Terms & Conditions

 Event Terms and Cancellation Policy

 

The person or organization completing this application is hereafter referred to as the Vendor or Exhibitor. Montage Events, producer of Cathedral City LGBT+ Days ("Festival") will reserve space for the Festival based upon our acceptance of the completed application submitted by the Vendor. Vendor's acceptance and booth usage is at the discretion of Montage Events. We reserve the right to deny any application for any reason. Booth spaces are limited to 10’ x 10’ in size unless otherwise arranged through Montage Events and noted in your application invoice. Booth space locations will be emailed to Vendor on or around February 27, 2026.

 

PUBLIC HEALTH/SAFETY: Our guidelines regarding COVID-19 and all public health concerns are developed in cooperation with the City of Cathedral City and are intended to create a safer space to gather. The guidelines may change as the date draws closer, and will meet or exceed any and all city and state requirements. The Festival will offer hand washing/sanitizing stations and encourages touchless payment wherever possible.

 

SATURDAY SET-UP & BREAKDOWN: Exhibitor understands that they will not be allowed into the Amphitheater until the assigned times of 8 or 9AM. We do not provide refunds for no-shows. Set-up must be completed by 10:45 AM for festival opening at 11:00 AM. Breakdown will start no earlier than 8:00 PM and all materials must be completely disassembled. Exhibitor’s area must be completely cleaned no later than 9:30 PM.More information on Exhibitor check-in, such as location, will be provided with booth space assignments on or around February 27, 2026.

 

SUNDAY SET-UP & BREAKDOWN: Exhibitor understands that they will not be allowed into the Civic Center Park area until 8AM. We do not provide refunds for no-shows. Set-up must be completed by 9:45 AM for Vendor Marketplace opening at 10:00 AM. Breakdown will start no earlier than 1:00 PM and all materials must be completely disassembled. Exhibitor’s area must be completely cleaned no later than 1:30 PM.More information on Exhibitor check-in, such as location, will be provided with booth space assignments on or around February 27, 2026.

 

VEHICLES: The Exhibitor understands that no vehicles will be allowed inside the Cathedral City Community Amphitheater without the prior approval of Montage Events. Exhibitors are responsible for finding parking outside of the Ampitheater. There is a city parking structure adjacent to the Amphitheater with free parking. 

 

CLEAN UP: All cardboard must be flattened and brought to the closest station for recycling along with other trash for sorting. No trash shall remain in an exhibitor booth space after an Exhibitor has left the Festival. In the case that there is trash left behind, the Exhibitor team will document the trash and a cleaning fee of $250 shall be charged.

 

SPACE ALLOCATION USE: Presentation must be confined to the specified location and space size as set forth in its application and space permit. Nothing that extends beyond the allocated space is permitted.

 

Exhibitor understands that this application is FOR SPACE ONLY, unless add-ons are ordered. Exhibitors will provide everything else such as booth structures, chairs, tables, batteries, clothes racks, merchandise displays, etc.

 

Generators and amplified sound equipment, including but not limited to stereos, loudspeakers, and bullhorns, of any kind are NOT permitted. NO ELECTRICITY IS AVAILABLE IN THE SPACE, unless previously arranged with Montage Events.

 

Exhibitors shall not sell or give away or otherwise distribute any product, food, drink or other item that is not specified in the Exhibitor’s application. Violation of this rule may result in immediate closure of the booth without refund or recourse.

 

Exhibitor agrees to indemnify, hold harmless, and defend Montage Events from all liability from loss, damage, or injury to persons or property in any manner arising out of, or incident to, their performance of this agreement, whether or not resulting from the negligence of the Exhibitor or its agents.

 

The Festival will not be canceled less than 30 days prior to the scheduled date, except for extreme weather, natural disasters (including disease/virus epidemic or pandemic), or other reasons by valid order of governmental authorities beyond Montage Event's control. In the event that cancellation of the Festival, less than 30 days prior to scheduled date, is caused by an “act of God” including but not limited to earthquake, storm, flood, fire, disease/virus epidemic or pandemic, terrorist act, riot, or by valid order of governmental authorities, Exhibitor shall not be entitled to a refund of any sums paid to Montage Events, and Montage Events will not be held liable to the Exhibitor for any other damages.

 

Montage Events reserves the right to refuse any Exhibitor’s participation in the fair at any time and for any reason. If necessary, Montage Events may eject an Exhibitor from the Festival grounds without reentry, and such Exhibitors will not receive a refund.


Exhibitor agrees not to record, videotape, or take photographic images by any means for resale or profit while on the fairgrounds without the explicit prior written consent of Montage Events. The Exhibitor agrees to use its space for display and/or sales of products or promotional materials only unless otherwise agreed upon.

 

Exhibitor agrees not to sell any merchandise that violates the rights to publicity or privacy of any person or which violates the trademark, copyright, patent or design patent rights of any third party, or libels or slanders any third party or holds them in a false light. The Exhibitor will indemnify Montage Events and hold Montage Events harmless against any claims brought against Montage Events based on third party liability for any such violations by the Exhibitor.

