is under the age of eighteen (18), a parent or legal guardian must apply as the vendor of record and agree to these Vendor Terms & Conditions on the minor’s behalf.

The parent or legal guardian executing this Agreement represents and warrants that they have full legal authority to bind themselves and to assume all obligations, responsibilities, indemnification duties, and liabilities associated with the minor’s participation in the Event.

HMS does not contract directly with minors. Any participation by a minor vendor occurs solely under the supervision and responsibility of the parent or legal guardian who is the contracting party. The parent or legal guardian agrees to be fully responsible for the acts or omissions of the minor vendor and acknowledges that HMS does not provide supervision, childcare, or guardianship services for minor vendors.

 


2. Assumption of Risk

Vendor understands that participation in an outdoor public festival, market or event may involve inherent risks, including but not limited to personal injury, illness, property damage, weather-related hazards, equipment use, crowd interactions, and food-related risks.

Vendor voluntarily assumes all risks associated with participation in the Event, including risks arising from the acts or omissions of Vendor, Vendor’s staff, agents, invitees, equipment, displays and operations.

Vendor acknowledges that this assumption of risk applies to Vendor’s owners, employees, volunteers, agents, invitees, and any minors under Vendor’s supervision or control.

 

3. Release of Liability

To the fullest extent permitted by Florida law, Vendor releases, waives, and discharges Hastings Main Street, Inc., its officers, directors, employees, volunteers, agents, sponsors, and affiliates from any and all claims, demands, damages, losses, or causes of action arising out of or related to Vendor’s participation in the event, including but not limited to bodily injury, illness, death, or property damage.

This release applies even if caused by the ordinary negligence of HMS, but does not apply to gross negligence or willful misconduct to the extent prohibited by law.

 

4. Indemnification

Vendor shall be solely responsible for their own actions and omissions during the Event, and the actions and omissions of any employees, volunteers, agents, invitees under their control or direction during the Event.  Vendor agrees to indemnify, defend, and hold harmless Hastings Main Street, Inc. and its officers, directors, employees, volunteers, agents, sponsors, and affiliates from and against any and all claims, liabilities, damages, losses, costs, lawsuits, judgments and/or expenses (including reasonable attorneys’ fees) arising out of or related to, either directly or indirectly:

Vendor’s participation in the event
Vendor’s products, food, services, displays, or activities
Vendor’s failure to comply with applicable laws or regulations
Acts or omissions of Vendor, Vendor’s employees, volunteers, or agents

 

5. Compliance with Florida Law

5.1 General Compliance

Vendor agrees to comply with all applicable federal, state, county, and local laws, ordinances, rules, and regulations, including those related to health, safety, sales tax, permitting, and business operations.

HMS does not monitor or enforce vendor compliance and assumes no responsibility for Vendor’s legal obligations.

 

5.2 Agritourism Notice (Florida Statute § 570.85 – § 570.87)

Vendor acknowledges that certain Events or activities may occur on or near agricultural land or in connection with third-party agricultural operations. Florida law provides limited liability protections to qualifying agritourism operators only where all statutory requirements are met.

HMS makes no representation or warranty that any Event qualifies as an agritourism activity or that agritourism liability protections apply. Vendor agrees not to engage in conduct that would interfere with applicable safety requirements where agritourism protections may otherwise be available. 

 

5.3 Food Vendors & Cottage Food Compliance

All food vendors are solely responsible for complying with applicable Florida food laws, including but not limited to:

Florida Statute § 500.80 (Cottage Food Operations)
Florida Department of Agriculture and Consumer Services regulations
St. Johns County Health Department requirements
Vendor represents and warrants that:

They are properly licensed or exempt under Florida law
All food products are prepared, labeled, transported, and sold in compliance with applicable regulations
HMS does not verify food licenses or Cottage Food eligibility and assumes no liability for food-related violations or illnesses.

HMS does not inspect, verify, supervise, or monitor food preparation, labeling, allergen disclosure, storage, transportation, or cross-contamination. Vendor assumes sole responsibility for all food-related risks, including but not limited to foodborne illness, allergic reactions, mislabeling, or regulatory violations arising from Vendor’s products or practices.

 

6. Insurance and Sales Tax Requirements

Vendor is solely responsible for determining whether liability insurance is required for their participation under Florida law or local regulation.

If insurance is required, Vendor agrees to obtain and maintain appropriate general liability insurance coverage, permits, and licenses required by applicable federal, state, and local laws for the duration of the event.

HMS reserves the right to request proof of insurance at any time. Failure to maintain required insurance may result in removal from the event without refund.

Vendor acknowledges that HMS’s insurance policies do not provide coverage for Vendor’s operations, products, employees, volunteers, minors, or equipment.

HMS reserves the right to require proof of insurance based on the nature of Vendor’s activities, equipment, or risk profile.

Sales Tax: Vendor is solely responsible for all monies collected from sales, plus the collection and reporting of sales tax. 


7. Safety Standards & Event Operations

Vendor agrees to:

Follow all reasonable safety instructions provided by HMS or event staff
Immediately report unsafe conditions to HMS representatives
Cease operations immediately if an unsafe condition exists
Vendor is responsible for the safe setup, operation, and breakdown of their booth, equipment, and displays unless otherwise expressly agreed in writing.

 


Weather Policy: This is an outdoor event and will be held “rain or shine” It is the responsibility of the Vendor to assume risk of setting up in inclement or potentially inclement weather. Please be sure to properly secure your tent with appropriate weights or other safety measures.

 

8. Equipment Use (If Applicable)

Use of HMS-owned equipment is permissive only and does not transfer control, supervision, or responsibility to HMS. If Vendor uses HMS-owned equipment (including tents, tables, chairs, trailers, or other property), Vendor assumes responsibility for its proper use, care, and return.

Vendor agrees to reimburse HMS for any loss, damage, or theft caused by Vendor’s negligence, misuse, or failure to follow instructions.

 

9. Removal for Non-Compliance

HMS reserves the right to remove any Vendor from the event, without refund, for:

Safety concerns
Violation of laws or regulations
Violation of applicable event rules 
Failure to comply with these Terms & Conditions
Conduct deemed detrimental to the event or public safety
Event Rules are intended to address operational, safety, and logistical requirements specific to the Event and shall supplement, and not materially conflict with, these Vendor Terms & Conditions.

 

10. Photography Release: Vendor grants permission and an unconditional release of any photographs, video or motion pictures and/or any verbal or written statements for use by the promoters of HMS for any legitimate purpose including, but not limited to, publicity, promotions, fundraising and/or websites.


11. Governing Law & Venue

This Agreement shall be governed by the laws of the State of Florida. Any legal action arising under this Agreement shall be brought exclusively in the courts of St. Johns County, Florida.

 

11. Electronic Agreement

Vendor understands and agrees that acceptance of these Terms & Conditions electronically constitutes a legally binding agreement equivalent to a handwritten signature. 

These Vendor Terms & Conditions constitute the entire agreement between HMS and Vendor regarding Vendor’s participation in the Event and supersede all prior or contemporaneous oral or written agreements.

 

Refunds and Cancellations:
Vendor acknowledges and agrees that all fees paid in connection with participation in the Cabbage, Potato, and Bacon Festival are non-refundable. No refunds shall be issued under any circumstances.
