Terms & Conditions
Photo release waiver:I give The Perfect Event and City of Vista permission to release photos, if taken, for publication and media. The Perfect Event and the City of Vista may use photos to promote the event, business or as they see fit. All photographs and videos shall be the property of TPE and TPE retains all rights, title and interest in any andall photographs, video, or other depiction of the Event and all Event guests if taken by its agents, subcontractors or employees for the Event pursuant to this Agreement. Liability Release Waiver:Vendor shall defend, indemnify and hold City and its officers, officials, andemployees (collectively, “City Indemnitees”) and The Perfect Event harmless against any and all liability, loss, damage, fine, penalty, expense, claim or cost (including without limitation costs and fees of litigation) ofevery nature (collectively, “Liability”) caused directly by Vendor's gross negligence or willfulmisconduct in the performance of its express obligations hereunder BY SUBMITTING THIS BOOTH ORDER I AM ACKNOWLEDGING AND AGREEING TO ALL THE ABOVE EVENT TERMS AND THE BELOW WAIVER OF LIABILITY – With my submission, I agree to waive, release, indemnify, and hold harmless, the City of Vista (“City”), and The Perfect Event (“TPE”) from any and all liability, claims, and causes of action, including attorney’s fees and court costs, for injuries or damages to person or property arising out of my participation in the The City of Vista Block Party. I HAVE CAREFULLY READ THIS DOCUMENT AND FULLY UNDERSTAND ITS CONTENTS. I AM AWARE THAT IT IS A FULL RELEASE OF ALL LIABILITY, ASSUMPTION OF RISK AND INDEMNITY AND BY SUBMITTING THIS ORDER I AM ACKNOWLEDGING AND AGREEING TO ALL EVENT TERMS AND WAIVER OF LIABILITY.