 

Exhibitor is an independent contractor. The relationship between the Exhibitor and Montage Events does not create a joint venture, partnership, agency or employee/employer relationship between the parties for any purpose, including, but not limited to, taxes or employee benefits. The Exhibitor will be solely responsible for payment of any and all wages, taxes, and insurance. This relationship shall not constitute a partnership between or joint venture by the parties or make either party the agent of the other. Neither party shall hold itself out otherwise nor shall either party become liable by any representation, act or omission of the other contrary to these provisions.

This Agreement shall be construed and interpreted pursuant to the laws of the State of California, County of Riverside, applicable to agreements entered into and fully performed in California. If any provision is deemed to be unenforceable as written it shall be modified so as to make it in its general interest, enforceable and as so modified shall form part of this Agreement. This Agreement and the schedules, exhibits and attachments constitute the entire agreement between the parties on this subject matter.

 

Exhibitors may use event names and logos in advertising their presence at the Festival. However, Montage Events, as licensed by the City of Cathedral City, reserves and retains all rights, title, and interest in and to all Cathedral City LGBT+ Days trademarks and logos. 


Under no circumstances and under no legal theory, tort, contract, or otherwise, shall either party or its affiliates or its suppliers or resellers be liable to the other party for any indirect, special, incidental, or consequential damages of any character including, without limitation, personal injury, damages for loss of profits, goodwill, work stoppage, or any and all other commercial damages or losses, even if a party has been advised of the possibility of such damages.

 

It is agreed that the undersigned Exhibitor shall accept the above conditions as well as accept sole responsibility for any and all acts, including “acts of God” that occur within the rented space. Montage Events shall bear no responsibility for any and/or all loss including, but not limited to, consequential loss, general damage or punitive and exemplary damages sustained or caused by the participant(s), its agents or employees. Notice is hereby given that the Exhibitor shall provide its own insurance coverage.

 

SPECIFIC TO FOOD TRUCK VENDORS:

 

All Food Trucks must hold the following permits:

  1. Business license
  2. Mobile Food Facility (MFF) permit from the Riverside County health department
  3. Riverside County Health Permit
  4. Food seller's permit
  5. Fire safety permit.
  6. Employee Health Permit (Food Handlers License)
  7. Food Safety Manager Certification  

All condiments are to be individually wrapped or dispensed from sanitary pour, pump, or squeeze type devices.

 

Vendor and its agents shall not sell or give away or otherwise distribute any product, food, drink, or other items not specified in the Applicant’s application. Violation of this rule will result in immediate closure without refund or recourse. A complete menu with prices of items you intend to serve must be provided with the application.

 

Vendor and its agents shall not sell or give away or otherwise distribute any alcoholic beverages. Violation of this rule will result in immediate closure without refund or recourse. 

 

Vendor and its agents shall confine its Food Truck to the specified location and space size as set forth in its application and space permit. It shall not construct or place any material of any kind that extends beyond the confines of the allocated space.

 

Containers of butane or fuel must be affixed to a post or other secure item but may not attach to site decorations or sets. All food vendors using heat and/or open flames must: a) provide fireproof containers for discarding ashes; b) provide one visibly mounted fire extinguisher rated A or B.

 

Food concession vendors must control drainage and/or condensation.

 

Food waste must be disposed of in the Applicant’s trash receptacles and then dumped into the large dumpsters provided. The vendor shall provide two (2) forty (40) gallon receptacles for public refuse and one (1) employee to empty trash into the dumpsters during the Festival. The area around the food booth MUST be kept clean at all times! Food vendors may not utilize the standard Festival trash containers. All trash or debris from your booth and surrounding area is to be removed before leaving the Festival.

 

Running water is NOT provided. Food concession vendors must provide appropriate cleaning materials.

 

Please ensure that booth signage MUST be confined to and attached to the booth only. Signage may not extend beyond the booth in any direction over two (2) feet.

 

BY ACCEPTING THIS AGREEMENT, THE EXHIBITOR AGREES THAT THEY CAN READ AND SPEAK ENGLISH WELL ENOUGH TO UNDERSTAND THIS AGREEMENT AND HAVE READ AND COMPREHEND THIS AGREEMENT COMPLETELY. THE EXHIBITOR ACCEPTS FULLY AND AGREES TO ADHERE TO ALL OF THE TERMS OF THIS AGREEMENT AS WELL AS TO COMPLY WITH ALL FEDERAL, STATE, AND LOCAL LAWS AND REGULATIONS.

 

YOUR ELECTRONIC SIGNATURE IS THE LEGAL EQUIVALENT OF YOUR SIGNATURE ON THIS AGREEMENT AND YOU CONSENT TO BE LEGALLY BOUND BY THIS APPLICATION'S TERMS AND CONDITIONS.
