The purpose of this agreement is to set forth the Terms and Conditions whereby the Food Vendor is authorized by the Mountain View Area Chamber of Commerce to operate a food concession for the purpose of selling food, Ordinance #90-2 from the City Council of Mountain View, Arkansas.
1. TERMS AND CONDITIONS:
HOURS: You are paying for a day of selling at a time. This does not permit you to sell the night before if you set up early. You can begin selling at any time in the morning but must have your food truck moved by 9pm that evening so the vendor for the next day can setup. You can setup earlier than 9pm the night before if the previous vendor has vacated from your spot.
MENU: The food vendor agrees to include only the food items shared with and authorized by the Mountain View Area Chamber of Commerce. Any changes or additions must be cleared with the chamber prior to serving or will be subject to removal. If you have been told to not sell an item and continue to do so, you can and will be removed.
TERMINATION OF RIGHTS:
The Chamber of Commerce reserves the right to terminate the operation of the Vendor at any time if the product being sold is not of the highest quality as determined by the Mountain View Area Chamber of Commerce Vendor Committee. The Chamber of Commerce reserves the right to terminate this agreement at any time if Vendor, in the judgment of the Chamber, violates the provisions of the Health Department; fails to cooperate with the representatives of the Chamber; breaches any of the agreements herein; or causes acts breaching security issues.
REFUNDS: We have a no-cancelation policy. This is a rain or shine event. If you cancel your contract with the Mountain View Chamber of Commerce you forfeit any monies paid to the MVCC.
2. COMMISSIONS AND PAYMENT:
In exchange for the right to sell consumable food or drink on the Mountain View Square, the Vendor agrees to pay the Mountain View Chamber of Commerce a fee of:
$60 for 1 day
$120 for 2 days
$180 for 3 days
$240 for 4 days
$300 for 5 days
$360 for 6 days
$420 for 7 days
3. PREMISES:
The Vendor warrants that the premises shall be left in the same condition that they were found. Vendor shall make every attempt to keep the area around the trailer clean. This includes picking up trash, and no dumping of grease, or any refuse in the vending area. Additionally, this includes securing napkins, straws, or other items that have a tendency to blow around or be spilled. Any large boxes or oil containers must be carried and put in dumpsters located on the premises. Please ask if you do not see a dumping station for such large items. If you leave trash you may not be allowed to return.
Potable water and electrical hook-ups shall be provided. You must provide your own hoses and/or electrical cords.
4. Indemnification:
The Vendor agrees to obtain liability insurance to protect the vendor against all claims for losses, injury, or property damages during the term of the contract.
The Vendor hereby releases the Mountain View Area Chamber of Commerce, the City of Mountain View, and the sponsoring organization from any liability for any damages sustained by the vendor, volunteer’s employees, contractors or customers. The vendor agrees to indemnify the Mountain View Area Chamber of Commerce, the City of Mountain View, and the sponsoring organization for any loss or liability, including the cost of defending any claim or lawsuit the Mountain View Area Chamber of Commerce, the City of Mountain View and the sponsoring organization may suffer as a result of any injuries or damages suffered by the vendor's staff, volunteers, employees, contractors or customers.
