Food Vendor

This is an electronic agreement, and by filling out this application, you are validating and approving this agreement electronically. Your payment will NOT be processed until you receive an acceptance of your application from us via email.

Event Details:

• What: Bean Festival and Championship Outhouse Races
• When: October 24th & 25th, 2025 (Admission is FREE to the public)
• Where: Downtown Mountain View, Arkansas
• Weather: This is an outdoor event and will be held rain or shine.

Terms & Conditions: This agreement sets forth the Terms and Conditions under which the Food Vendor is authorized by the Mountain View Area Chamber of Commerce to operate a food concession for the purpose of selling food, in accordance with Ordinance #90-2 from the City Council of Mountain View, Arkansas.

1. Terms and Conditions:

Hours:
The concession business hours begin on Friday, October 24, 2025, and continue through Saturday, October 25, 2025. Vendors may set up any time AFTER 5:00 PM on Thursday, October 23rd, but must be fully set up no later than 7:00 AM on Friday, October 24th. Only the Executive Director of the Mountain View Area Chamber of Commerce has the authority to grant exceptions.

Menu:
The food vendor agrees to sell only the food items pre-approved by the Mountain View Area Chamber of Commerce. Any changes or additions must be cleared with the Chamber in advance. Failure to comply may result in the removal of unauthorized items or the vendor's removal from the event.

Termination of Rights:
The Chamber of Commerce reserves the right to terminate the vendor’s operation at any time if the quality of the products sold does not meet the standards set by the Mountain View Area Chamber of Commerce Vendor Committee. The Chamber may also terminate this agreement if the vendor violates Health Department regulations, fails to cooperate with Chamber representatives, breaches the agreement, or engages in actions that compromise security.

Refunds:
This is a rain or shine event, and no cancellations or refunds are permitted.

2. Commissions and Payment:

In exchange for the right to sell consumable food or beverages during the festival, the vendor agrees to pay the following fees to the Mountain View Chamber of Commerce:

• $500.00 for non-members
• $400.00 for Mountain View Area Chamber of Commerce members

All prices on items sold by the vendor must include sales tax. The vendor is responsible for the collection and payment of all applicable taxes as required by Arkansas law.

3. Premises:

The vendor agrees to leave the premises in the same condition as they were found. This includes maintaining cleanliness around the vending area, properly disposing of trash, and avoiding the dumping of grease or other waste. All large boxes and oil containers must be disposed of in designated dumpsters. Failure to adhere to these conditions may result in exclusion from future events.

Potable water and electrical hook-ups will be provided; however, vendors must supply their own hoses and electrical cords. The Chamber of Commerce does not provide ice. Vendors are responsible for their own ice supply.

4. Indemnification:

The vendor agrees to obtain liability insurance to cover all claims for losses, injuries, or property damages during the event.

The vendor hereby releases the Mountain View Area Chamber of Commerce, the City of Mountain View, and the sponsoring organization from any liability for damages sustained by the vendor, their volunteers, employees, contractors, or customers. The vendor also agrees to indemnify these parties for any losses or liabilities, including legal defense costs, arising from claims or lawsuits related to injuries or damages involving the vendor’s staff, volunteers, employees, contractors, or customers.
