About the application

Be a part of Somerville's Winter Village! We're excited to invite vendors to showcase and sell their products at Somerville's first-ever indoor holiday pop-up market.

The village will be open every Saturday from 10 AM to 7 PM and Sunday from 10 AM to 4 PM, beginning November 30 through January 19. Additionally, the village will be open on Friday, December 6, from 4 PM to 9 PM for our Holiday Jubilee!

Updated Commitment for Pop-Up Shop

Please note that the pop-up shop commitment has been changed from a week to just one day. We understand the importance of flexibility, and this change is made to better meet the needs of both participants and the event. We're excited about this new format and look forward to having you be part of it!

 

This pop-up has limited vendor spots available. To be chosen, your business must meet the following requirements:

  • Must not sell food, packaged or otherwise.
  • Products must be high quality and handmade. We will not be accepting any resellers or drop-shippers.
  • Must not conflict directly with established Downtown Somerville businesses.
  • Vendors will be required to handle their own sales, marketing, and maintaining their booth space.
  • Vendors must be willing to submit to a background check
  • All approved vendors are required to submit a Certificate of Insurance (see terms & conditions below)

The DSA team will select vendors that offer complimentary shopping in the downtown district and will not conflict in any way with established retail in Somerville. Space fees are non-negotiable and will be submitted in accordance with terms and conditions.

Terms & Conditions

Terms and Conditions for Somerville Winter Village Vendor Spaces

Vendors ("Sublessee") acknowledge and agree to the following terms for participation in the Somerville Winter Village ("Event"):

 

1. Liability: The Sublessee agrees to assume full responsibility for the space they are renting for the duration of the Event. The Sublessee releases the Event organizers, Downtown Somerville Alliance ("DSA" or "Sublessor"), from any liability related to damage, loss, theft, or injury within the vendor's rented space. The Sublessee is responsible for maintaining the safety and cleanliness of the space and ensuring that all activities comply with local laws and regulations.

 

2. Certificate of Insurance (COI): A valid Certificate of Insurance is required from each Sublessee prior to the start of the Event, naming both "Downtown Somerville Alliance" and "Somerville Realty LLC" as additionally insured. The COI must include General Liability coverage of at least $1,000,000 per occurrence and $2,000,000 annual aggregate, as well as Product Liability coverage. The COI must be submitted and approved prior to move-in.

 

3. Damages: The Sublessee is responsible for any damage to the rented space, fixtures, or property caused by themselves, their employees, or their customers during the Event. Any damages discovered at the conclusion of the rental term will be repaired by the Sublessor, and the Sublessee will be billed for all associated repair costs. A walkthrough inspection of the space will be conducted both before and after the Event to assess any damages.

4. Alterations and Modifications: Sublessees are prohibited from making permanent alterations to the rented space (e.g., painting, nailing, structural changes) without the express written consent of the Sublessor. Temporary modifications, such as the installation of displays or decorations, must not cause damage to the space. The Sublessee agrees to restore the space to its original condition by the conclusion of the Event.

 

5. Sublease Terms: This agreement is for a temporary sublease of the designated space for the duration of the Event from November 30 to January 19. The Sublessee agrees to vacate the space on or before January 26th. Failure to vacate on time may result in additional charges.

 

6. Compliance: The Sublessee must comply with all municipal and state health, safety, fire, and building codes, as well as any additional guidelines set by DSA. This includes obtaining any necessary permits for the operation of their business during the Event. Failure to comply with these regulations may result in immediate termination of the agreement without a refund.

 

7. Indemnification: The Sublessee agrees to indemnify, defend, and hold harmless DSA, Somerville Realty LLC, and their respective owners, agents, and employees from and against any and all claims, liabilities, damages, and expenses (including reasonable attorney’s fees) arising out of or related to the Sublessee’s use of the rented space or participation in the Event.

 

Prices

Application fees + Deposit $150.00 A $150 security deposit is required upon submission to secure your vendor space at the Somerville Winter Village. This deposit will be fully refunded at the conclusion of the event, provided that the rented space is returned in its original condition and no damages or violations of the terms and conditions have occurred. The deposit is intended to cover potential damages or cleaning fees, and any necessary deductions will be communicated to the vendor following a post-event inspection.
