About the application

Lessor hereby grants and leases to said lessee, certain rights, privileges, and space, during the period of the Owosso Curwood festival, June 4th, 2026, through June 7th, 2026, (Thursday through Sunday) to conduct, operate, or sell upon said premises. Such business and articles as are set in the questions below. (menu), signed by the lessee and approved by the festival Board of Directors or its designated representative.

 

Privileges granted under this contract gives the Lessee permission to conduct, operate, or sell from their concession unit only items detailed on the attached sales sheet (menu) and for no other purpose.  Premises or space, use of which is granted to lessee under this contract, are at the location in the approved application to or another space assigned by the lesser.  For the rights and privileges herby granted, the lessee agrees to pay the sum in the application.

Note: Any unit extended past the allowed space stated in the application will be charged an additional fee.  Please reference question 13 in the application questions.

 

CURWOOD FESTIVAL RULES AND REGULATIONS

 

  1. The lessor assumes no liability for loss or damage to any property of the lessee due to fire, tornado, weather conditions, or other causes beyond the control of the lessor.  The lessee, his or her employees and agents, herin agreed to cover by insurance all goods and property brought to or upon the grounds of the lessor.  Lessee further agrees to hold and save said lessor harmless from suit or civil action in case of damage or loss of any kind or character to said property, or from civil.  Or suit action to recover damage or loss to other persons or property brought to or upon the grounds of the lessor, sad, loss or damage occurring as a result of or in connection with the operation and conduct of the privileged contract.
  2. General gerounds security will be maintained through the specified dates of the festival.  Additional or specific security is the responsibility of the lessee.
  3. Fire inspector, authorized electrician, and the lessor shall have full authority to eliminate any hazardous, unauthorized, or unsafe conditions without notice to the lessee.
  4. Wiring and electrical installations, cords, etc., must be of sufficient capacity for the load carried and must conform to the rules and regulations of the lessor.  Any and all installations by individuals and or contractors must be approved by the proper personnel of the lessor and the fire inspector of the County of Shiawassee, and no alterations are permitted after approval.(Plugging two or more units or other elctrical devices into a single cord or outlet is prohibited.)
  5. Equipment or displays causing noise may not be permitted. Operations of sound equipment, sound, movies, television, radio, etc., shall not be permitted when lessor determines such operation as obnoxious or encroaches upon the rights of others.
  6. During hours of operation from June 4th through June 7th, 2026, the festival may be closed due to circumstances beyond the control of the lessor.
  7. Proof of insurance must be submitted to the contract within 10 days of approval of application.
  8. Possession of alcohol or illegal drugs or the use of either is strictly prohibited. Violation will render this contract null and void, and the lessee must vacate his or her location immediately at the request of the festival board or its designated representative, hereupon, alll rights and privileges here and granted will be terminated, and payment previously made will be retained by the lessor.
  9. Lessee is required to obtain a temporary health license from the Shiawassee County Health Department.

 

Submission of Commercial Food application signifies agreement to above listed rules and regulations.

  • Lessee must provide current certificate of insurance, including proof of general liability insurance and product liability insurance with the return of this contract. If requested insurances are not provided at the time of contract approval, spaces will not be secured and or approved by the Board of directos until submitted (with no exceptions).
  • Lessee agrees to operate and conduct the privileges herein granted in strict conformity tot he festival, county, state, and federal lws and the rules and regulations of the lease, or all the rules, regulations, and conditions set forth and printed as a part of this contract are hereby accepted by both parties as an tegral part of this contract.
  • No part of the space covered by this agreement may be used or occupied by any other party or reassigned or sublet by the lessee.
  • Lessee agrees that each vendors concession unit assigned to a designated space which extends past the agreed upon space diminsions will be charged additional fees. The fee structure is 1/2 the cost of each space that the concession unit extends. (EX: Curwood lounge: 5 x 15 space, $250, an additional fee of $200, or 1/2 the cost of the original rental space up to 9 feet.))
  • The lessee agrees to keep the assigned premises clean and to leave the premises and property covered by this contract in the same condition as when he/she took possession. No loudspeaker, amplifier, radio, or other broadcasting device is permitted on the concession operated under this contract without written permission of the Curwood Festival Board of directors or their designated representative. Trash dumpsters will be provided by the festival.
  • Space assigned and not occupied for the purpose of, and hereby set forth at your designated date and time, shall revert back to the lessor and to be r occupied in such a manner and for such purposes as the lessor may see fit, in which event this agreement shall become null and void and all payments herein forfeited to the lessor.
  • No concession unit, in whole or in part, may be dismantled without prior permission of the Curwood Festival Board of Directors or its designated representative prior to 5:00 PM of the last day of the FESTIVAL. Early removal of a concession without prior approval may result in denial of space in future festival years.
  • The location for said privilege will be assigned by the festival Board of Directors or its designated representative. The business of running such privilege shall be conducted to the satisfaction of the festival Board of Directors or its designated representative. Lessee agrees to accept full responsibility for the conduct of the business or wanting such privilege, and any claim thereto.
  • Violation of any portion of this agreement by the lessee shall cause this agreement to become invalid and work a revocation and a forward of all rights and privileges herein granted by the lessee, in all sums paid prior, under the terms of this agreement, shall be forfeited to the lessor.
  • ALL FOOD CONCESSION UNITS AND FOOD SERVICE AREAS WILL BE POSTED WITH A NO SMOKING SIGN PROVIDED BY THE LESSEE. Any section of the document or portion thereof, found by adjudication to be the contrary to the law or constitutional rights, shall be stricken without effect of the remainder.
