THIS AGREEMENT made between applicant (hereinafter referred to as “CONCESSIONAIRE”) and THE ARTS FOUNDATION FOR MARTIN COUNTY, (hereinafter referred to as “ARTS”), hereby stipulate and agree to the following:
WHEREAS, CONCESSIONAIRE has been granted concession rights for “ArtsFest 2021” on February 20 and 21, 2021. In consideration for these rights,
CONCESSIONAIRE shall pay to the ARTS the vendor fee (selected above) for both days and agrees to pay ARTS an additional 25% of any gross food sales exceeding $5000. All Vendor fees are due on approval or before February 5, 2021.
CONCESSIONAIRE will provide a proposed menu and agrees to sell similar items to those described in application or on attached menu in designated area. ARTS reserves the right to accept or reject any menu items upon review. All vendors’ menu items and prices will be pre-approved no later than February 5, 2021 by the ARTS.
CONCESSIONAIRE must provide a State of Florida Health Department approval and Hood Suppression Inspections Report (Food Trucks only). These documents must be provided with application.
CONCESSIONAIRE will have in full force and affect a one million dollar ($1,000,000.00) general liability/products liability insurance policy and agrees to indemnify and hold ARTS harmless for any claims relating to the provision of food service and participation in the event. CONCESSIONAIRE will also provide a Certificate of Liability naming the ARTS and Martin County Board of County Commisioners as additional insured once approved and prior to setting up at event.
CONCESSIONAIRE will set up on Friday, February 19th, 2021 from 5:00p.m. to 7:00p.m OR Saturday, February 20th from 7:30am to 9:00a.m. Overnight security will be provided throughout the event. Break down will begin Sunday, February 21st no earlier than 5:00p.m. Vehicles will be allowed to move/exit site ONLY when the site has been cleared of patrons, or no later than 6:30p.m. ARTS will give permission and/or a pass when allowed to move/exit from site.
CONCESSIONAIRE shall be set up and prepared to operate all facets of food booth both days no later the 9:30 a.m. and shall remain open until 5:00 p.m. both days of event.
ARTS shall provide no more than the space for food truck/cart as indicated on application.
CONCESSIONAIRE is responsible for all food vendor site planning, booth construction, set up, cleanup of cooking area after the event in cooperation with ARTS. Site set up is to be coordinated with ARTS.
CONCESSIONAIRE shall set up, maintain, and breakdown any additional equipment. Additional equipment needs can be ordered through Eventmakers International (772) 286-1841 on CONCESSIONAIRE’s own invoice. The Fire Marshall will be checking all vendor booths to ensure they are up to code for the event.
CONCESSIONAIRE agrees that any generators used must be 75 decibels or less. Use of park electric may be available at an additional cost. Electricity is not provided.
CONCESSIONAIRE will purchase any ice needed from ARTS or Bar Service (at discounted fixed rates).
CONCESSIONAIRE shall not sell beverages, including but not limited to soda or water – per our Bar Service agreement. Specialty drinks may only be sold with prior approval.
CONCESSIONAIRE will ensure professionalism of all employees, signage, and food truck/carts as defined by ARTS.
CONCESSIONAIRE will pass on to vendors any fees for holding tanks, permits, signage, etc.
